Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.
The following days only: New Year's Day, Memorial Day, July Fourth, Labor Day, Thanksgiving and Christmas.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a.
The Mayor or, in his/her absence, disability or inability to act, the Chief of Police or the ranking member of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b.
Any regulations promulgated by the Mayor or Chief of Police and in accordance with Paragraph a above shall provide for the posting of proper warning signs advising drivers and pedestrians of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c.
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d.
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.
e.
The Mayor is authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days or during specified hours on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare, for a period not longer than 30 days; in compliance with Paragraph d above.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute or in this chapter, any person who shall violate any section or any part of Chapter 7, entitled "Traffic" of the Revised General Ordinances of the Town of Morristown," shall, upon conviction, be subject to one or more of the following: imprisonment in the county jail or in any place provided by the municipality for the detention of prisoners, for any term not exceeding 90 days; or by a fine not less than $21 nor exceeding $1,250 by a period of community service not exceeding 90 days.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Town of Morristown which are contained in this chapter are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The Governing Body hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Town of Morristown, in the County of Morris, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as MUTCD, except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor or utility who fails to comply with the provisions of MUTCD while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility as required under a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a pre-construction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason the emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Town may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Town shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Town before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Officer in charge of the Police Department. If it is determined by the Officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County Jail for a term not exceeding 90 days. For a second offense, the person, contractor or utility shall, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County Jail for a term not exceeding 90 days. A separate offense shall be deemed committed on each day during or on which violation occurs or continues.

All ordinances or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

This section shall take effect after approval by the Commissioner of Transportation 20 days after passage and publication as prescribed by law.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b.
The effectiveness of this subsection is contingent upon the signs being erected as required by law. During planned events or planned road construction, all signs shall be posted 48 hours in advance.
c.
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

Whenever snow has fallen and the accumulation is such that it covers the street or highway to a depth of two inches or more, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below.
The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly to the curb, and to the extent that parking will not interfere with the normal flow of traffic.

Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. Parking shall be prohibited on those streets or highways or portions thereof whenever snow has fallen such that an emergency exists and temporary No Parking signs have been posted on the streets or highways or portions thereof described below. The above parking prohibitions shall remain in effect until said signs have been removed.

Any unoccupied vehicle parked or standing in violation of this ordinance shall be deemed a nuisance and a menace to the safe and proper regulation of traffic. Any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

a. PARKING METER PARKING METER SPACE
Definitions. As used in this subsection:
Includes any mechanical device or meter not inconsistent with this subsection placed or erected for the regulation of parking by authority of this subsection.
A space in the street alongside the curb within which a vehicle shall be properly parked, which space shall be bounded by the curb and lines marked on the street and shall have a parking meter installed adjacent to the curb side of the space.

Time limits established. The following time limits are hereby established in parking meter zones in the Town of Morristown: 30 minutes, 2 hours, and 18 hours.

Effective meter periods established. The following effective meter periods are hereby established in parking meter zones in the Town of Morristown:

d.
Parking meter zone regulations. Parking meter zones and regulations are hereby established as described in Paragraphs b, c, and d on the streets, portions of streets, and sides of streets indicated, as set forth in Schedule I. The time limit for parking meter spaces shall be two hours with the exception of:
1.
Lackawanna Place from Morris Street to Lot 3R during Period C, which time limit shall be 18 hours; and
2.
Up to 30 parking meter spaces anywhere in the Town which may be designated as "short-term" parking spaces with thirty-minute time limits by the Parking Authority of the Town of Morristown in their discretion in consultation with the Morristown Partnership.

