A. 
Offenses against state laws subject to forfeiture. The following statutes defining offenses against the peace and good order of the state are adopted by reference to define offenses against the peace and good order of the Town, provided the penalty for commission of such offenses hereunder shall be limited to a forfeiture imposed under the general penalty provisions of this Code. However, upon failure to timely pay the forfeiture and costs, imprisonment may be imposed by the court at the rate of one day for each $50, or portion thereof, owed. Any future amendments, revisions or modifications of the statutes incorporated herein by reference are intended to be made part of this Code.

It shall be unlawful for any person to hunt on Town-owned property or to discharge any bow and arrow, crossbow or firearm on any land, regardless of ownership, within the territorial limits of the Town of Rome except as follows:
A. 
On a privately owned parcel of land which is five acres in size or greater;
B. 
Discharge of firearms by law enforcement officers, while in the performance of their official duties;
C. 
If the discharge is justified under § 66.0409(3)(b), Wis. Stats. or if the discharge is subject to a defense described in § 939.45, Wis. Stats.;
D. 
When acting under a valid discharge event permit issued by the Police Chief or his designee pursuant to § 281-3, herein.
E. 
Discharge of a bow and arrow or crossbow on privately owned land subject to the following limitations:
(1) 
A bow and arrow or crossbow may not be discharged within 100 yards of a building, as that term is defined in § 29.038(3)(b)1.a, Wis. Stats., located on another person's land unless the person who owns the land on which the building is located permits the discharge within such distance.
(2) 
The arrow or bolt from the bow and arrow or crossbow must be discharged toward the ground.
A. 
Hunting with, and/or discharge, of a bow and arrow, crossbow or firearm may be conducted on Town-owned property and firearms may be discharged on privately owned parcels less than five acres in size upon issuance of a discharge event permit from the Police Chief or his designee.
B. 
Applications for discharge event permits shall include the following information:
(1) 
Name, address and telephone number for each individual participating in the discharge event.
(2) 
A description of the nature of the discharge event (i.e., hunting, target practice, etc.).
(3) 
The date(s) on which the discharge event will take place.
(4) 
A description of the parcel(s), or portions thereof, on which the discharge event will take place.
(5) 
For hunting activities, a statement that the applicant will ensure that all individuals in the hunting party who will possess a weapon hold a valid hunting license and, if using a firearm, are not legally prohibited from doing so.
C. 
An application fee will be imposed. The Police Chief may waive the fee in his or her discretion.
D. 
The Police Chief or his designee is vested with the authority to approve or deny applications based on public safety considerations and may place conditions on the discharge event permit as determined necessary including, but not limited to, limiting the size or nature of the weapons used (i.e., shotgun only, bow only, etc.).
E. 
The Police Chief or his designee may, but is not required to, conduct a background check of any person named in an application for the purpose of determining if the person is prohibited from possessing a firearm or is the subject of an active warrant.
F. 
The Police Chief or his designee may, in his or her discretion; revoke a discharge event permit if it is determined that anyone participating in the discharge event has violated any governing law or the terms of the permit.
A. 
Pursuant to § 943.13(1e)(h), Wis. Stats., it shall be unlawful for any person to enter or remain in any Town-owned or occupied buildings while carrying a firearm, knife, or other weapon. Signs shall be placed at the entries to any included buildings clearly notifying the public of this prohibition.

B. 
Nothing in this section shall be construed to apply to prohibit a peace officer or armed forces or military personnel armed in the line of duty or any person duly authorized by the Town Board to possess a firearm or weapon in any public Town owned building. Notwithstanding § 939.22(22), Wis. Stats., for purposes of this subsection, "peace officer" does not include a commission warden who is not a state-certified commission warden.
C. 
The possession of weapons, concealed or otherwise, is prohibited at any special event, as that term is defined in § 943.13(1m)(c)3, Wis. Stats., for which the Chief of Police has issued such a prohibition by written order. Signs shall be placed at the entries to such special events notifying the pubic of this prohibition.
D. 
Penalty. Any person who violates this subsection shall, upon conviction, be subject to a forfeiture of not more than $500 per violation, plus court costs and fees.
For the purpose of this chapter, the following terms, phrases, words, and their derivations shall have the meaning given herein. If not defined herein, the word, term or phrase shall have the definition commonly accepted including a relevant definition contained in the Wisconsin Statutes. When not inconsistent with the context, the words used in the present tense include the future, words in the plural number include the singular number and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory:
FIREARM
All weapons used for the purpose of propelling bullets, shot, balls, or other missiles, whether from cartridge, shell or other container, by explosives spring loaded, or compressed air, and shall include, without limitation because of specific enumerations, all forms of shotguns, rifles, revolvers and other similar types of equipment whereby such bullets, shot, or missiles are propelled through the air by reason of discharge therefrom by explosives, caps, spring loaded, or compressed air.

PERSON
Includes a corporation, firm partnership, association, organization and any other group acting as a unit as well as individuals, including a personal representative, receiver or other representative appointed according to law. Whenever the term "person" is used in any section of this chapter prescribing a penalty or fine, as to partnerships or associations, the work shall include the partners or members thereof, and as to corporations, shall include the officers, agents or members thereof who are responsible for any violation of such section.
PUBLIC OFFICER
Persons serving in statutory elected or appointed offices provided for in Chapter 60 of the Wisconsin Statutes, and all members appointed to boards, committees and commissions established or appointed by the Town Chairperson and/or Town Board, whether paid or unpaid.
SIGN
Any medium, including its structure, words, letters, figures, numerals, phrases, sentences, emblems, devices, designs, trade names or trademarks by which anything is made known and which are used to advertise or promote an individual, firm, association, corporation, profession, business, commodity or product and which is visible from any public street or highway.
TOWN
The Town of Rome, Adams County, Wisconsin, or any duly appointed designate thereof, including, but not limited to, the Town Board and Town committees.
TOWN BOARD or BOARD
The present governing body of the Town or any successors to the legislative power of said body, or any duly appointed designate thereof.
UTILITIES
Public and private facilities, such as water wells, water and sewage pumping stations, water storage tanks, electrical power substations, static transformer stations, telephone and telegraph exchanges, microwave radio relays and gas regulation stations, inclusive of associated transmission facilities but not including sewage disposal plants, municipal incinerators, warehouses, shops, storage yards and power plants.
