It is the intent, purpose, and scope of this chapter to ensure the health, safety and welfare of the community by prohibiting the deposit or dumping of garbage, litter, refuse, recyclables, or rubbish on properties owned by the Township, on roads and road rights-of-way within the Township, and on private property owned by others.

As used in this chapter, the following terms shall have the meanings indicated:
Animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.
Any used or unconsumed substance or waste material which has been discarded, whether made of aluminum, glass, plastic, rubber, paper or other natural or synthetic material or any combination thereof, including but not limited to any piece of furniture, bottle, jar or can or any top, cap or detachable tab of any bottle, jar or can, any unlighted cigarette, cigar, match or any flaming or glowing material or any garbage, trash, refuse, debris, rubbish, vehicle part including tire, grass clippings or other lawn or garden waste, newspaper, magazines, glass, metal, plastic, cardboard, or paper containers or other packaging or construction material, but does not include political literature.
Any person, firm, partnership, association, corporation, company or organization of any kind.
Any dwelling, house, building or other structure used either wholly or in any part for private residential purposes, whether inhabited or temporarily or continuously uninhabited or vacant, and shall include any yard, grounds, walk, driveway, porch, steps, vestibule or mailbox belonging to or appurtenant to such dwelling, house, building or other structure.
Any and all roads, streets, road rights-of-way, sidewalks, parking areas open to the public, alleys and any and all public parks, squares, spaces, grounds (including the Township recycling center, and public buildings.
All solid wastes, including ashes, street cleanings, abandoned automobiles, dismantled vehicles, other abandoned personal property and solid market and industrial wastes.
Solid wastes consisting of both combustible and noncombustible wastes, such as circulars, leaflets, pamphlets, wrappers, handbills, newspapers and all and any other printed material, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, building materials and other like materials, but specifically excepting political literature.
The Township of West Rockhill.
A.
It shall be unlawful for any person to throw, drop, discard or otherwise place garbage, refuse, litter or rubbish of any nature upon any public place or private property, other than in a receptacle provided by the Township or the owner of the private property.
B.
It shall be unlawful for any person to drop, discard, place or deposit litter, rubbish, recyclables, or garbage in the Township recycling center except for the proper deposit of recyclables in containers labeled for the deposited material.
C.
No person, while a driver or passenger in a vehicle on a public street, road, or highway, shall throw litter or allow litter to be thrown from the vehicle.
D.
No person shall drive or move any truck or other vehicle onto any street, road, highway, or public place unless the vehicle is so constructed or loaded as to prevent any the contents thereof from being blown or deposited from the vehicle upon any street, alley or other public place.
The Township Manager, Code Enforcement Officer, or any member of the Pennridge Regional Police Force shall be authorized to enforce the provisions of this chapter. Any individual or entity authorized to enforce this chapter shall be authorized to file a complaint for the violation of this chapter with a Magisterial District Judge. Police officers shall further have the authority to arrest and detain such individual or individuals.
Any person violating any of the provisions of this chapter shall be punishable, upon conviction thereof, by a fine not to exceed $1,000 and costs of prosecution or by imprisonment in the Bucks County Prison for not more than 90 days, or by both fine and imprisonment. In the event of the imposition of a fine only, default in payment of such fine and costs of prosecution shall subject the violator to imprisonment in the Bucks County Prison for not more than 90 days.
If any sentence, clause, section, or part of this chapter is for any reason found to be unconstitutional, illegal, or invalid, such unconstitutionality, illegality, or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this chapter. It is hereby declared as the intent of the Board of Supervisors of West Rockhill Township, that this chapter would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, section, or part thereof not been included therein.
