A. 
Creation of Office of Code Administration. There is hereby created by the West Rockhill Township Board of Supervisors an office of the Township of West Rockhill to be known as the "Office of Code Administration" (at times in this Code referred to as "Code Official" or "Fire Code Official"). The official or officials appointed thereto by the Board of Supervisors shall meet the requirements of the Pennsylvania Construction Code and shall have the responsibility for administration and enforcement of the provisions of this chapter.
B. 
Enforcement authority.
(1) 
Appointment of Code Official. There shall be appointed, by the Board of Supervisors of West Rockhill Township, a Code Official, who shall be in charge of the Office of the Code Administration of the Township of West Rockhill. The Code Official is referred to in the International Building Code as the "Building Code Official" and in the International Fire Code as the "Fire Code Official." (Note: All other chapters of the West Rockhill Township Code of Ordinances shall be administered and enforced by the Zoning Officer or Code Enforcement Officer.)
(2) 
Approved inspection agencies. The Code Official shall make all the required inspections or may accept reports or inspections by authoritative and recognized inspection agencies or individuals, which satisfy requirements as to qualifications and reliability. All inspection reports shall be in writing and shall be certified by the approved authority or responsible officer of the agency or the individual when expert inspection services are accepted. The Code Official may engage such expert opinion as may be deemed necessary to report upon unusual technical issues that may arise subject to the approval of the Board of Supervisors. When required by the provisions of the code or by the approved rules, materials or assemblies shall be inspected at the point of manufacture or fabrication.
C. 
Duties and powers of Code Official.
(1) 
Enforcement of codes. The Code Official shall enforce and administer all of the provisions of this chapter.
(2) 
Duties and powers. The duties and powers of the Code Official shall be as set forth in the UCC and Property Maintenance Code.
Administration and enforcement of the code within West Rockhill Township shall be undertaken, as determined by the Board of Supervisors for West Rockhill Township, Bucks County, Pennsylvania, in accordance with the regulations of the Pennsylvania Construction Code Act.
A. 
Penalties. Any person, firm or corporation who shall violate any provision of this chapter or fails to correct a violation or institute a remedial action as ordered by the Code Official, or who shall erect, construct, install, alter or repair a building, structure or any plumbing, electrical and mechanical equipment or systems in violation of an approved plan or directive of the Code Official or of a permit or certificate issued under the provisions of the Township codes shall, upon conviction before any Magisterial District Judge, be sentenced, for each such violation, to pay a fine not exceeding $1,000 plus costs and, in default of payment thereof, to undergo imprisonment in the county jail for a period not to exceed 30 days. Each day that a violation continues after due notice has been served in accordance with the terms and provisions hereof, shall be deemed a separate offense.
B. 
Prosecution. The imposition of the penalties herein prescribed shall not preclude the Solicitor representing the Township from initiating, and he is hereby ordered to initiate, appropriate actions or proceedings at law or equity for the purpose of ordering that person:
(1) 
To restrain, correct or remove the violation or refrain from any further execution of work.
(2) 
To restrain or correct the erection, installation or alteration of such structure.
(3) 
To require the removal of work in violation.
(4) 
To prevent the occupation or use of the structure or part thereof erected, constructed, installed or altered in violation of, or not in compliance with, the provisions of this code, or in violation of a plan or specification under which an approval, permit or certificate was issued.
A. 
Authorization of entry into intergovernmental cooperation agreement. The proper officers of the Township are hereby authorized and directed to execute and deliver on behalf of the Township of West Rockhill the intergovernmental cooperation agreement (the "agreement"), in substantially the form attached hereto as Exhibit "A", with respect to the amendment and restatement, powers and appointment of a Joint UCC Board of Appeals.
B. 
Powers of Joint UCC Board of Appeals. The Joint UCC Board of Appeals shall have all of the powers and shall be subject to the limitations of and shall exercise its authority in conformity with the provisions of the Construction Code and the regulations adopted thereunder and set forth in 34 Pa. Code §§ 403.121 and 403.122.
C. 
Appointment of member. The Township shall appoint and reappoint three members of the Joint UCC Board of Appeals, by resolution, from time-to-time as required, which members shall serve an indefinite term, provided that such members may be removed, with or without cause, by a majority vote of the Township Board of Supervisors, provided further that no member of the Joint UCC Board of Appeals shall be removed during the pendency of a hearing or application until the hearing is concluded and a decision of the Joint UCC Board of Appeals has been rendered.
D. 
Authorization of further action. The proper officers of the Township are hereby authorized and directed to take all such actions, execute, deliver, file and/or record all such documents, publish all notices and otherwise comply with the provisions of this chapter and the Act insofar as the transaction contemplated by this chapter, in the name and on behalf of the Township.
