Town of Marcellus, NY Article V Inspection; Penalties; Exceptions

§ 137-22 Inspection and enforcement.

The Health Officer for the County and the Town Board of the Town of Marcellus shall enforce all of the provisions of this chapter. At all times, the Town Board or their designated employees shall have the right to enter upon such mobile home park or other premises used for the parking or location of a mobile home.

§ 137-23 Penalties for offenses.

[Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]

Any violation of the requirements of this chapter shall be punished by a fine and/or imprisonment as set forth in Chapter 235, Zoning, § 235-30. Each continuous 24 hours of violation shall be considered a separate offense.

§ 137-24 Exceptions.

A. None of the provisions of this chapter shall be applicable to the sale, storage or garaging of a mobile home or homes within a building or structure.

B. None of the provisions of this chapter shall be construed in any way to permit the maintenance of mobile homes, mobile home parks or travel parking areas in any residential zone, and the same is hereby prohibited in any residential zone in the Town of Marcellus.

C. None of the provisions of this chapter shall be construed as permitting the sale, storage, garaging or maintenance of any mobile home or homes except as specifically permitted in this chapter and the same is hereby prohibited.

§ 137-25 Severability.

If any section, paragraph, subdivision or provision of this chapter shall be invalid, such invalidity shall apply only to the section, paragraph, subdivision or provisions adjudged invalid and the rest of this chapter shall remain valid and effective.

§ 137-26 Effective date.

This chapter shall take effect and be in force from and after the first day of August 1968.
