Whenever the Fire Prevention Bureau or the Building Inspector
shall determine that conditions exist in an abandoned building which
are dangerous or injurious to the occupants of neighboring buildings
or other residents in Roselle, as provided by law, it or he shall
issue and cause to be served upon the owner of and parties in interest
in such building a complaint stating the charges in that respect and
containing a notice that a hearing will be held before the County
Board of Appeals pursuant to their rules and regulations.
If, after such notice and hearing, the Board of Appeals determines
that conditions exist in such abandoned building which are dangerous
or injurious to the health or safety of the occupants of neighboring
buildings or other residents in Roselle, it shall state in writing
its findings of fact in support of such determination and shall issue
and cause to be served upon the owner thereof and parties in interest
an order:
A. Requiring the repair, alteration or improvement of said building
to be made by the owner within a reasonable time, which time shall
be set forth in the order; and
B. If the owner fails to repair, alter or improve said building within
the time specified in the order, then the owner shall be required
to remove or demolish said building within a reasonable time as specified
in said order.
If the owner fails to comply with an order to repair, alter,
improve or demolish the building, the Fire Prevention Bureau or the
Building Inspector, whoever made the complaint, may cause such building
to be repaired, altered or improved or may contract for the removal
or demolition thereof after advertisement for and receipt of bids
therefor.

The amount of:
A. The cost of the filing of legal papers, expert witnesses' fees, search fees and advertising charges incurred in the course of any proceeding taken under §§
540-1 through
540-3 determined in favor of Roselle; and
B. The cost incurred by the Borough in undertaking such repairs, alterations
or improvements, or vacating and closing, or removal or demolition,
if any, or the amount of the balance thereof remaining after deduction
of the sum, if any, realized from the sale of materials derived from
such building or from any contract for removal or demolition thereof,
shall be a municipal lien against the real property upon which such
cost was incurred. In addition to the costs associated with the repair,
alteration, improvement or abatement, a charge of 15% of the total
cost shall be imposed as an administrative charge.

Demolition requirements for buildings, structures, garages and
shed in excess of 100 square feet.
All applications for demolition are subject to UCC and local
regulations contained herein and throughout the Borough Code.
A. Permit application are to be submitted to the Building Department
as follows: UCC Folder F-100, Building Subcode UCC F-110 and Construction
Permit UCC F-170. All forms are to be completed with the present owner
in fee information.
B. Disconnect letters from the following utilities: electric, gas (turned
off at the main and meter removed), phone, cable and water service.
(Water meter must be removed.)
C. Certification of rodent and vermin baiting from a licensed pest control
service reflecting that the baiting service has been performed for
at least seven days. The service must be performed within two weeks
of submission of the application.
D. Current certificate of insurance from the contractor listing the
Borough of Roselle as certificate holder with minimum coverage of
$300,000.
E. Notarized letter from the property owner or mortgage holder stating
the approval for the demolition.
F. All oil tanks, above or underground, must be removed under separate
permit application prior to issuance of demolition permit. This includes
tanks previously sand or concrete filled. If no tank is present, certification
must be provided by means of a "tank sweep" or other approved method.
G. Certification from a licensed asbestos contractor following an inspection
of the building or structure certifying no asbestos is located at,
on or in any building or structure located on the property or certification
of removal provided by a licensed asbestos removal company. This certification
will include all disposal manifests, air-monitoring reports and any
other applicable reports required by federal, state, local jurisdictions,
including the Roselle Board of Health.
H. Confirmation of current taxes paid, provided by the Roselle Tax Collector.
I. An approved application from Somerset/Union Soil Conservation.
J. Upon submission, the applicant will schedule an inspection with the
Building Official or his designee for compliance with the regulations.
Upon compliance, the demolition permit can be issued.
K. Upon completion of the demolition, an inspection will be required
for issuance of a certificate of approval. All debris must be removed
and the site must be graded with clean backfill to insure proper water
runoff, as not to infringe on neighboring properties. All foundations
and footings must be removed. A sewer cap inspection is also required.