e.
Installation of meters. In the parking meter zones hereby created or hereafter created, a parking meter shall be installed adjacent to the curb side of each parking meter space as may be designated by the Governing Body. The meter shall be placed not more than two feet from the curb and each space shall be marked out as an individual parking space for vehicles. Each meter shall be set to operate upon the deposit of one or more coins as set forth in subsection.
f.
Each meter shall be arranged so as to show or display a signal which shall clearly indicate whether the time limit during which parking in the space is permitted has expired.
g.
Operation of parking meters and rate schedule. Except in a period of emergency determined by a member of the Department of Administration and Public Safety, or except in compliance with the direction of a Police or Fire Officer, or except during certain hours on certain streets, or portions thereof, when and where parking is prohibited in order to expedite the flow of traffic, when any vehicle shall be parked in a parking meter space between the hours specified in Paragraph e of this subsection, the owner, operator or driver of any vehicle shall, upon entering the parking meter space, immediately deposit a coin or coins, or credit card payment, where applicable, in the parking meter in the amounts specified on the parking meter, which shall be based on $0.75 per hour for non-credit card meters having a time limit of 60 or 120 minutes, $1 per hour for non-credit card meters having a time limit that is less than 60 minutes, $0.25 per 45 minutes for credit card meters having a time limit of 18 hours, and $1 per hour for all other credit card meters. Credit card meters shall be subject to a minimum charge, as indicated on the meter.
h.
Parking time limits. Any vehicle parking or standing in any designated parking meter space in a parking meter zone shall be parked within the lines marked on the street or curb and may only occupy the space during the parking limit provided by the ordinance of the Town for the part of the street in which the parking meter space is located and shall not exceed the time limit indicated on the meter.
i.
Unlawful extension of parking time. It shall be unlawful for any person to deposit or cause to be deposited in a parking meter, any coins for the purpose of extending the parking time beyond the total lawful parking period provided for the parking space along side or next to which the parking meter is placed. It shall be unlawful to willfully break, destroy or impair the usefulness of, or to open without lawful authority, any parking meter installed in a parking meter zone. It shall be unlawful to deposit or cause to be deposited in any parking meter any slug, device or substitute for a coin of the United States of America. It shall be unlawful to deposit or cause to be deposited a "sleeper" coin, which is a coin placed in the coin slot without the handle being turned thus activating the mechanism as per instructions.

No person shall cause or permit to be parked any motor vehicle upon any street between the specified hours and days described.

No person shall park a vehicle between the hours specified any day (except Sundays and public holidays) upon any of the streets or parts of streets described.
All prohibited parking areas designated below shall be further designated and posted as a "Tow-Away Zone," and in accordance with § 7-3 of the Code of the Town of Morristown (2005), any vehicle parked in any place where parking is prohibited may be impounded by the Morristown Bureau of Police and shall be towed or transported to any place designated by the Chief of the Bureau of Police.

No person shall park any commercial vehicle, truck or vehicle over four tons' gross vehicle weight (GVW), a school bus, any other type of bus, recreational vehicle, camper, boat or trailer for more than two hours during the times specified upon any of the streets or parts of streets described.

b.
Commercial vehicles. For purposes of this section, "commercial vehicles" are defined as trucks, buses, sedan delivery vehicles, station wagons with advertising matter on the sides, or any other commercially used vehicle except a passenger car with no advertising matter exposed to view. This shall include a motor-driven vehicle used for commercial purposes on the highways, having a gross vehicle weight of 8,000 pounds or less, which vehicle is used by the owner or lessee of the property for the transportation of people, goods, wares, merchandise, tools and/or equipment, and which is the principal vehicle used by said owner or lessee of the property in connection with said property owner's or lessee's business. This definition shall also include a trailer, whether or not attached to a motor vehicle. This definition shall also include any vehicle bearing advertisements or printed commercially related matter thereon. Any vehicle designed or converted and used for commercial purposes, notwithstanding the type of registration, shall be deemed to be commercial.

Except as set forth in Subsection b2, commercial vehicles shall be prohibited from parking on any street in a residential zone district between the hours of 9:00 p.m. and 6:00 a.m.
2.
The parking prohibition set forth herein shall not apply to commercial vehicles necessary to the driver's actively performing a service (e.g., plumber, moving van, cable TV, etc.) for a resident, and which therefore needs to be parked.

