The Mayor and Council of the Borough of Roselle shall be required
to authorize all change orders except:
A. When an emergency condition requires immediate action, the Borough
Engineer or the Superintendent of Highways may authorize the necessary
actions to be taken, but only to the extent necessary to meet the
emergency. In such cases, the action taken shall be reported promptly
to the Mayor and Council of the Borough of Roselle, which shall then
act to ratify the action and authorize payment. The procedures prescribed
in the Local Public Contract Guidelines and Local Public Contract
Regulations promulgated by the Local Finance Board, Division of Local
Government Services, New Jersey Department of Community Affairs, on
April 5, 1977, shall be utilized.
B. Minor field modifications, to the extent normally permitted by the
Mayor and Council of the Borough of Roselle and its appropriate administrative
officials, shall be authorized, provided that they do not affect the
overall scope of work of the contract. If change orders will result
in an inability to complete the full contracted scope of services
without increasing the contracted price, the Mayor and Council must
approve in advance.
C. If the awarded contract includes a sum for contingencies, said sum
shall be encumbered against the particular appropriation, and charges
against that amount may be authorized by the Borough Engineer or the
Superintendent of Highways, provided that the sum so included does
not exceed 20% of the entire contract.
