This Part is enacted pursuant to authority granted in the Pennsylvania Intergovernmental Cooperation Act, Act 177 of 1996 (53 Pa.C.S.A. § 2301 et seq.), as amended.

By enactment hereof, the Borough Council of the Borough of Honey Brook hereby approves entering into the Intergovernmental Cooperative Implementation Agreement for Honey Brook Township and Honey Brook Borough (the "agreement") with Honey Brook Township, in substantially the form attached to this Part and hereinafter included as an attachment to this Part[1] and authorizes and directs the Borough Council President to execute, and the Secretary of the Borough to attest, such agreement.

The term of this agreement shall run for the duration of the effectiveness of the Multi-Municipal Comprehensive Plan with certain termination rights as outlined in the agreement.

The Township of Honey Brook and the Borough of Honey Brook (the "municipalities") negotiated this agreement to support the goals and objectives of the Multi-Municipal Comprehensive Plan as adopted by the both municipalities, including required municipal cooperation to achieve such goals and objectives.

Each municipality shall be responsible for its own costs except as separately set forth in the agreement.

Each municipality shall appoint members of its individual Planning Commissions to serve on the Multi-Municipal Planning Committee. Additional terms on the organizational structure and duties for the committee are set forth within the agreement and shall further be established upon agreement of the municipalities.

All property shall be acquired, managed or disposed of directly by the municipalities, in accordance with the terms of the agreement. No acquisition of real property or real estate is authorized.

No new entity has been created by the agreement, and therefore no employees are required. The utilization of municipal consultants to be compensated directly by their respective municipalities is contemplated in the agreement.