The purpose of this section is to reduce hazardous traffic conditions resulting from the overflow of traffic onto and the overcrowding of streets exclusively or primarily serving residential area serviced by such streets in order to protect those streets and their inhabitants from polluted air, excessive noise and the trash and refuse caused by the entry of such vehicles; to protect the residents of such streets from unreasonable burdens in gaining access to their residences; to preserve the maintenance of the streets in such areas in a clean and safe condition; to preserve and protect the safety of children and other pedestrians and traffic on said streets; to reduce air pollution and other deleterious environmental effects of vehicular commuting; to encourage reliance upon car pools and other means of mass transit, and generally to promote, preserve and protect the peace, good order, comfort, convenience, health, safety and welfare of the citizens and inhabitants of the Town.

The following vehicles shall be exempt from the two-hour parking limitation.
a.
Vehicles owned and operated on a regular basis by a resident of that street or an employee of an entity permitted to do business on that street whose vehicle has displayed on its left rear window a current regulation exemption sticker for that street (hereinafter "sticker").
b.
Visitors. A vehicle displaying a current reusable visitor parking permit may park a maximum of seven days, provided that the operator of the vehicle is a bona fide guest of a resident within the permit parking area. The visitor's permit shall hang from the rear-view mirror of his/her vehicle in such manner as it may be clearly visible to any officer enforcing parking regulations.
c.
Contractors, service and delivery vehicles. Contractors, service and delivery vehicles bearing the name and address of a commercial business may park without a permit during the time they are rendering service to a residence within the permit parking area.
d.
Emergency vehicles. Emergency vehicles and public service, telephone and other public utility vehicles may park within the two-hour parking area during the time they are rendering service or repairs within the area.

The Town Business Administrator, or his/her designee, shall periodically cause traffic studies to be performed in residential areas. Where such studies reveal that certain streets or parts of streets primarily servicing residential land uses are being used for parking by drivers who do not reside on said streets, thereby causing a shortage of parking spots for the residents of those streets, the Administrator shall recommend to the Town Council that such streets be included within the regulations of this section. A street shall be deemed to have a shortage of residential parking spots where an average of 25% or more of the parking spots are occupied by vehicles owned by nonresidents and an average of 65% or more of the parking spots are occupied during weekdays from 9:00 a.m. to 5:00 p.m.

Applications for parking permits pursuant to this section shall be made in writing on forms provided by the Town Clerk. Permits shall be issued only under the following terms and conditions:
a.
To persons who are residents of said streets or portion thereof upon which parking is restricted by this section, a maximum of three permanent stickers per dwelling unit, valid through December 31 of the year of issue, shall be issued for vehicles owned or principally operated by such persons who can provide proof of residency.
b.
Up to four reusable visitor parking permit hangtags shall be issued to each dwelling unit on any street or portion thereof upon which parking is restricted by this section for use only by visitors to that dwelling unit. There is no fee for a new application; however, any replacement tag issued will invalidate the initial permit and a fee of $5 will be imposed.
c.
A maximum of six permanent stickers shall be issued to each nonresidential entity whose place of business is located on a street or portion thereof upon which parking is restricted by this section, and shall be valid through December 31 of the year of issue.
d.
A properly displayed sticker shall constitute authorization to park the vehicle for an unlimited period of time in any legal parking space on the street for which the sticker was issued, except when alternate side, emergency or snow removal restrictions are in effect.

In accordance with the provisions N.J.S.A. 39:4-197, the following Municipal and Board of Education Property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate, or park a vehicle in violation of the regulations indicated.

