This article provides rules for use of any area the City has fenced off and set aside for use as a dog park, where dogs are allowed to run and play under the supervision of responsible adults. Dogs are allowed to be off-leash within the dog park and, provided all requirements of this article are complied with, shall not be considered running at large under Article
II of this chapter.
As used in this article, the following terms have the following
meanings:
DOG PARK
Any area the City has designated by fencing, signage or otherwise
as an exercise/play area for dogs.
OWNER
Includes any person or persons, firm, association or corporation
owning, keeping or harboring a dog, or any other person having custody,
possession or control of a dog.
No person shall enter the dog park between sunset and sunrise.
The City may close the dog park at other times if necessary for maintenance.
This article may be enforced by the Animal Control Officer or
any officer of the Westbrook Police Department.

Any person who violates any provision of this article is subject to civil penalties as set forth in Chapter
A401, Master Fine Schedule, per violation. In addition to civil penalties, the City may seek equitable or injunctive relief, including an order that the person committing the violation be prohibited from entering the dog park. The City shall be entitled to reimbursement of its costs of enforcement, including its attorney fees.
