(1)
Title. This chapter shall be known as the "Building and Zoning Administration Code of the Town of Brookfield" and will be referred to as "this code."
(2)
Purpose. The purpose of this code is to protect the health, safety and welfare of the public by establishing standards for the inspection, design, construction, structural strength, quality of materials, adequate egress facilities, sanitary facilities, natural lighting, heating and ventilating, energy conservation, and fire safety for all residential, commercial and public buildings and places of employment. It shall further include the administration and enforcement of all provisions of Chapter 17, Zoning Code, of the Code of the Town of Brookfield.
(3)
State codes adjoined. Except as otherwise specifically provided herein, the provisions of the Wisconsin Administrative Code, Chs. SPS 320 to 325 and SPS 327, the Uniform Dwelling Code, Chs. SPS 361 to 366, the Wisconsin Commercial Building Code, and Chs. SPS 375 to 379, Buildings Constructed Prior to 1914, are hereby made part of this code by reference.

Interpretation. The provisions of this code shall supplement any laws and regulations of the state and orders, rules and regulation of the Department of Safety and Professional Services relating to buildings. Where the requirements of the state code, orders, rules and regulations of the Department and provisions of this code conflict, the strictest requirements shall govern.
(5)
Invalidity of part. The several sections, subsections and paragraphs of this chapter are hereby declared severable. If any section, subsection, paragraph or subparagraph of this chapter shall be declared by a decision of a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the other provisions of the chapter or the section of which the invalid portion or paragraph may be a part.
(6)
Legal responsibility. The Town shall not assume legal responsibility for the design, construction or modification of any building or structure.
(7)
Administration. This code shall be administered and enforced by the Town Building Inspection Department.
(8)
Delegated appointed agent municipality. The Town has adopted the appointed agent municipality status as described in § SPS 361.60 and Ch. SPS 382 of the Wisconsin Administrative Code.
(a)
Responsibilities. The Town shall assume the following responsibilities for the State of Wisconsin Department of Safety and Professional Services:

Plan examination. Drawings, specifications and calculations for all the types of buildings and structures, except state-owned buildings and structures and other structures exempted in § SPS 361.03(3) and Ch. SPS 382 of the Wisconsin Administrative Code, to be constructed within Town limits shall be submitted, if the plans are for any of the following:
1.
A new building or structure.
2.
An addition to a building, structure, or building system such as fire alarm, sprinkler, plumbing, or HVAC system.
3.
An alteration of a building space, element, or structure, including alteration of an existing fire alarm system, fire sprinkler system, plumbing system, HVAC system, or replacement of equipment or fixtures within those systems.
(c)
Jurisdictional waiver. The Town may waive its jurisdiction for the plan review of a specific project or types of projects, or components thereof, in which case plans and specifications shall be submitted to the Department of Safety and Professional Services for review and approval. The Department of Safety and Professional Services may waive its jurisdiction for the plan review of a specific project, where agreed to by the Town, in which case plans and specifications shall be submitted to the Town for review and approval.
