This article shall be known and may be cited as the "Quarryville
Borough Parking Ordinance."
Words and phrases, when used in this article, shall have the
meanings ascribed in the Vehicle Code, 75 Pa.C.S.A. § 101
et seq., as hereinafter amended, supplemented, modified or reenacted
by the General Assembly of Pennsylvania (hereinafter referred to as
the "Vehicle Code"), unless the context clearly indicates a different
meaning. In this article, the singular shall include the plural, the
plural shall include the singular, and the masculine shall include
the feminine and neuter genders.

Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas.
The chief of the Police Department.
The Quarryville Borough Police Department or any successor
municipal or multi-municipal police department having jurisdiction
within the corporate boundaries of the Borough.
Any officer of the Police Department.
Shall be used interchangeably with the word "highway" and
shall have the same meaning as the word "highway" defined in the Vehicle
Code.
All traffic and parking regulations of a permanent nature shall
be enacted as ordinances, as parts of ordinances, as amendments to
ordinances or as amendments to this article.
The provisions of this article, so far as they are the same
as those of ordinances in force immediately prior to the enactment
of this article, are intended as a continuation of such ordinances
and regulations and not as new enactments. The provisions of this
article shall not affect any act done or liability incurred, nor shall
they affect any suit or prosecution pending or to be instituted to
enforce any right or penalty or to punish any offense under any such
ordinances or regulations aforesaid.
A.
The Police Chief or Maintenance Superintendent shall have the following
powers to regulate traffic and parking temporarily and in time of
emergency.
(1)
In the case of fire, flood, storm or other emergency, to establish
temporary traffic and/or parking regulations;
(2)
In the case of emergency or to facilitate public works, or in the
conduct of parades, processions or public events, to restrict or prohibit
traffic and/or parking in limited areas for periods of not more than
72 hours.
B.
Such temporary and emergency regulations shall be enforced by the
Police Department in the same manner as permanent regulations. Any
person who shall operate or park a vehicle or tractor in violation
of any such regulations, or who shall move, remove, destroy, injure
or deface any sign or marking erected, posted or made to give notice
of the regulation, shall, upon conviction thereof, be subject to the
penalty set forth in the Vehicle Code or elsewhere in this article
for a violation of such nature, and, in case of a violation for which
no specific penalty is set forth in the Vehicle Code or elsewhere
in this article, to a fine of not more than $25, together with costs
of prosecution.
The Borough Council may, from time to time by resolution, designate
places upon and along the highways in the Borough where for a period
of not more than 90 days, specific traffic and/or parking regulations,
prohibitions and restrictions shall be in force and effect, and shall
designate such locations by proper signs and markings. Such regulations,
prohibitions and restrictions shall be effective as if they had been
specified in this article. No person shall operate or park a vehicle
or tractor in violation of any such regulation, prohibition or restriction,
and no person shall move, remove, destroy or deface any sign or marking
erected, posted or made by authority of this section. Any person who
shall violate any provision of this section shall, upon conviction
thereof, be subject to the penalty set forth in the Vehicle Code or
elsewhere in this article for violation of such nature, and in case
of a violation for which no specific penalty is set forth in the Vehicle
Code or elsewhere in this article, to a fine of not more than $25
together with costs of prosecution; provided, the purpose of this
section is to allow for the testing and experimental determination
of the feasibility and desirability of permanent changes in the ordinances
of the Borough relative to traffic and parking.
Police officers are hereby given authority to direct traffic
on the highways of the Borough and at intersections thereof and to
enforce the provisions of this article.
No person shall drive a vehicle, other than a human-powered
vehicle, upon a sidewalk or sidewalk area except upon a permanent
or duly authorized temporary driveway. Any person who shall violate
any provision of this section shall, upon conviction thereof, be sentenced
to pay a fine of $25 together with costs of prosecution.
No vehicle shall be parked upon either public or private property
in a zone which shall have been posted in a manner prescribed by law
designating the zone as a handicapped parking area unless such vehicle
bears a handicapped registration plate or a disabled American veteran
registration plate or a disability parking placard, and is being used
to transport a handicapped person or disabled veteran. Any person
who violates any provision of this section shall, upon conviction
thereof, be subject to a fine not to exceed $50 together with costs
of prosecution.

A.
No vehicle shall be parked for a continuous period (as hereinafter
defined) of more than two hours between 8:00 a.m. and 6:00 p.m. on
days other than Sundays and legal holidays on the hereafter-designated

