A. 
Uniformity. The regulations within each zone district shall apply uniformly to every proposed development therein whether new construction, expansion or renovation of a property.
B. 
Conformity. No building, structure or land area shall, after adoption of this chapter, be erected, used or altered except to conform with the regulations of the zone district containing the property to be developed, unless:
(1) 
The Board of Commissioners approves an application for a conditional use in accordance with this chapter; or
(2) 
The Zoning Hearing Board grants a variance allowing specific modification of the regulations.
C. 
Yard size and use. No yard or lot area or off-street parking space used by one building, structure or land use shall be credited to another building, structure or use, and no yard or lot or off-street parking area shall be reduced in size so as to be less than the minimums prescribed for the zone district.
D. 
Uses allowed by right. Within each zoning district lands, buildings and structures shall be used, and buildings and structures shall be erected, altered or enlarged only for any of the uses permitted by right in the zone district or after the Board of Commissioner's approval for a conditional use. The principal permitted uses (allowed by right), accessory uses and conditional uses for each zone district are listed below in this article. No use listed in one zone district is allowed in a second district unless listed as a permitted, accessory or conditional use in that second district.
E. 
Location of front yard. The front yard of any lot shall be considered the yard providing access to the principal use entrance or the yard abutting the street that bears the lot's address or, if doubt exists, the yard across the lot with the least width between side lot lines.
A. 
Principal permitted uses. Principal permitted uses shall be as follows:
(1) 
Publicly owned and operated recreation areas.
(2) 
Properties and buildings of public authorities and school districts.
(3) 
Cemeteries.
(4) 
Rights-of-way of limited access highways and railroads.
B. 
Accessory uses. Accessory uses shall be as follows:
(1) 
Maintenance structures and facilities in support of any of the principal permitted uses.
(2) 
Signs as regulated by § 180-25.

C. 
Conditional uses. There shall be no conditional uses in the Conservation District.
D. 
Lot and area requirements. There shall be no minimum lot size requirements except that buildings shall be set back at least 25 feet from a lot or street right-of-way line.
A. 
Principal permitted uses. Principal permitted uses shall be as follows:
(1) 
Single-family detached dwellings.
(2) 
Parks and recreation areas owned and operated by public or nonprofit organizations.
(3) 
Public, public authority or public utility uses that cannot be located elsewhere.
(4) 
Growing of field, forest or orchard crops or nursery stock.
B. 
Accessory uses. Accessory uses shall be as follows:
(1) 
Private garages or parking areas.
(2) 
Private recreation facilities for the use of residents of the property and their guests.
(3) 
Buildings for property maintenance equipment, shelter for household pets owned by the property residents and noncommercial greenhouses.

Signs as regulated by § 180-25.

C. 
Conditional uses. Conditional uses shall be as follows:
(1) 
Cluster residential development (see § 180-28A).
(2) 
Educational, religious or other private nonprofit community use (see § 180-28B).
D. 
Special exception uses. Special exception uses shall be as follows:
(1) 
Home occupation (see § 180-28C).
(2) 
Seasonal sale of nursery stock or orchard crops from property on which it is grown (see § 180-28D).
E. 
Lot and area requirements. Lot and area requirements shall be as follows:
(1) 
Minimum lot area.
(a) 
Every building erected after the effective date of this chapter with a water supply shall be connected to the public sewer system.
(b) 
The minimum lot area for a lot with public sewer and water connection shall be 7,500 square feet.
(c) 
The minimum lot area for a lot with public sewer connection only shall be 40,000 square feet.
(d) 
Any portion of a lot that slopes greater than 16% shall not be included in the minimum lot calculation if the total lot area is less than 40,000 square feet in area.
(2) 
Minimum lot width shall be 60 feet, but lot width shall not be less than 1/3 the lot depth.
(3) 
Minimum front yard setback shall be 25 feet.
(4) 
Minimum side yard setback.
(a) 
The minimum side yard setback shall be 20 feet for both yards and eight feet for one side yard.
(b) 
The minimum side yard setback for a side yard abutting a street shall be 20% of lot width but not more than 25 feet.
(5) 
Minimum rear yard setback shall be 25 feet.
(6) 
Minimum setback of accessory buildings from side or rear lot lines shall be five feet, but 25 feet from a street right-of-way line.
(7) 
Maximum building height shall be 2 1/2 stories and 30 feet.
(8) 
Maximum building coverage of a lot shall be as follows:
(a) 
Principal building: 30% of lot area but not more than 3,000 square feet, whichever is less.
(b) 
Accessory buildings, total: 40% of rear yard area, but not more than 800 square feet, whichever is less.
(9) 
Maximum coverage of a lot by all buildings and paved surfaces shall be 20% of lot area, but not more than 5,000 square feet, whichever is less.
A. 
Principal permitted uses. Principal permitted uses shall be as follows:
(1)

