The following municipal parking lots are hereby established,
to be used in accordance with the restrictions, limitations and provisions
set out in this division:
(a) Lot No. 1: The lot between the southwest side of Elm Street between
East Broad Street and Cowperthwaite Place and the northeast side of
Prospect Street 160 feet from East Broad Street.
(b) Lot No. 2: The lot at the westbound railroad station between North
Avenue and the railroad right-of-way.
(c) Lot No. 3: The lot between South Avenue and the railroad right-of-way.
(d) Lot No. 3A: The lot located between Lot No. 3 and the railroad tracks
east of the railroad station and containing only paystation spaces.
(e) Lot No. 4: The lot between Mountain Avenue and Elm Street and in
the rear of properties fronting on East Broad Street.
(f) Lot No. 5: The lot on the northeast side of Central Avenue, southeast
of East Broad Street through to Elmer Street.
(g) Lot No. 6: The lot on the northwest side of Watterson Street between
Rahway Avenue and South Avenue.
(h) Lot No. 7: The lot on the westerly side of Lenox Avenue between Central
Avenue and North Avenue.
(i) Lot No. 8: The lot at the corner of North Avenue and Central Avenue.

The following regulations shall apply to Municipal Parking Lot
No. 1 located between the southwest side of Elm Street between East
Broad Street and Cowperthwaite Place and the northeast side of Prospect
Street 160 feet from East Broad Street.
(a) Parking in this lot shall be limited to four hours except for those
spaces therein as may be designated for nine-hour parking.
(b) Parking paystations shall be installed to provide parking for up
to four hours at the rate of $0.50 for 60 minutes or any portion thereof.
The operator, immediately after parking the operator's vehicle in
the numbered space, shall deposit or cause to be deposited in the
paystation device the posted fee required for the numbered space occupied
by the operator's vehicle.
(c) Nine-hour parking spaces shall be designated to provide parking for
up to 12 hours at a rate of $0.50 for one hour or any portion thereof.
(d) Hours of enforcement shall be Monday through Saturday 10:00 a.m.
to 6:00 p.m.

(a) The following regulations shall apply to Municipal Parking Lot No.
3 known as the south side railroad lot.
(1)
This lot shall include the area between South Avenue and the
railroad right-of-way in the vicinity of and on both sides of the
eastbound railroad station building, with the exception of that portion
located on the railroad right-of-way known as parking lot 3A.
(2)
Parking in the 11 spaces on the westerly side of the driveway
entrance to the eastbound railroad station building shall be limited
to four hours. Parking pay stations shall be installed to provide
parking for up to four hours at the rate of $0.50 for 60 minutes or
any portion thereof. The operator, immediately after parking the operator's
vehicle in the numbered space, shall deposit or cause to be deposited
in the pay station device the posted fee required for the numbered
space occupied by the operator's vehicle.

Parking in the 10 spaces on the easterly side of the driveway
entrance to the eastbound railroad station building shall be limited
to 12 hours. Parking pay stations shall be installed to provide parking
for up to 12 hours at the rate of $0.50 for 60 minutes or any portion
thereof. The operator, immediately after parking the operator's vehicle
in the numbered space, shall deposit or cause to be deposited in the
pay station device the posted fee required for the numbered space
occupied by the operator's vehicle. Hours of enforcement for this
portion of lot three shall be Monday through Friday 9:00 a.m. to 7:00
p.m.

Parking spaces, as shall be determined from time to time by
the Town Council, shall not be metered and the fee charged for same
shall be payable to the Town in advance, payment of which shall be
evidenced by a sticker permit issued by the Town, good only during
the period for which same was purchased. Such sticker permit shall
be affixed to the location specified by a notice given to the permit
holder at the time the permit holder is given the permit and shall
be clearly visible at all times during which the vehicle is parked
in one of such unmetered parking spaces of parking Lot No. 3. Such
sticker permits shall only be available to residents of the Town of
Westfield and shall be nontransferable. Proof of residency acceptable
to the Police Department of the Town of Westfield shall be provided
by all applicants for permits.
(5)
Except as otherwise designated in this section, hours of enforcement
shall be Monday through Friday 5:00 a.m. to 10:00 a.m.

