As used in this article, the following terms shall have the meanings indicated:
CERTIFIED MASSAGE THERAPIST
Any person who holds a valid certificate for certification as a massage, bodywork and somatic therapist from the State of New Jersey pursuant to N.J.S.A. 45:11-53.
HEALTHCARE PROVIDER
Professional licensed by the Board of Medical Examiners.
MASSAGE
Administration, by any person, of a method of exerting or applying pressure, friction, moist hot or cold external applications, rubbing, stroking, kneading, pounding or tapping of the human body by any physical or mechanical means.
MASSAGE ESTABLISHMENT
An establishment or business operation wherein massage is administered or permitted to be administered for any form of consideration.

It shall be unlawful for any person to operate or participate in the operation of any massage establishment unless such establishment provides only:
A. 
Massage by a certified massage therapist or healthcare provider; or
B. 
Massage to the scalp, face, neck, shoulders, back, arms, hands, legs or feet only, administered at barbershops, beauty parlors, nail salons or spas.

The Police Department and the Health Official are designated to enforce the provisions of this article in accordance with due process of law.

Any person who shall violate or fail to comply with any provision of this section shall be subject to a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days, or a period of community service not exceeding 90 days, or any combination of the above.
