No water service connection to any premises shall be installed
or maintained by the Town of Macedon unless the public water supply
system is protected as required by this chapter and by the New York
State Sanitary Code, Chapter I, Part 5, Section 5-1.31, or any amendments
thereto.
Each service connection from the public water supply system
to premises having an auxiliary water supply shall be protected against
backflow of water from the premises into the public water system unless
the auxiliary water supply is approved and monitored as an additional
source by the Town and is satisfactory to the public health agency
having jurisdiction with regard to quality and safety.
Each service connection from the public water supply system
to premises upon which any substance is handled under pressure in
such fashion as to permit entry into the public water system or upon
which a substance of unusually toxic concentration or danger to health
is handled in liquid form (even though it is not under pressure) shall
be protected against backflow of the water from the premises into
the public water system.
Backflow prevention devices, of a type and design which the
New York State Department of Health approves as reasonably adequate
to prevent contamination, shall be installed on the service connection
to any premises that has internal cross-connections, unless such cross-connections
are abated to the satisfaction of the Town. It shall be the responsibility
of the water user to provide and maintain these protective devices,
and each such device must be installed in accordance with standards
approved by the Town and the New York State Department of Health.
It shall be the duty of the water user on any premises on account
of which backflow prevention devices are installed to have competent
inspections made at least once a year, or more often in those instances
where successive inspections indicate repeated failure. These devices
shall be repaired, overhauled or replaced at the expense of the water
user whenever they are found to be defective. All such tests shall
be performed by a qualified backflow prevention device tester, and
all test results shall be provided to the Town within 72 hours after
the test is made or conducted. Records of such tests, repairs and
overhaul shall also be kept and made available to the Town and the
health authority having jurisdiction upon request.
Any corrective measures, disconnections or changes on private
property shall be at the sole expense of the person in control of
such property. Any changes required in the public water supply system
outside the property or between the meter and the supply line or distribution
system and any charges for cutoff or disconnection shall be added
to the charges for water against the premises necessitating such expenditures.