Handicapped Parking Spaces on Municipal Property.
(1)
All stalls shall be 12 feet wide as shown on the attached site plan and signed with R7-8 and R7-8P (Reserved Parking Sign and Penalty Plate), in the designated parking areas for persons who have been issued the Handicapped Parking Permits by the Motor Vehicle Commission.
(2)
It will be unlawful to park, stop or stand a motor vehicle in an appropriately marked handicapped parking space unless the vehicle displays a special vehicle identification card, certificate, or license plate issued by the Motor Vehicle Commission pursuant to N.J.S.A. 39:4-204 et seq. and N.J.S.A. 39:4-197.5 or 39:4-197.6 and a physically handicapped individual is either the driver or a passenger in that vehicle.
2.
Reserved parking: All vehicles that are granted specialty parking in this section such as: police vehicles, ambulances, teachers, etc., must be properly identified and the reserved parking spaces must be shown on the attached site plan.

7.
Authorized vehicles only. Road "A" (Police Drive) shall be designated for use by police vehicles only, no other vehicle shall be permitted to enter upon or be driven upon said roadway.
That all signs, posts, or other necessary materials be installed and paid for by the applicant. All signing shall conform to the current Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27. |
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this subsection or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both. |
b.
School grounds. No vehicle shall be parked in the school grounds of the Morristown High School, George Washington School, Alexander Hamilton School, Mills Street School, Thomas Jefferson School, and Lafayette School except in the authorized parking areas.
c.
Speedwell avenue firehouse - north side. Except by permit to members of the Morristown Fire Bureau, paid and volunteer, parking is prohibited at all times on the north side of the Speedwell Avenue Firehouse, from the sidewalk to the rear of the building, a distance of approximately 126 feet.
d.
Parking restricted municipal lots. No truck or tractor-trailer or other commercial vehicle shall be permitted to park in any municipal (non-Parking Authority) parking lot at any time without prior permission of the Mayor or his/her designees. No person shall park any other vehicle longer than twenty-four consecutive hours in any such municipal parking lot unless otherwise provided for herein, including but not limited to the following locations: Madison Street lot, Speedwell Avenue (Fire House) lot, Burnham Pavilion lot. Vehicles parked for longer than twenty-four consecutive hours may be subject to towing at the owner's expense.
e.
Parking in publicly owned lots.
1.
No motor-driven vehicle used for commercial purposes on the highways, which vehicle is used for the transportation of people, goods, wares, merchandise, tools and/or equipment or tractor-trailer shall be permitted to park in any municipal (non-Parking Authority) lot at any time without prior permission of the Mayor or his/her designees.
2.
No truck or tractor-trailer or other commercial vehicle as defined by § 7-16a shall be permitted to park in any publicly owned lot between the hours of 8:00 p.m. and 8:00 a.m., whether or not it is operated by the Parking Authority or the Town of Morristown.
3.
No vehicle shall be permitted to park in any publicly owned lot for a period longer than 24 hours except for vehicles with permits issued by the Parking Authority. Any unauthorized vehicle parked for longer than 24 consecutive hours in a publicly owned and operated lot may be subject to towing at the owner's expense.
f.
Martin Luther King Avenue and Coal Avenue Parking Lot.
1.
General Parking.
(a)
All vehicles must park in designated areas and between the lines provided.
(b)
No person shall stop or stand a vehicle upon any of the aisles or vehicular travel lanes therein.
(c)
There shall be no parking of any vehicles between the hours of 9:00 p.m. and 6:00 a.m. on all days.
(d)
All parking shall be reserved for use exclusively by staff, clergy, and attendees of Calvary Baptist Church between the hours of 8:00 a.m. and 1:00 p.m. Sundays.
2.
All vehicular travel lanes shall be two-way traffic.
3.
The speed limit for both directions of travel shall be 15 mph.
4.
Tow-Away. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways or pedestrian walkway, present in any way a safety or traffic hazard, or otherwise violate any of the regulations herein may be removed by towing the vehicle at the vehicle owners' or vehicle operators' expense.

