A. 
License required; fees; time for compliance.
(1) 
Every owner of a dog five months of age or older on January 1 of any year or a dog which becomes five months of age during a license year shall annually, on or before March 31 or the date the dog becomes five months of age, or within 30 days from the date a dog over five months of age is acquired or brought into the Village of Salem Lakes, obtain a dog license for such dog from the Village Treasurer and shall pay therefor an annual licensing tax as provided in § 272-1 of this Code.
(2) 
The license year shall be from January 1 to the following December 31. The Treasurer shall assess and collect a late filing fee, as provided in § 272-1 of this Code, from every owner of a dog five months of age or over if the owner failed to obtain a license prior to April 1 of any year or within 30 days of acquiring ownership of a licensable dog or if the owner failed to obtain a license on or before the dog reached licensable age.
B. 
Conditions on issuance. As a condition of obtaining a dog license, an owner shall present a valid veterinarian's certificate of rabies vaccination.
C. 
Issuance; collar tags. Upon payment of the required dog license fee and presentation of proof of rabies vaccination, the Village Treasurer shall execute and issue to the owner a dog license, which shall state the date of its expiration and shall bear a serial number and the owner's name and address and the name, sex, breed and color of the licensed dog and whether such dog has been neutered or spayed. A duplicate of such license shall be kept on file by the Village Treasurer. The Village Treasurer shall deliver to the licensee a tag of durable material, which shall bear the license serial number, the name of the county, and the license year.
D. 
Exemption for service dogs. Every dog specially trained to lead blind or deaf persons or to provide support for mobility-impaired persons shall be exempt from the dog license fee, and every resident of the Village of Salem Lakes owning such a dog shall annually receive a free dog license and tag upon application therefor.
E. 
Violations and penalties. Any person, firm or corporation who or which owns, keeps, possesses, has, uses, harbors, holds or maintains any dog within the Village of Salem Lakes violating any of the provisions hereof shall, upon conviction thereof, be subject to a penalty as provided in § 1-4 of this Code. Each and every day of violation shall constitute a separate offense.
A. 
Definition. "Kennel" means any lots or premises on which five or more dogs or cats, or both, at least four months of age are kept, boarded or trained, whether in special structures or runways or not.

B. 
License required.
(1) 
No person shall operate a kennel within the Village without first obtaining a license from the Village Board therefor.
(2) 
Application for an initial license or renewal license shall be made on forms supplied by the Village Clerk.
(3) 
Upon submission of an initial or renewal application, the applicant shall pay a license tax as provided in Chapter 272, Article I, of this Code in accordance with § 174.053, Wis. Stats.
(4) 
Upon submission of the application, the applicant shall also pay a license fee as provided in Chapter 272, Article I, of this Code to aid in defraying the costs and expense of administering the provisions of this section, including any required inspection.
(5) 
The license year shall be from January 1 to the following December 31.
C. 
Plan Commission review of license applications and certain renewals. The provisions of this subsection apply only to an initial license application and to any renewal which does not comply with the requirements of this section pursuant to Subsection F(2).
(1) 
Upon the filing on an application and prior to the conduct of a public hearing as provided in this section, the Village shall conduct an inspection of the premises to be licensed or for which the license is to be renewed to determine if the premises complies with the requirements of this section and provides for the humane and sanitary care of dogs and cats. The Village shall prepare a written report of such inspection and file the same with the Plan Commission.
(2) 
The Plan Commission shall hold a public hearing upon the application, which hearing shall be held upon not less than 10 days' notice. Notice shall be mailed to the applicant and to the owners of property within 250 feet of the boundaries of the parcel upon which the kennel is to be located or, in the case of a renewal not complying with the requirements of this section as provided in Subsection F(2), to the applicant and the owners of property within 250 feet of the boundaries of the parcel upon which the kennel is currently located. In addition, the Plan Commission shall cause a notice of the public hearing to be published as a Class 1 notice and posted at the Village Hall and on the Village website. At this public hearing the Plan Commission shall keep minutes of its proceedings, which may be by means of a mechanical recording device.
(3) 
Following public hearing the Plan Commission shall make a finding as to whether or not the proposed kennel adequately provides for the humane and sanitary care of dogs and cats, that zoning will permit a kennel to be established on the proposed site, and that the applicant has complied with all ordinances, rules and regulations.
(4) 
In formulating its recommendation to the Village Board with regard to the issuance of a kennel license, the Plan Commission shall take into consideration any laws, ordinances or regulations that the applicant may have violated relating to the care and treatment of animals.
D. 
Kennel license tags. The provisions of § 174.053, Wis. Stats., are incorporated herein and shall govern the placement of tags under kennel licenses, including but not limited to compliance with any requirements for proof of rabies or other required vaccinations.
E. 
Location. A kennel shall not be located in such proximity to residential areas within the Village as to disturb the peace or create a nuisance to such proximate residential areas, and the location of any such kennel shall comply with all applicable provisions of the Village Zoning Ordinance.
F. 
Issuance.
(1) 
The Village Board shall have the authority to grant or deny the initial application for the kennel license following consideration of any recommendations by the Plan Commission. The Village Board shall have the authority to impose such conditions as may be reasonably necessary to ensure that the kennel is operated in a manner which does not disturb the peace or otherwise create a nuisance within the Village.
(2) 
The Village Clerk shall have the authority to issue any renewal license following satisfactory inspection of the premises by the Village and the applicant's compliance with the requirements of Subsection B(3) and (4). However, if the Village inspection or other information available to the Clerk indicates that the kennel or its operation does not comply with the requirements of this section or provide for the humane and sanitary care of dogs and cats, the Clerk shall refer the application to the Plan Commission and the provisions of Subsection C shall apply.
