For the purpose of this Article, the following terms, phrases,
words and their normal derivations will have the meanings given herein:
GARAGE AND/OR YARD SALE
A sale of goods for profit offered to the public conducted
at a single-family, a dual-family or a multi-family residential dwelling
place.
GOODS
Any goods, wares, merchandise, articles or other personal
property, capable of being the object of a sale regulated hereunder.
PERSON
Any person, firm, partnership, association, corporation,
company or organization of any kind.

It shall be unlawful for any person to conduct more than two
(2) garage and/or yard sales at the same location within any calendar
year, provided that no more than one (1) such sale takes place as
aforesaid during each six-month period of such calendar year.

Any person proposing to conduct a garage and/or yard sale must
obtain a permit from the City Collector by payment of one dollar ($1.00)
to said City Collector and must notify, in writing, the Police Department
of the place where such sale is to be conducted, the dates of such
sale and the names, addresses and telephone numbers of the persons
responsible for conducting such sale. Said permit issued by the City
Clerk shall be posted in a conspicuous place on the property where
the garage and/or yard sale is being conducted.

It shall be unlawful to conduct a garage and/or yard sale lasting
longer than two (2) days' duration.

No person shall erect, place, post or mark any sign advertising
a garage and/or yard sale on any public property, including street
signs and posts, and traffic signs and posts, or on any public utility
pole. Any such sign erected, placed, posted or marked on non-public
property advertising such garage and/or yard sale shall be removed
on or before the last day of such sale. The person responsible for
conducting any such garage and/or yard sale shall be responsible for
removing any such sign.

No person shall accept or take in for sale, any goods from any
commercial business or enterprise on a consignment basis.

A. Yard sale permits and permit fees shall be waived from Thursday through
Monday of Memorial Day weekend.
B. This shall apply every Memorial Day weekend so long as the "Hundred
Mile Yard Sale" exists.

The Malden Community Center is permitted to sponsor a yard sale
or marketplace up to a frequency of four (4) times per year so as
to develop and promote economic activity and also to provide a sales
venue for craftsmen, produce farmers and other individuals who may
have items for sale for which there is not now an appropriate venue.

For purposes of this Article, the term "flea market" shall mean
the sale of goods or personal property conducted at a place of business
and not at a private residence, but shall not include merchants who
sell goods at retail or wholesale.

It shall be unlawful for any person to operate a flea market
within the City without first obtaining a license therefor from the
City. The annual fee for such license shall be one hundred dollars
($100.00) plus ten dollars ($10.00) for each booth or stall in the
flea market.

It shall be unlawful for any person, while selling goods at
a flea market, to place, display or offer for sale any goods upon
the public streets, sidewalks or alleys of the City.
