The Borough shall have the right of access at reasonable times
to any part of any improved property served by the sewer system as
shall be required for purposes of inspection, measurement, sampling
and testing and for performance of other functions relating to service
rendered by the Borough through the sewer system.
The Borough reserves the right to amend this chapter or to adopt
additional rules and regulations from time to time as it shall deem
necessary and proper in connection with the use and operation of the
sewer system or as may be required to meet necessary costs and expenses.
No officer or employee of the Borough is authorized to vary
these rules without action by the Borough Council.
The Borough shall not be liable for a deficiency or failure
of service when occasioned by an emergency, required repairs, or failure
from any cause beyond control. The Borough reserves the right to restrict
the use of sewer service whenever the public welfare may require it.
Each owner must give the Borough written notice of his address,
any change of address, any change of ownership, and of the use or
uses of any improved property or any part thereof or any change in
such use or uses.

Any person who violates or permits a violation of this chapter
shall, upon conviction in a summary proceeding under the Pennsylvania
Rules of Criminal Procedure, be guilty of a summary offense and shall
be punishable by a fine of not more than $1,000, plus court costs
and reasonable attorneys' fees incurred by the Borough in the enforcement
proceedings. Upon judgment against any person by summary conviction,
or by proceedings by summons on default of the payment of the fine
or penalty imposed and the costs, the defendant may be sentenced and
committed to the Borough correctional facility for a period not exceeding
10 days or to the county correctional facility for a period not exceeding
30 days. Each day that such violation exists shall constitute a separate
offense, and each section of this chapter that is violated shall also
constitute a separate offense. In addition to or in lieu of enforcement
under this section, the Borough may enforce this chapter in equity
in the Court of Common Pleas of York County.
In the event that any provision, section, sentence, clause or
part of this chapter shall be held to be invalid, such invalidity
shall not affect or impair any remaining provision, section, sentence,
clause or part of this chapter, it being the intent of the Borough
that such remainder shall be and shall remain in full force and effect.
