Adoption by reference. The following statutes defining offenses against the peace and good order of the state are adopted by reference to define offenses against the peace and good order of the County, provided the penalty for commission of such offenses hereunder shall be limited to a forfeiture imposed under Chapter 1, General Provisions, Article III, General Penalty, of the Code of Washington County.

B.
Limitation. Forfeiture penalties for the commission of any of the foregoing adopted State Statutes for which the actor could be charged with a felony as defined in §§ 939.50 and 939.60, Wis. Stats., do not apply unless the matter has been referred to the District Attorney and the District Attorney refuses to prosecute the matter as a criminal charge.
