Definition. "Fireworks" shall mean and include any combustible or explosive composition, or any substance or combination of substances, or article prepared for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration or detonation, and shall include blank cartridges, toy pistols, toy cannons, toy canes or toy guns in which explosives are used, the type of balloons which require fire underneath to propel the same, firecrackers, torpedoes, skyrockets, roman candles, dago bombs, sparklers or other devices of like construction and any device containing any explosive substance, except that the term "fireworks" shall not include auto flares, paper caps containing not in excess of an average of 0.25 grain (16.2 mg) of explosive content per cap, and toy pistols, toy canes, toy guns or other devices for use of such caps, the sale and use of which shall be permitted at all times.

The transport, storage and display of fireworks may be permitted with the special consent of the Borough Council, as evidenced by resolution, at such times and places within the Borough as the Borough Council may at its sole discretion designate. The Borough Council reserves the right to create and revise rules, policies and procedures for the submission and granting of requests by individuals or entities for the display of fireworks within the Borough.

Any person who shall violate or fail to comply with any provision of this Part shall, severally for each and every such violation or noncompliance, be guilty of a summary offense, punishable by a fine of not less than $25 or more than $1,000, and costs, or, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. The imposition of a penalty for any violation or noncompliance shall not excuse the violation or noncompliance or permit it to continue. Each day that the violation or noncompliance exists shall constitute a separate offense.

The provisions of this Part shall be severable and, if any of the provisions hereof shall be invalid or unenforceable, the remaining provisions of this Part shall remain in effect.

That all ordinances and parts thereof conflicting herewith be and the same are hereby repealed.
