[HISTORY: Adopted by the Village Board of the Village of Winneconne as Title 10, Ch. 4, of the 2012 compilation of ordinances, as amended through 2-28-2018. Subsequent amendments noted where applicable.]
All state laws applicable to this chapter, including § 23.33, Wis. Stats., are hereby adopted pursuant to the authority given to the Village by § 23.33(11), Wis. Stats.
As used in this chapter, the following terms shall have the meanings indicated:
ALL-TERRAIN VEHICLE or ATV
A commercially designed and manufactured motor-driven device that has a weight, without fluids, of 900 pounds or less, has a width of 50 inches or less, is equipped with a seat designed to be straddled by the operator, and travels on three or more low-pressure tires or nonpneumatic tires or as defined in § 23.33(1)(b), Wis. Stats., and any amendments thereto.

ALL-TERRAIN VEHICLE ROUTE or ATV/UTV ROUTE
A highway or sidewalk designated by Village ordinance for use by all-terrain vehicle operators or ultra-terrain vehicle operators or as defined in § 23.33(1)(c), Wis. Stats., and any amendments thereto.

GOLF CART
A vehicle whose speed attainable in one mile does not exceed 20 miles per hour on a paved, level surface, and that is designed and intended to convey one or more persons and equipment to play the game of golf in an area designated as a golf course or as defined in § 23.33(fm), Wis. Stats., and any amendments thereto. A golf cart is not an ATV or UTV and is not allowed on the all-terrain vehicle routes established by this chapter.
ULTRA-TERRAIN VEHICLE or UTV
Any of the following, or as defined in § 23.33(ng), Wis. Stats., and any amendments thereto:
A. 
A commercially designed and manufactured motor driven device that does not meet federal motor vehicle safety standards in effect on July 1, 2012, that is not a golf cart, low-speed vehicle, dune buggy, mini-truck, or tracked vehicle, that is designed to be used primarily off of a highway, and that has, and was originally manufactured with, all of the following:
(1) 
A weight, without fluids, of 2,000 pounds or less.
(2) 
Four or more low-pressure tires or nonpneumatic tires.
(3) 
A steering wheel.
(4) 
A tail light.
(5) 
A brake light.
(6) 
Two headlights.
(7) 
A width of not more than 65 inches.
(8) 
A system of seat belts, or a similar system, for restraining each occupant of the device in the event of an accident.
(9) 
A system of structural members designed to reduce the likelihood that an occupant would be crushed as the result of a rollover of the device.
B. 
A commercially designed and manufactured motor driven device to which all of the following applies:
(1) 
It has a weight, without fluids, of more than 900 pounds but not more than 2,000 pounds.
(2) 
It has a width of 50 inches or less.
(3) 
It is equipped with a seat designed to be straddled by the operator.
(4) 
It travels on three or more low-pressure tires or nonpneumatic tires.
A. 
Operators must have attained the age of 16 and must have a valid driver's license to operate an ATV/UTV on any ATV/UTV route designated by the Village.
B. 
Helmets must be worn on any operator or passenger of an ATV/UTV if they are under the age of 18.
C. 
Eye protection must be worn by any operator of an ATV/UTV.
D. 
ATV/UTV operation on any sidewalk in the Village is prohibited unless stated in this chapter.
E. 
ATV/UTVs must be registered for public use through the Department of Natural Resources.
F. 
Headlights must always be operational and visible from 200 feet and tail lights must always be operational and visible from 500 feet in the hours of darkness.
G. 
Speed limit on Village ATV/UTV routes is 25 mph.
H. 
Operators shall operate in single file on the right side of the roadway.
I. 
Hand signals shall be used when turning.
J. 
Village residents wishing to use the Village ATV/UTV routes must travel directly from their residence to the Village ATV/UTV route.
K. 
Lake Winneconne Park must be accessed via the most direct travel from the Village route.
L. 
Hours of operation are from 7:00 a.m. to 11:00 p.m.
M. 
Village ATV/UTV routes can be closed temporarily at any time by the Village Administrator or Police Chief when public safety is at risk.
N. 
The Village ATV/UTV routes are intended for recreational travel to and from other ATV/UTV routes located outside the Village, places of business or other destinations along the Village ATV/UTV routes. The Village ATV/UTV routes are not intended for continuous circular travel on the Village ATV/UTV route only.
A. 
All regulations in §§ 502-1 through 502-3 apply to this subsection.
B. 
A person may operate an ATV/UTV outside of the Village ATV/UTV routes for snow removal purposes only under the following conditions:
(1) 
The ATV/UTV shall have a snow removal device attached to it.
(2) 
ATVs only (no UTVs) shall be allowed on public sidewalks for snow removal, and only at a speed not to exceed 10 mph.
(3) 
Snow removal operation of ATV/UTV is allowed only between October 1 and April 30.
(4) 
The ATV/UTV must display one or more illuminated, yellow lights that flash or rotate and are visible for 360° and 100 feet.
The following are Village ATV/UTV routes:
A. 
Main Street (State Highway 116):
The entire length of Main Street (State Highway 116) within the Village, including over the bridge.
B. 
West side routes:
Grant Street from State Road 116 to S. 6th Street to W. Main Street.
Lakeshore Road to N. 9th Street to W. Main Street.
C. 
East side routes:
N. 9th Avenue from E. Main Street to Wolf Run.
E. Main Street to N. 6th Avenue to Parkway Drive.
A.

B. 
When crossing the Main Street/Highway 116 Bridge, in addition to all other regulations found in this chapter, all ATV/UTV operators must:
(1) 
Stop the ATV/UTV prior to crossing the bridge; and
(2) 
Yield the right-of-way to other vehicles, pedestrians, and electric personal assistive mobility devices using the roadway or shoulder.

Any person who shall violate any provision of this chapter shall be subject to a penalty as determined by Village Board. See § 1-3 of this Code.
Upon passage, the Village Clerk-Treasurer shall immediately send a copy of this ordinance to the Department of Natural Resources, the state traffic patrol, and to the office of any law enforcement agency of each county, town, city or village having jurisdiction over any of the highways to which the ordinance applies.
