This article shall be known as the "Code Enforcement Officer Residency Law and the Assessor Residency Law of the Town of Wawarsing" and shall be set forth in Chapter 20, Article IV, § 20-6, Code Enforcement Officer Residency Law and Assessor Residency Law.
A. 
New York State has determined that a Town Code Enforcement Officer and Town Assessor is a public officer.
B. 
As a public officer, an individual appointed as the Code Enforcement Officer and/or Assessor must be a Town elector of the Town in which he or she is appointed.
C. 
A Town elector must be an individual, at least 18 years of age, a citizen of the United States and a Town resident.
The Town Board of the Town of Wawarsing, County of Ulster, State of New York, hereby waives the residency requirement set forth above requiring the Code Enforcement Officer and/or Assessor be an elector of the Town of Wawarsing, County of Ulster, State of New York.
The Town Board of the Town of Wawarsing hereby establishes that the requirements for Code Enforcement Officer and/or Assessor shall no longer require residency within the limits of the Town of Wawarsing, County of Ulster, State of New York. All other requirements, including, but not limited to, being an individual at least 18 years of age, a citizen of the United States, and holding all necessary and proper certifications, shall continue to be required of any individual seeking appointment as Code Enforcement Officer and/or Assessor of and for the Town of Wawarsing, County of Ulster, State of New York.
This article shall take effect immediately upon filing with the Secretary of State.
Please take notice to the extent that this article may conflict with applicable portions of the Town Law of the State of New York, it is the stated intention of the Town to exercise its authority to supersede and amend, as granted under the Municipal Home Rule Law of the State of New York, § 10. The Town hereby provides notice that it is exercising its authority to supersede and amend pursuant to the Municipal Home Rule Law of the State of New York, § 22.
