[Adopted by the Borough Council of the Borough of Trainer 7-12-2018 by Ord. No. 763. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
KEY LOCKBOX
A small metal box attached to a building in which keys, plans and other pertinent information required by this chapter and/or the Fire Chief of the Marcus Hook Trainer Fire Company ("Fire Chief"), are locked inside and the Fire and Police Department have a master key to that box.
A. 
The following buildings/structures shall be equipped with a key lockbox at or near the main entrance or such other location required by the Fire Chief or his/her designee or authorities having jurisdiction.
(1) 
All commercial or industrial buildings/structures which include buildings where industry, trade or business is carried on or where any process or operation, directly or indirectly related to any industry, trade or business, is carried on and where any person is employed by another for direct or indirect gain or profit;
(2) 
Any buildings/structures which are protected with an automatic fire suppression or sand pipe system and is not manned during a twenty-four-hour, seven-day-a-week operation;
(3) 
Multifamily residential buildings of four or more units in which access to the buildings are common areas and/or mechanical or electrical rooms within the building are denied through locked doors;
(4) 
Any building or facility which handles, uses, or stores hazardous materials or is required to prepare the emergency services, material safety data sheets (MSDS) or Hazardous Chemical Inventory Forms under the Superfund Amendments and Reauthorization Act of 1986 (SARA Titled III);
(5) 
Nursing care facilities;
(6) 
Government structures;
(7) 
All nonresidential buildings/structures which are protected by an automatic fire alarm system (auto dialer, central station, external audible alarm);
(8) 
Churches and places of worship.
B. 
Exception:
(1) 
The buildings/structures on the premises currently owned and/or operated by Monroe Energy, LLC, which is a transportation worker identification credential facility (TWIC), its successors and/or assignees in interest, are exempt from the requirements of this chapter for so long as there is maintained the Company 86 Conoco — Phillips Fire & Rescue Department or other similarly trained, certified and equipped fire department and also a trained volunteer emergency response team (VERTs) which are presently available and active at the premises and have full access to all buildings/structures on the premises 24 hours a day, seven days a week, 52 weeks a year.
C. 
Location of key lockbox.
(1) 
The key lockbox shall be located directly or as close as reasonably possible to the main entrance or the recognized public entrance, adjacent to the fire annunciator panel, or the exterior of the structure, above the fire department connection, when occupancy is serviced by fire sprinkler system and/or fire alarm system approved by the Fire Chief;
(2) 
The key lockbox shall be located at a height not less than six feet and more than 10 feet above finished surface grade;
(3) 
No steps, displaced signs or other fixtures or structure protrusions shall be located under the key lockbox which would allow intruders to access the box without assistance.
A. 
All existing building/structures required to have a key lockbox shall comply with this chapter within one year from its effective date.
B. 
All newly constructed structures subject to this chapter shall have the key lockbox installed and operational prior to the issuance of an occupancy permit.
C. 
The property owner or operator of a building/structure is responsible at all times to keep a key(s) in the key lockbox that will provide access to the building/structure and all other contents in the key lockbox as required by this chapter and the Fire Chief.
D. 
The Fire Chief shall designate the type of key lockbox system to be installed and implemented within the Borough of Trainer and shall have the authority to require all buildings/structures to use the designated system.
E. 
The Fire Chief shall be authorized to implement rules and regulations for the use of the key lockbox system.
A. 
The property owner or operator of a building/structure subject to this chapter is required at all times to keep a key(s) in the key lockbox that will access to the building/structure.
B. 
The property owner or operator of a building/structure subject to this chapter is required at all times to insure the key lockbox shall contain, but not be limited to, the following items as designated by the Fire Chief:
(1) 
Labeled keys to lock points of ingress and egress and interior or exterior such buildings;
(2) 
Labeled keys to the locked mechanical room;
(3) 
Labeled keys to locked elevator rooms and controls;
(4) 
Labeled keys to any fence or secured area;
(5) 
Labeled keys to areas of the building where fire alarm panels and fire protection systems are located;
(6) 
Labeled keys to any other areas that may be required by the Fire Chief;
(7) 
A card containing the emergency contact names and phone numbers for such building.
A. 
The owner/operator of a building/structure subject to this chapter shall immediately notify the Fire Chief and provide a new key when a lock is changed or rekeyed.
B. 
The key to such lock shall be secured in the key box.
C. 
The cost of purchasing or installing, along with any costs associated with implementation of the program on a specific property, will be borne by the property owner.
A. 
Failure to install the key lockbox after 30 days when required to install shall enable the Marcus Hook Trainer Fire Department to purchase and install said key lockbox at the owner's expense.
B. 
Enforcement of this chapter shall be accomplished through citations issued by the Code Enforcement Officer for the Borough of Trainer with the direction of the Fire Chief or Trainer Borough Council.
C. 
It shall be the responsibility of the building owner or operator to order and install, at his/her expense, a key lockbox as approved and designated by the Fire Chief.
D. 
Any person, firm or corporation who shall violate any provision of this chapter, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for in the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $300 plus costs and attorney fees and, in default of payment of said fine, costs and attorney fees, to a term of imprisonment not to exceed 90 days. Each day that a violation of this chapter continues or each section which shall be found to have been violated shall constitute a separate offense.
All ordinances or resolutions or parts of ordinances or resolutions insofar as they are inconsistent herewith are hereby repealed.
If any sentence, clause, section or part of this chapter is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections, or parts of this chapter. It is hereby declared as the intent of the Borough Council, that this chapter would have been adopted had any such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included therein.