B.
The hours referred to in this section shall be according to standard
or daylight time, whichever is currently being observed in the Borough.
The purpose of this section is to prevent street parking spaces from
being monopolized by a few "all-day" parkers and to free such spaces
for short time use by greater numbers of people on shopping and business
errands; and, therefore, to effectuate this purpose, a vehicle shall
be deemed to be parked "continuously," within the meaning of this
article, if it is removed from one parking place and reparked, within
15 minutes thereafter, in another parking place on any street within
the above specified restricted area within 500 feet of the former
parking place.
Every vehicle parked upon a highway shall be positioned to the right side of the highway with the right-side wheels within 12 inches of the curb or right-hand edge of the highway. On one-way streets, vehicles may be parked with either the right or left side thereof to the curb when headed in the legal direction of traffic, unless parking on such side is otherwise prohibited. Any person who violates any provision of this section shall be subject to the penalties set forth in § 385-22 of this article.
A.
Parking prohibitions.
(1)
No vehicle shall be parked within 15 feet of any fire hydrant.
(2)
No vehicle shall be parked within 20 feet of any intersection of
two or more highways.
(3)
No vehicle shall be parked within 30 feet of any stop sign, flashing
signal light, yield sign, or traffic control signal.
(4)
No vehicle shall be parked within 50 feet of any railroad crossing.
No vehicle shall at any time be parked in front of any private garage or driveway or within a private drive so as to impede or prohibit entrance or exit, unless the vehicle blocking such garage, driveway or private drive is that of the owner of the garage, driveway or private drive. Notwithstanding the foregoing, no vehicle shall be parked in any manner so as to impede or prohibit the passage of emergency vehicles. Any person who violates any provision of this section shall be subject to the penalties set forth in § 385-22 of this article.
A.
It shall be a violation for any person to do any of the following
on any public streets or highways within the Borough of Quarryville:
(1)
Park a motor vehicle that does not have either a current registration
or current inspection sticker.
(2)
Park on a sidewalk.
(3)
Park in any area or zone where parking is prohibited by the posting
of signs.
(4)
Park double/blocking traffic lane.
(5)
Park on the left side facing traffic.
(6)
Park outside of boundary lines. Whenever a space is marked off on
any street for the parking of an individual vehicle, every vehicle
parked there shall be within the lines bounding that space.
(7)
Park in front of a mailbox so that a postal worker cannot deliver
mail.
A.
It shall be unlawful for any person to park on any public street
or alley in the Borough of Quarryville any commercial vehicle with
a registered gross weight in excess of 9,000 pounds or any truck tractor
and/or semi-trailer and to allow such vehicle to remain parked there
for longer than one hour between the hours of 6:00 p.m. and 6:00 a.m.
on weekdays or for more than one hour between the hours of 6:00 p.m.
Saturday and 6:00 a.m. on Monday.
No person shall park or permit to be parked a trailer, camper trailer, camper, boat and trailer combination, or utility trailer, loaded or unloaded, upon a public highway in excess of 48 continuous hours. Any person who violates any provision of this section shall be subject to the penalties set forth in § 385-22 of this article.
No vehicle shall be parked upon either public or private property in a designated fire lane which has been so designated in a manner prescribed by law. Any person who violates any provision of this section shall be subject to the penalties set forth in § 385-22 of this article.
No person engaged in the business of repairing or maintaining vehicles shall do so while a vehicle is parked upon a highway except in the case of making emergency repairs, at which time necessary and appropriate warning signs and/or safety devices shall be placed or utilized to warn other traffic upon the highway. Any person who violates any provision of this section shall be subject to the penalties set forth in § 385-22 of this article.
No person operating or in charge of a motor vehicle shall permit the vehicle to park or stand unattended, upon public or private property, without first stopping the engine, removing the keys and/or placing the ignition switch in the locked position. Any person who violates any provision of this section shall be subject to the penalties set forth in § 385-22 of this article.
A.
It shall be the duty of police officers and parking enforcement personnel
of the Borough to report to the Police Chief all violations of any
provision of this article, indicating in each case: the section violated,
the license number of the vehicle involved in the violation, the location
where the violation took place, the time and date of the violation,
and any other facts that might be necessary in order to secure a clear
understanding of the circumstances attending the violation. The police
officer or other person making the report shall also attach to or
place upon every such vehicle a notice stating that the vehicle was
parked in violation of this article. The notice shall contain instructions
to the owner or driver of the vehicle that if he shall report within
five working days to the Quarryville Borough Office during normal
business hours and pay the sum set forth below, or mail the sum set
forth below to the Quarryville Borough Office, so that it is received
within five days after the time of the notice, that act will save
the violator from prosecution and from payment of the fine and costs
of prosecution prescribed in the first sentence of this section.
B.
Penalties for violations are as follows:
(1)
No-parking zone: $10.
(2)
Overtime parking: $10.
(3)
Loading zone: $10.
(4)
Parking left side: $10.
(5)
No parking - no stopping permitted: $10.
(6)
Parking more than 12 inches from curb: $10.
(7)
Parking less than 20 feet from an intersection: $10.
(8)
Parking less than 15 feet from fire hydrant: $15.
(9)
Parking double/obstructing traffic lane: $15.
(10)
No parking in fire lane: $15.
(11)
Parking in handicapped zone: $50.
(12)
All others: $10.
C.
Any person who violates any other provision of this article shall,
upon conviction, be sentenced to pay the penalties or fines set forth
in the Vehicle Code or elsewhere in this article for violations of
such nature, together with costs of prosecution.
D.
If the notice of violation is not satisfied within five days, a letter
sent by first class mail shall be issued by the Police Department
and an additional $5 shall be applied to the penalty. If the violation
has not been satisfied within 30 days after it has been issued, than
the violator shall be prosecuted.
The provisions of this article are severable, and if any section,
sentence, clause, part or provision hereof shall be held to be illegal,
invalid or unconstitutional by any court of competent jurisdiction,
such decision of the court shall not affect or impair the remaining
sections, sentences, clauses, parts or provisions of this article.
It is hereby declared to be the intent of the Borough Council that
this article would have been enacted if such illegal, invalid or unconstitutional
section, sentence, clause, part or provision had not been included
herein.