Residential buildings containing two or more dwelling units, but not exceeding eight.
(3) 
Parks and recreation areas owned and operated by a public or nonprofit organization.

Transitional living facility (see § 180-28G).
(4) 
Personal care home (see § 180-28H).

Day-care center (see § 180-28I).
(6) 
Funeral home (see § 180-28J).

Parking lot to serve commercial use on a nearby lot in the Commercial Zone District (see § 180-28K).
(8) 
Professional offices if on a lot abutting State Avenue (see § 180-28L).
E. 
Lot and area requirements. Lot and area requirements shall be as follows:
(1) 
Minimum lot area: 5,000 square feet (all development must be connected to public sewer and water services).
(2) 
Minimum lot width: 50 feet.
(3) 
Minimum front yard setback: 25 feet.
(4) 
Minimum side yard setback shall be:
(a) 
Twelve feet for both yards, five feet one side yard.
(b) 
For a side yard abutting a street: 30% of lot width, but not more than 25 feet.
(5) 
Minimum rear yard setback: 25 feet.
(6) 
Minimum setback of accessory buildings from side or rear lot lines: five feet, but 25 feet from a street right-of-way line.
(7) 
Maximum building height: three stories and 35 feet.
(8) 
Maximum building coverage of a lot.
(a) 
Principal building: 35% of lot area.
(b) 
Accessory buildings, total: 40% of rear yard area, but not more than 600 square feet, whichever is less.
(9) 
Maximum coverage of a lot by all buildings and paved surfaces: 60% of lot area.
A. 
Principal permitted uses. Principal permitted uses shall be as follows:
(1) 
Retail sales businesses conducted entirely within a building.
(2) 
Banks and other financial institutions.
(3) 
Service businesses, including barber and beauty shops, tailor shops, laundromats, dry-cleaning pickup and delivery, repair of items that can be carried by one person, business services, etc.
(4) 
Offices: business, professional or government.
(5) 
Restaurants or coffee shops, not including drive-through.
(6) 
Motel or hotel.
(7) 
Bakery or confectionery store with minor manufacturing for sales on the premises only.
(8) 
Funeral home.
(9) 
Parking lots.
B. 
Accessory uses. Accessory uses shall be as follows:
(1) 
Parking and service areas.
(2) 
Trash storage buildings.
(3) 
Apartments on the second and/or third floor of a building, the first floor of which is devoted to a principal permitted use, provided the lot contains at least 7,500 square feet and there is not more than three such apartments plus one additional apartment for each additional 1,000 square feet of lot area, fractions excluded.

Veterinary office (see § 180-29H).

Special exception uses. Special exception uses shall be as follows:
(1) 
Restaurant drive-through or bank drive-through facility (see § 180-29D).
(2) 
Commercial recreation venture (see § 180-29E).
(3) 
Commercial use similar to and compatible with those that are permitted (see § 180-29I).
E. 
Lot and area requirements. Lot and area requirements shall be as follows:

Minimum lot area: 7,500 square feet (all development must be connected to public sewer and water services).
