This chapter is adopted under the authority granted by § 101.65, Wis. Stats.
The purpose of this chapter is to promote the general health, safety and welfare and to maintain required local uniformity with the administrative and technical requirements of the Wisconsin Uniform Dwelling Code and more particularly:
A. 
To exercise jurisdiction over the construction and inspection of new one- and two-family dwellings.
B. 
To provide plan review and on-site inspections performed by the Building Inspector.
C. 
To establish use of standard building permit forms as prescribed by the Department of Safety and Professional Services.
D. 
To collect fees to defray administration and enforcement costs.
The scope of this chapter includes the construction and inspection of one- and two-family dwellings built since June 1, 1980. Plans and inspections shall cover topics of construction, heating, ventilation, electrical and plumbing. The scope of this chapter shall also include additions and alterations to one- and two-family dwellings built before June 1, 1980, garages and residential outbuildings. An electrical inspection shall not be required for the following:
A. 
A reconnection has occurred within two weeks where the cause of disconnection related to nonpayment of the utility bill.
B. 
A reconnection is due to any type of repair not involving the service panel.
The Wisconsin Uniform Dwelling Code (UDC), Wis. Adm. Code Chs. SPS 320 to 325, and all amendments thereto, is hereby adopted and incorporated by reference and shall apply to all buildings within the scope of this chapter. A copy of the UDC shall be kept on file in the office of the Building Inspector.
A. 
Qualifications. The Building Inspector shall be certified by the Department of Safety and Professional Services, as provided by § 101.66(2), Wis. Stats., in the category of Uniform Dwelling Code Construction Inspector. In addition, the Building Inspector or deputy inspectors shall possess the certification categories of UDC HVAC, UDC Electrical, and UDC Plumbing.
B. 
General powers and duties. The Building Inspector shall administer and enforce all provisions of this chapter. The Inspector may at all reasonable times enter upon any public or private premises for inspection purposes. No person shall interfere with the Inspector while in the performance of his duties.
C. 
Records. The Building Inspector shall keep a record of all permits issued and inspections made. The permits shall be marked in order and shall coordinate with the seal numbers purchased from the state. A record shall also be kept of all condemnation and removal of buildings. The Inspector shall make an annual report to the Village Board.
Any structural changes or major changes to mechanical systems that involve extensions shall require permits. Repairs for purposes of maintenance or replacements in any existing building or structure which do not involve the structural portions of the building or structure or which do not affect room arrangement, light and ventilation, access to or efficiency of any existing stairways or exits shall be deemed minor repairs and shall not require a permit. Restoration or repair of an installation to its previous code-compliant condition, as determined by the Building Inspection, is exempted from permit requirements. Residing, reroofing, finishing of interior surfaces and installation of cabinetry shall be exempted from permit requirements. If construction commences prior to permit issuance, the permit fee shall be doubled.
A. 
Application forms to be used. The Building Inspector shall use forms prescribed by the Department of Safety and Professional Services and shall file a copy of each form with the Department of Safety and Professional Services in accordance with § 101.65(3), Wis. Stats.
B. 
Submission of plans. The applicant shall submit two copies of plans at the time the building permit application is filed.
C. 
Issuance of permit. If the Building Inspector determines that the building plans comply with this chapter, a permit shall be issued. After being approved, the plans and specifications shall not be changed, except with approval of the Building Inspector. The issued building permit card shall be posted in a conspicuous place at the building site.
D. 
Occupancy permit. The dwelling may not be occupied until an occupancy permit is issued. The Building Inspector shall issue an occupancy permit if no violations exist that could reasonably be expected to affect health or safety.
E. 
Permit lapse. The building permit shall expire one year after issuance if the dwelling exterior has not been completed.
If a building is so old, dilapidated and so out of repair as to be dangerous, unsafe and unsanitary or otherwise unfit for human habitation and so that it would be unreasonable to repair, the Building Inspector shall order the owner to raze or remove the building at the owner's expense. Such order and proceedings shall be carried out in a manner prescribed by § 66.0413, Wis. Stats.
The building permit fees shall be determined by resolution of the Village Board and are on file with the Building Inspector and the Village Clerk.
A. 
The Building Inspector may issue a stop-work order for the following reasons:
(1) 
If written violations are not corrected within 30 days.
(2) 
Construction significantly and structurally deviates from approved plans.
(3) 
Construction is deemed dangerously unsafe.
B. 
The stop-work order "red tag" shall be posted at the construction site, and the owner shall be notified in writing. The stopped work may resume when unsafe conditions and violations are corrected and the Building Inspector authorizes a restart.
Any person feeling aggrieved by an order of the Building Inspector may, within 30 days thereafter, appeal from such order to the Village Board. The Village shall follow procedures set forth in Ch. 68, Wis. Stats., to arrive at a final determination. Final determination may be reviewed as provided in Wis. Adm. Code § SPS 320.21.

The enforcement of this chapter and all other laws and ordinances relating to building shall be by means of the withholding of building permits, imposition of forfeitures and injunctive action. Forfeitures shall be as provided in § 1-3 of this Code. Said forfeitures shall be for each day of noncompliance. When the Building Inspector cites violations of this chapter, the violations shall be promptly corrected. All written violations shall be corrected within 10 days unless an extension of time is granted pursuant to Wis. Adm. Code § SPS 320.21.