(6)
Daily color coded parking permits shall be available for sale
to residents of Westfield for a daily fee of $5 per day entitling
the holder to park in spaces designated by the Police Department in
the eastern portion of Lot 3. Proof of residency acceptable to the
Police Department of the Town of Westfield shall be provided in order
for a patron to be eligible to purchase a daily permit. Daily parking
permits shall be available for sale in such manner, at such times
and on such days as the Police Department shall establish via a representative
of the Police Department.
(b) The following regulations shall apply in municipal parking Lot No.
3A located between Lot No. 3 and the railroad tracks east of the railroad
station and containing only metered spaces unless otherwise prohibited
or restricted:
(1)
Parking in this lot shall be limited to 12 hours.
(2)
Parking pay stations shall be installed to provide parking for
up to 12 hours at the rate of $0.50 for 60 minutes or any portion
thereof. The operator, immediately after parking the operator's vehicle
in the numbered space, shall deposit or cause to be deposited in the
pay station device the posted fee required for the numbered space
occupied by the operator's vehicle.

The following regulations shall apply in Municipal Parking Lot
No. 4, located between Mountain Avenue and Elm Street and in the rear
of properties fronting on East Broad Street:
(a) Parking in this lot shall be limited to four hours except for those
spaces therein as may be designated for eight-hour parking.
(b) Parking pay stations shall be installed/updated to provide parking
for up to eight hours at the rate of $0.50 for 60 minutes or any portion
thereof. Online payment options through mPay2Park App shall be updated
to provide parking for up to eight hours at the rate of $0.50 for
60 minutes or any portion thereof. The operator, immediately after
parking the operator's vehicle in the numbered space, shall deposit
or cause to be deposited in the pay station device the posted fee
required for the numbered space occupied by the operator's vehicle.
(c) Eight-hour parking spaces shall be designated to provide parking
for up to eight hours at a rate of $0.50 for one hour or any portion
thereof. Parking is prohibited in all areas designated for four-hour
or eight-hour parking between the hours of 1:00 a.m. and 6:00 a.m.
except for those vehicles displaying night hours parking permits and
except in those spaces expressly reserved, marked or designated by
the Police Department for all-night parking.
(d) Hours of enforcement shall be Monday through Saturday 10:00 a.m.
to 6:00 p.m.

The following regulations shall apply in municipal parking Lot
No. 5, located between Central Avenue and Elmer Street:
(a) Parking in this lot shall be limited to four hours except for those
spaces therein as may be designated for twelve-hour parking.
(b) A pay station device shall be installed to provide parking for up
to four hours at the rate of $0.50 for 60 minutes or portion thereof.
The operator, immediately after parking the operator's vehicle in
a numbered spot, shall deposit or cause to be deposited in the pay
station device the posted fee required for the numbered spot occupied
by the operator's vehicle.
(c) Hours of operation shall be Monday through Saturday 10:00 a.m. to
6:00 p.m.

(d) Night hours.

Parking Lot No. 5 is hereby designated as a "night hours" parking
lot for residents of the Town of Westfield Central Business District
("CBD") who have been issued permits as set forth below. "Night hours"
is defined as the hours of 4:30 p.m. to 9:00 a.m. seven days per week.
(2)
Residents who reside within the CBD (hereinafter sometimes referred
to as "CBDR") or owners of residential property in the CBD shall be
entitled to purchase a permit allowing CBD residents or tenants of
CBD property owners to park in Parking Lot No. 5 between the hours
of 4:30 p.m. to 9:00 a.m. seven days per week. Permits shall be issued
by the Town of Westfield Police Department to individuals residing
in the Town of Westfield within the CBD or owners of property within
the CBD based upon adequate proof of residence and/or ownership, in
such form as shall be acceptable to the Police Department of the Town
of Westfield.
(3)
The quantity of night hours parking permits to be sold shall
be determined by the Town of Westfield Police Department taking into
account the need to accommodate adequate parking for CBDR during the
night hours.
(4)
The Westfield Police Department shall designate the number and
location of parking spaces to be used by holders of night hours parking
permits.
(5)
Only holders of properly displayed night hours parking permits
may park in those parking spaces designated for use by night hours
permit holders during night hours.
(6)
The night hours parking permit to be issued by the Town of Westfield
shall be affixed to a location specified by a notice delivered to
the permit holder at the time the permit holder is issued the permit
and shall be clearly visible at all times during which the vehicle
is parked in night hours designated spaces located in Parking Lot
No. 5.
(7)
The cost for a night hours parking permit for CBDR residents
shall be $120 for an annual permit and $60 for a six-month permit.
(8)
Parking in spaces designated for use by night hours permit holders
without a night hours permit properly displayed between the hours
of 4:30 p.m. to 9:00 a.m. seven days per week is a violation of this
chapter.

