The operator of a snowmobile upon a roadway shall, in addition
to the provisions of Ch. 350, Wis. Stats., be subject to §§ 346.04,
346.06, 346.11, 346.14(1), 346.18, 346.19, 346.20, 346.21, 346.26,
346.27, 346.33, 346.35, 346.37, 346.39, 346.40, 346.44, 346.46, 346.47,
346.48, 346.50(1)(b), 346.51, 346.52, 346.53, 346.54, 346.55, 346.87,
346.88, 346.89, 346.90, 346.91, 346.92(1), 346.94(1) and (9), and
346.215(3), Wis. Stats.
No person shall operate a snowmobile upon any public right-of-way
in any public park, golf course or on any other public right-of-way
or on any other public municipal property in the Village except upon
the following designated snowmobile routes and trails:
A. Routes. All side streets in the Village except for CTH A, CTH G and
CTH U and Main Street.
B. Trails. Operation of snowmobiles on marked trails is authorized in
designated public parks, golf courses and recreational areas, subject
to approval of the Village Board. The Park Superintendent or Operations
Manager and the Chief of Police are directed and authorized to procure,
erect and maintain appropriate snowmobile route, trail and limit signs
and markers approved by the State Department of Natural Resources
under § 350.13, Wis. Stats.
C. No person shall fail to obey any route or trail sign, marker or limit
erected in accordance with this article.
No person shall operate a snowmobile on any sidewalk, pedestrianway or mall within the Village except as specifically authorized by §
250-2 above or for the purpose of crossing to obtain immediate access to an authorized area of operation.
No person shall operate or ride upon a snowmobile on a lake
at any time or place when such operation has been declared unsafe
by the Police Department. The Police Chief is authorized and directed
to procure, erect and maintain signs and markers giving notice that
such restrictions are in effect at all public access points on any
lake.
No owner or person having charge or control of a snowmobile
shall authorize or permit any person to operate such snowmobile who
is not permitted under state law to operate such snowmobile or who
is under the influence of an intoxicant or a dangerous or narcotic
drug.
Section 346.63, Wis. Stats., shall apply to the operation of
a snowmobile any place within the Village.
Any person who shall violate any of the provisions of this article shall be subject to a forfeiture as provided in §
1-3 of this Code.
Pursuant to § 350.047, Wis. Stats., the Village Clerk
is hereby authorized and directed to send a copy of this article to
the Department of Natural Resources and the County Sheriff's
Department.
The Village of Gresham, Shawano County, adopts the following,
all-terrain vehicle ordinance for the operation of all-terrain (ATV)
and utility terrain (UTV) vehicles upon all designated roadways of
the Village.
The following roads are designated as routes:
A. All signed Village streets.
As a condition for the use of these designated routes, the following
conditions shall apply to all operators (and passengers);
A. All ATV/UTV operators shall observe posted roadway speed limits.
B. All ATV/UTV operators shall ride single file.
C. All ATV/UTV operators shall slow the vehicle to 10 mph or less when
operating within 150 feet of a dwelling.
D. Routes must be signed in accordance with § NR 64.12(7)(c),
Wis. Adm. Code.
E. All ATV/UTV operators must stay on the paved portion of streets/roads.
No riding on the shoulder of the roads or sidewalks.
F. All ATV/UTV operators must be 16 years of age or older.
G. ATV/UTVs can only be operated from 8:00 a.m. to 10:00 p.m. on designated
Village streets/roads; starting April 1 until 11:30 p.m.
The Village of Gresham Village Board gives the authority to
enforce this article to the State of Wisconsin Highway Patrol, Shawano
County Sheriff's Department, Stockbridge Munsee Tribal Police,
Village President or his designee, and/or the Village Board of Trustees
or its designee, and any other enforcement authority as allowed by
Wisconsin Statutes.
Wisconsin state all-terrain and utility terrain vehicle penalties,
as found in § 23.33(13)(a), Wis. Stats., are adopted by
reference.
The Village of Gresham accepts no liability for the operation
of ATV/UTVs on any Village streets/roads under the provisions of this
article.
The provision of this article shall be deemed severable, and
it is expressly declared that the Village would have passed the other
provisions of this article irrespective of whether or not one or more
provisions may be declared invalid. If any provision of this article
or the application to any person or circumstances is held invalid,
the remainder of the article and the application of such provisions
to other person's circumstances shall not be deemed affected.
This article shall take effect upon passage and publication
and can be reviewed by the Board at its discretion. A copy of this
article and any revisions thereto shall be sent by the Village Clerk
to the Department of Natural Resources, the Shawano County Sheriff's
Department and any other law enforcement agency serving in the Village
of Gresham jurisdiction.
