That certain document, three copies of which are on file in the office of the Borough Clerk of the Borough of Garwood, being marked and designated as the International Property Maintenance Code, 2015 edition, as published by the International Code Council, is hereby adopted as the Property Maintenance Code of the Borough of Garwood for regulating and governing the conditions and maintenance of all property, buildings and structures; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Borough Clerk are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes prescribed in § 67-14 of this article.
The provisions of the International Property Maintenance Code, 2015 edition, incorporated herein, are hereby amended and revised in the following respects. The International Property Maintenance Code is amended and revised in the following respects:
A. 
Section 101.1 (page 1, second line). Insert: "The Borough of Garwood."
B. 
Section 103.1. Delete entire section.

Section 103.3. Delete entire section.
D. 
Section 103.5. Delete entire section.
E. 
Section 106.4 (page 3). Delete entire section and replace with:
"106.4. Violation Penalties. Any person or entity subject to this article found by the Municipal Court or by any other court of competent jurisdiction to be in violation of any requirement to correct a care, maintenance, security or upkeep violation cited in a notice pursuant to this article shall be subject to a fine as follows:
A.
If the property is a single-family residence, not to exceed $100 for each day of the violation.
B.
If the property is a two-family residence, not to exceed $250 for each day of the violation.
C.
For any other type of property, not to exceed $500 for each day of the violation.
No violation and fines shall be deemed to have commenced until 31 days following the receipt of a notice sent pursuant to this article, unless the violation presents an imminent risk to public health and safety, in which case a violation and fines shall commence 11 days following receipt of the notice."

The Code Official under the Property Maintenance Code shall be the Property Maintenance Officer created by § 5-51.20, except that the Chief of Police or his designee shall be the Code Official for the enforcement of the following sections: 302.1 (sanitation), 302.8 (motor vehicles), and 304.2 (exterior painting).