for which same was purchased. Such sticker permit shall be affixed
to the location specified by a notice given the permit holder at the
time the permit holder is given the permit and shall be clearly visible
at all times during which the vehicle is parked in parking Lot No.
6. Such sticker permits shall only be available to residents of the
Town of Westfield and shall be nontransferable. Proof of residency
acceptable to the Police Department of the Town of Westfield shall
be provided by all applicants for permits.
(b) Hours of enforcement shall be Monday through Friday 5:00 a.m. to
12:00 p.m.

to four hours at the rate of $0.50 for 60 minutes or any portion thereof.
The operator, immediately after parking the operator's vehicle in

paystation device the posted fee required for the numbered space occupied
by the operator's vehicle.
(c) Hours of enforcement shall be Monday through Saturday 10:00 a.m.

The following regulations shall apply in Municipal Parking Lot
No. 8 located on the corner of Central Avenue and North Avenue:
(a) This lot shall be for permit holders only. The fee charged for same
shall be payable to the Town in advance, payment of which shall be
evidenced by a sticker permit issued by the Town, good only during
the period for which same was purchased. Such sticker permit shall
be affixed to the location specified by a notice given the permit
holder at the time the permit holder is given the permit and shall
be clearly visible at all times during which the vehicle is parked
in Parking Lot No. 8. Such sticker permits shall only be available
to employers, employees of commercial establishments conducting business
in the Town of Westfield and residents of the Town of Westfield and
shall be nontransferable. Proof of employment and/or residency in
the Town of Westfield acceptable to the Police Department of the Town
of Westfield shall be provided by all applicants for permits.
(b) The Westfield Police Department shall designate the number and location
of parking spaces to be used by residential permit holders and employees
and employers. A violation of this section shall be subject to the
penalties provided in § 13-49(b).
(c) A permit issued pursuant to this section shall also permit parking
in other parking lots authorized by the Police Department.
(d) No vehicle shall be parked in Municipal Parking Lot No. 8 unless
such vehicle shall have displayed, in a manner described by the Police
Department, a current parking permit for that vehicle. A violation
of this section shall be subject to the penalties provided in § 13-49(b).
(e) Hours of enforcement shall be Monday through Friday 6:00 a.m. to
6:00 p.m.
(f) Night hours.
(1)
Parking Lot No. 8 is hereby designated as a "night hours" parking
lot for residents of the Town of Westfield Central Business District
("CBD") who have been issued permits as set forth below. Night hours
is defined as the hours of 6:00 p.m. to 6:00 a.m. seven days per week.
(2)
Residents who reside within the CBD (hereinafter sometimes referred
to as "CBDR") or owners of residential property in the CBD shall be
entitled to purchase a permit allowing CBD residents or tenants of
CBD property owners to park in Municipal Parking Lot No. 8 between
the hours of 6:00 p.m. to 6:00 a.m. seven days per week. Permits shall
be issued by the Town of Westfield Police Department to individuals
residing in the Town of Westfield within the CBD or owners of property
within the CBD based upon adequate proof of residence, and/or ownership,
in such form as shall be acceptable to the Police Department of the
Town of Westfield.
(3)
The quantity of night hours parking permits to be sold shall
be in the discretion of the Town of Westfield Police Department recognizing
the need to accommodate adequate parking for CBDR during night hours.
(4)
The Westfield Police Department shall designate the number and
location of parking spaces to be used by holders of night hours parking
permits.
(5)
Only holders of properly displayed night hours parking permits
may park in those parking spaces designated for use by night hours
permit holders during night hours.
(6)
The night hours parking permit to be issued by the Town of Westfield
shall be affixed to a location specified by notice given to the permit
holder at the time of the issuance of the permit and shall be clearly
visible at all times during which the vehicle is parked in night hours
designated parking spaces located in Municipal Parking Lot No. 8.
(7)
The cost for a night hours parking permit for CBDR residents
shall be $120 for an annual permit and $60 for a six-month permit.
(8)
Parking in spaces designated for use by night hours permit holders
without a night hours permit properly displayed between the hours
of 6:00 p.m. and 6:00 a.m. seven days per week is a violation of this
chapter.

