No building shall be occupied by a principal use or changed from one principal use to another, and no building erected, constructed, altered or extended shall be occupied until a certificate of occupancy has been issued by the Borough stating that the building(s) and proposed use(s) fully comply with the provisions of all applicable Borough ordinances. No building shall be occupied after a change in ownership or tenancy until a certificate of occupancy has been issued by the Borough.
All applications for certificates of occupancy shall be made in writing on form(s) authorized and approved for such purpose by Borough Council. All applications shall be accompanied by a fee in an amount to be established by resolution of Borough Council.
A. 
Where building permit required. In cases where a building permit is required, the certificate of occupancy shall be applied for contemporaneously with the building permit application. The certificate of occupancy shall be retained by the Borough until such time as the building in question has been approved as in compliance with the provisions of Chapter 470, Zoning, of the Code of the Borough of West York, and all other applicable Borough ordinances. Under such circumstances, the certificate of occupancy shall be granted or denied within 15 days after the Borough has been notified of the completion of the permitted construction or alteration.

B. 
Establishment of use, change of use, change of ownership or tenancy. In cases involving the establishment of a use or the change of use, or in cases involving change of ownership or tenancy, only an application for certificate of occupancy is required. The certificate of occupancy shall be granted or denied within 15 days of the date of the filing of the application.

C. 
Certificate denial. In cases where the application for certificate of occupancy has been denied, the Borough shall provide the applicant with written notice of the reason(s) for denial concurrently with the notice of denial.
A certificate of occupancy issued under this chapter shall expire and become void 90 days from the date of issuance unless the approved occupancy, use or change of use is commenced.
This chapter shall be effective at 12:00 midnight, July 1, 2003.
