A. 
Unless waived under Subsection C, the Government Records Department may charge records requesters a reasonable fee according to a fee schedule adopted by the Department to recover the costs incurred in responding to records requests, including reproduction and dissemination of records.
B. 
A schedule of fees shall be developed by the Government Records Department and posted by the Department and on the Department's webpage. The schedule of fees shall include criteria and standards for granting waivers or reduction of fees as provided in Subsection C.
C. 
The Government Records Department may, in its discretion and at the request of a records requester, waive all or a portion of the fees otherwise chargeable for records requests by tribal members under a predetermined amount established in the fee schedule adopted by the Department. Any other waiver of fees would have to be approved by the Chief Executive Officer when in his or her judgment fulfilling the request would be in the public interest. The criteria and determination that a request is in the public interest shall consider whether the request and dissemination of the information requested relates to promoting the health, safety and welfare of the broader tribal community and is intended to promote public policy initiatives within the Tribal government and is not primarily intended for the personal, political or commercial benefit of the records requester.