The following regulations shall apply to the municipal parking
lot specified:
(a) The fee to be charged for permits in Lot Nos. 3, 8 and other spaces
designated for commuter parking shall be $420 for a six-month period
or $696 for a twelve-month period. The fee shall be payable to the
Town of Westfield in advance and payment shall be evidenced by a sticker-permit
to be issued by the Parking Division of the Westfield Police Department
during the period for which the permit was purchased and only for
the daily parking allowed in the specific lot for which the permit
has been issued. The fee to be charged for permits in Lot No. 6 shall
be $210 for a six-month period or $420 for a twelve-month period.
If the sticker-permit is not renewed upon expiration, the right to
renew shall be forfeited. The sticker-permit shall be affixed to that
portion of the motor vehicle to be specified in a written notice to
be given to the permit holder at the time that the sticker-permit
is issued. If the car with the permit-sticker is not available to
the holder of the permit, the permit holder shall be entitled to apply
to the Parking Division of the Westfield Police Department for a temporary
permit. The fee to be charged for permits in Lot No. 8 and other spaces
designated for employee parking shall be $150 for a three-month period.
The fee shall be payable to the Town of Westfield in advance and payment
shall be evidenced by a sticker-permit to be issued by the Parking
Division of the Westfield Police Department during the period for
which the permit was purchased and only for the daily parking allowed
in the specific lot or on street space for which the permit has been
issued. If the sticker-permit is not renewed upon expiration, the
right to renew shall be forfeited. The sticker-permit shall be affixed
to that portion of the motor vehicle to be specified in a written
notice to be given to the permit holder at the time that the sticker-permit
is issued. If the car with the permit-sticker is not available to
the holder of the permit, the permit holder shall be entitled to apply
to the Parking Division of the Westfield Police Department for a temporary
permit.

(b) A vehicle occupying a reserved space without a valid sticker-permit therefor being displayed as aforesaid shall be towed away at the owner's expense and the owner of such vehicle or any person causing, suffering or permitting such reserved space to be occupied by a vehicle without authority from the Town of Westfield as provided herein shall be subject to a fine as provided in §
13-8(a) of this chapter upon conviction in municipal court.

(c) The general public shall be allowed in the designated Town of Westfield
permit parking lots and spaces without a charge all day Saturday and
Sunday and after 6:00 p.m. prevailing time Monday through Friday.
The general public shall be permitted in the permit spaces in Lot
No. 8 and employee designated spaces on Orchard Street, Ferris Place
and Elm Street without charge after 4:30 p.m. prevailing time Monday
through Friday. Parking by the general public and holders of sticker-permits
is prohibited in these parking lots and spaces between the hours of
1:00 a.m. and 6:00 a.m. prevailing time, except in those spaces expressly
reserved, marked or designated by the Police Department for such all-night
parking.

(d) In order to obtain a parking permit the applicant therefor must be a resident of the Town of Westfield. The applicant must present such evidence of residency as the Town Clerk shall require and the applicant shall sign an affidavit that establishes such facts. The applicant must state in writing that he or she will not sell, assign, transfer, lend or give the sticker-permit issued to any other person, firm, association or corporation. If the sticker-permit issued to such applicant is found in a motor vehicle parked in a parking lot which is not the vehicle for which it was issued, the applicant for said parking permit shall be subject to a fine as set forth in §
13-8(a) and shall permanently forfeit any rights to further sticker-permits in any municipal parking lot located in the Town of Westfield unless said person can demonstrate to the municipal court why such forfeiture should not be enforced. Such unmetered parking spaces shall be in operation 12 hours a day, Monday through Friday from 6:00 a.m. until 6:00 p.m. prevailing time.

(e) The general public shall be obligated to pay the required amount for the use of parking meters from 10:00 a.m. to 6:00 p.m. Any person who is found to have used a parking meter space without proper payment shall be subject to the fines specified in §
13-8(a) of this chapter.

(f) Parking in certain spaces within a portion of Municipal Lot 2 shall
be by permit only, which shall be evidenced by a hang tag, issued
by the Town, to be displayed on the vehicle at all times. Such permits
shall only be available to employees of the Town of Westfield and
shall be nontransferable.

Parking is prohibited in all municipal parking lots or areas
between the hours of 2:00 a.m. and 6:00 a.m. except:
(a) Holders of night hours parking permits may park all night in the
spaces designated by the Westfield Police Department in Lots 4, 5
and 8;

(c) Non-permit holding residents of Westfield, in non-numbered permit

for the replacement of any parking permit decal which has been lost,
stolen or destroyed.

It shall be unlawful for any person to ride or use a skateboard
or use roller skates or roller blade skates or similar devices at
any time in the following municipal parking facilities and any access
driveways or aisles contained therein: Parking Lot Nos. 2, 3, 3A,
9 and the parking lot at the Westfield Memorial Library.
