Prior to any individual flushing a private water main, the owner
of the water main shall gain the written permission of the Water Superintendent.
Permission shall be granted at the sole discretion of the Village
Water Superintendent, provided that permission may not be unreasonably
withheld. The time, place, and manner of the private flushing activities
will be arranged by the Water Superintendent. Individuals or entities
seeking such permission shall make the request either by phone or
in writing to the Village of Cobleskill Water Superintendent. No private
water mains may be flushed prior to gaining permission pursuant to
this section.
Any individual found to have violated §
154-16 of this chapter shall be guilty of a violation and may be fined by the Local Court in an amount not exceeding $2,500 and/or up to 15 days of incarceration. Individuals charged with a violation of this article shall be charged via a written accusatory instrument which complies with the applicable sections of the New York State Criminal Procedure Law, and prosecuted in the Cobleskill Town Court.
