[Adopted as § 1.06 of the prior Code]
As used in this article, the following terms shall have the
meanings indicated:
AUTHORITY
Any Village entity having custody of a Village record, including
an office, elected official, agency, board, commission, committee,
council, department or public body corporate and politic created by
constitution, law, ordinance, rule or order, or a formally constituted
subunit of the foregoing.
CUSTODIAN
That officer, department head, division head or employe of the Village designated under §
82-3 below or otherwise responsible by law to keep and preserve any Village records or file, deposit or keep such records in his office, or is lawfully in possession or entitled to possession of such public records and who is required by this section to respond to requests for access to such records.
RECORD
Any material on which written, drawn, printed, spoken, visual
or electromagnetic information is recorded or preserved, regardless
of physical form or characteristics, which has been created or is
being kept by an authority. "Record" includes, but is not limited
to, handwritten, typed or printed pages, maps, charts, photographs,
films, recordings, tapes (including computer tapes), and computer
printouts. "Record" does not include drafts, notes, preliminary computations
and like materials prepared for the originator's personal use or prepared
by the originator in the name of a person for whom the originator
is working; materials which are purely the personal property of the
custodian and have no relation to his office; materials to which access
is limited by copyright, patent or bequest; and published materials
in the possession of an authority other than a public library which
are available for sale, or which are available for inspection at a
public library.
Pursuant to § 19.34, Wis. Stats., and the guidelines
therein listed, each authority shall adopt, prominently display and
make available for inspection and copying at its offices, for the
guidance of the public, a notice containing a description of its organization
and the established times and places at which the legal custodian
from whom and the methods whereby the public may obtain information
and access to records in its custody, make requests for records, or
obtain copies of records, and the costs thereof. Each authority shall
also prominently display at its offices, for the guidance of the public,
a copy of this section. This subsection does not apply to members
of the Village Board.

This article is entitled the "Village of Gresham Ordinance to
Adopt the Wisconsin Municipal Records Schedule." The purpose of this
article is to provide the legal custodian(s) of public records in
the possession of the Village of Gresham with the authority to retain
and destroy those records.
The Village Board of the Village of Gresham, Shawano County,
Wisconsin, has the specific authority under § 19.21(4),
Wis. Stats., to adopt an ordinance to address the management and destruction
of public records.
The Wisconsin Municipal Records Schedule, as approved by the
Public Records Board on August 27, 2018, attached hereto, and incorporated
herein by reference, is hereby adopted by the Village Board of Gresham as the
Village's official record retention schedule.
When a record has met the terms of the retention period, the
record may be destroyed by the legal custodian of the record, provided
the custodian has complied with the notification requirement set forth
in § 19.21(4), Wis. Stats., to the Wisconsin State Historical
Society.
In the event of any conflict between the terms of this article
and any applicable state statute, the applicable state statute shall
control.
This article hereby revokes and supersedes any prior resolutions
or ordinances adopted by the Village of Gresham Board relating to
the retention and/or destruction of public records of the Village
of Gresham.
This article shall become effective upon its publication and/or
posting in the manner set forth in § 61.50, Wis. Stats.
