For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
RINGELMANN SMOKE CHART
The Ringelmann smoke chart referred to in this chapter is the chart of that name published by the United States Bureau of Mines. The method of measuring the density of smoke by the use of such chart shall be in compliance with the instructions issued therefor by the United States Bureau of Mines, as the same may be from time to time amended.
SMOKE
The visible emission resulting from combustion or from heating of a substance or both.

The Town Engineer is hereby designated as smoke inspector under this chapter. He may consult with and receive the cooperation of the chief engineer of the Fire Department of the Town and such experts as he may select or who may be appointed from time to time by the Town Council. It shall be the duty of the smoke inspector to inspect all chimneys, ovens and smokestacks and other appliances from which smoke is emitted and he shall have authority in the performance of the duties of his office to enter upon any premises, including any cellar, basement, boiler room, engine room or other room in any building not occupied exclusively as a private residence, to inspect any steam boiler, oven, furnace engine room or other machine or contrivance. No person shall hinder or obstruct the smoke inspector in the performance of such duties.
The smoke inspector shall make written reports of his work of inspection covering any alleged violation of this chapter to the Town Clerk or covering any inspection which he may be requested to make by any member or the Town Council.

(a) 
The emission within the Town of smoke, the density of shade of which is equal to or greater than No. 2 of the Ringelmann smoke chart, or which is so dense as to be dimly seen through at the point of emission into the external air from any stack, oven, chimney, open fire, tar kettle, or other machine, furnace or contrivance, for periods aggregating 12 minutes or more in any period of one hour, is hereby prohibited.
(b) 
The emission within the Town of smoke, the density or shade of which is equal to or greater than No. 3 of the Ringelmann smoke chart, or which is so dense as to prevent seeing through it at the point of emission into the external air, from any stack, oven, chimney, open fire, tar kettle, or other machine, furnace or contrivance, except that of a locomotive, for a period or for periods aggregating two minutes or more in any period of 15 minutes, is hereby prohibited.

Any owner, agent, manager, lessee or occupant of any building or property within the Town to which is attached a chimney, oven or smokestack connected with any stationary engine or steam boiler or of any apartment house, office building, institution, establishment or private residence using oil burners or other fuels or other place, premises or buildings used as a factory or for any purpose of trade within the Town and any owner or manager of any tar kettle or other machine, furnace or contrivance within the Town who permits or allows to be emitted from any such chimney, oven, smokestack, tar kettle or other machine, furnace or contrivance or private residences using oil burners or other fuels, smoke in violation of Section 21-3 shall, upon receipt of notice in writing duly served upon him by the smoke inspector, without delay, entirely eliminate such smoke as violates this chapter. Every day such smoke shall be emitted in violation of this chapter, after the time to correct same has expired, shall be deemed to be and shall constitute a separate violation of this chapter.