In accordance with the provisions of N.J.S.A. 40:48-2.46, the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the regulations listed herein. No person shall operate or park a vehicle in violation of the following regulations.

a. COIN LEGAL HOLIDAY OFF-STREET PARKING PROJECT PARKING SPACE
Definitions. As used in this subsection; the following terms shall have the meanings indicated:
A coin of the United States of America.
The following days only: New Year's Day, Memorial Day, July Fourth, Labor Day, Thanksgiving and Christmas.
The areas or places constructed or acquired or to be constructed or acquired and owned and operated by the Parking Authority of the Town for the parking and storing of motor and other vehicles, including all real and personal property, driveways, roads, approaches, structures, garages, meters, mechanical equipment and all appurtenances and facilities either on, above or under the ground which are used or usable in connection with such parking or storing of such vehicles.
The area or portion of an off-street parking project within which a vehicle may be properly parked, which space shall be bounded by curb or lines marked on the surface of the project or by a combination of curb and lines.
b.
Parking areas; limits; fees.
1.
Parking authority regulation. The Morristown Parking Authority shall have the authority to regulate the following matters with respect to parking areas designated in this section: reserved areas, hours of operation, prohibited parking, unlawful extension, unlawful overtime, prohibited areas, permits, parking meters, and the establishment and allocation of metered, daily and monthly parking areas with respect to the parking facilities set forth in Subsection b. Additionally, the Morristown Parking Authority shall continue to exercise the authority it already has with respect to the Maple Avenue Parking Deck (Parking Area No. 1), Cattano Avenue Lot (Parking Area No. 2), Ann-Bank Parking Garage (Parking Area No. 12), and Mall Lot (Cattano Avenue, Washington and Prospect Streets). Copies of said regulations shall be maintained on file and available for inspection with the Morristown Town Clerk.
2.
Designated parking areas. The following parking areas, which have heretofore been regulated by Ordinance, as well as any Off-Street Parking Projects acquired after the adoption of this Ordinance, shall be regulated by the Parking Authority as set forth in Paragraph b1 above:
(a)
Parking Area No. 3. Parking Area No. 3 is a parking lot situated at the rear (westbound side) of the New Jersey Transit Corporation Railroad Depot including the southwesterly side of a street know as Lackawanna Place, running from Morris Street to the rear of the Railroad Depot, and the portion of the parking area lying on the westerly side of Lumber Street, directly opposite Lackawanna Place, together with the area located on the front (eastbound side) of the Railroad Depot comprising both sides of the paved driveway, sometimes known as Saw Mill Lane, and running for a distance of 170 feet in a northerly direction from Morris Street, and the paved Railroad Plaza area fronting on Morris Street.
(b)
Parking Area No. 4. Parking Area No. 4 is a parking lot situated on the northeasterly side of Morris Street opposite Pine Street on lands leased from the New Jersey Transit Corporation.
(c)
Parking Area No. 6. Parking Area No. 6 is a parking lot on the northerly side of Clinton Place and the northwesterly side of Speedwell Avenue.
(d)
Parking Area No. 7. Parking Area No. 7 is a parking lot situated on the southwesterly side of Ann Street at the extension of Schuyler Place.
(e)
Parking Area No. 8. Parking Area No. 8 is a parking lot situated on the corner of Franklin Street and Elm Street.
(f)
Parking Area No. 9. Parking Area No. 9 is a parking lot situated on the southerly side of King Place at the rear of 110 South Street.
(g)
Parking Area No. 10. Parking Area No. 10 is a parking lot situated in the rear of properties fronting on the southerly side of Morris Street adjacent to property of the United States Post Office.
(h)
Parking Area No. 11. Parking Area No. 11 is a parking lot situated on the northerly side of Court Street between the parking garage of the County of Morris and the lands of the Morristown National Historical Park.
(i)
Parking Area No. 13. Parking Area No. 13 is a parking lot situated on the southerly side of Flagler Street at its intersection with the easterly side of Speedwell Avenue.
(j)
Parking Area No. 14. Parking Area No. 14 is a parking lot situated on the northeasterly side of Sussex Avenue, opposite Grant Street.
(k)
Parking Area No. 15. Parking Area No. 15 is a portion of a parking lot situated on the Northeasterly side of Speedwell Avenue on lands owned by the Town of Morristown and designated as Block 5002, Lot 7 on the Tax Map of the Town of Morristown, and is restricted to that area located on the northwesterly side of said lot running for a distance of 200 feet in a northeasterly direction from Speedwell Avenue and comprising 20 public parking spaces for a distance of said 200 feet and a depth of 20 feet or approximately 4,000 square feet.
The metered parking spaces of Parking Area No. 15 shall be in operation from 8:00 a.m. to 9:00 p.m., daily, excepting Sundays and legal holidays.
(l)
Fees for unmetered parking spaces, per month. Fees for unmetered parking spaces, per month, are as follows:

Lot No. 15. Parking in the first five spaces on the northwesterly side running in a northeasterly direction for a distance of 50 feet from Speedwell Avenue shall be metered spaces and shall be limited to one hour and the fee or charge shall be $0.10 for each 15 minutes of parking time, payable by depositing one $0.10 coin for each 15 minutes or one $0.25 "convenience coin" for each thirty-minute period to the one hour maximum limit in the parking meter adjacent to the parking space used. Parking in the remaining 15 spaces for the remaining 150 feet from Speedwell Avenue to the aforementioned distance of 200 feet shall be limited to three hours and the fee or charge shall be $0.10 for each 15 minutes of parking time, payable by depositing one $0.10 coin for each 15 minutes or one $0.25 "convenience coin" for each thirty-minute period to the three-hour maximum limit in the parking meter adjacent to the parking space used. |
(m)
Powers and duties of the Morristown Parking Authority. The Town of Morristown does hereby grant permission to the Morristown Parking Authority to carry out the terms and provisions of this subsection and does hereby grant easement rights to the Parking Authority for this purpose. This authorization and easement rights are, however, revocable by the Town of Morristown at any time by adoption of an ordinance which specifically revokes the permission and easement rights granted herein without need for the Town to reimburse the Parking Authority for lost revenues.
(n)
Rights of the Town of Morristown not invalidated. Nothing in this subsection is intended to invalidate, vacate or in any way diminish the rights granted by the Town of Morristown in a certain Settlement Agreement between the Morristown Jewish Community Center and House of Israel resolving an action in the Superior Court of New Jersey under Docket No. L-5326-69 P.W., which agreement was approved by the Morristown Council by Resolution dated December 14, 1970 and executed by Mayor Victor L. Woodhull and attested by Town Clerk Arthur A. Vigilante in which, among other things, the Town agreed in Subparagraph (d) as follows:
"(d) That the Town of Morristown will provide a means of access to the Southerly and Easterly side of the Morristown Jewish Community Center building through the entrances of the parking lot to the proposed firehouse so as to affect a method of picking up or leaving off students, persons attending services, or other persons attending functions at the Morristown Jewish Community Center building."
c.
Regulations for control of parking lots.
1.
Unlawful extension of parking time. It shall be unlawful for any person to deposit or cause to be deposited in a parking meter, any coin or coins for the purposes of extending the parking time beyond the total lawful parking limit as herein specified. Such overparked vehicle will be issued additional summonses for each additional authorized time period which is overextended. This provision is directed at preventing what is commonly termed "meter feeding" and is exacted to provide for the convenience of "turnover" parking.
2.
Unlawful overtime parking. It shall be unlawful and an offense for any person to permit a vehicle registered in his name or operated by him to remain in any parking space while the parking meter adjacent to the parking space is displaying a signal showing that the time for which the privilege granted to park in the space has expired.
3.
Lines and markings. Suitable lines or markings shall be provided upon the surface of off-street parking projects to denote and designate each parking space. It shall be a violation of this article to park a vehicle across any such line or markings or to park a vehicle in such position that it shall not be entirely within the area so designated by such lines or markings as a parking space.
4.
Removal of vehicles. The Parking Authority and the Police Department shall have the right to remove from off-street parking projects any unattended vehicle parked or standing in any portion thereof not designated as a parking space or any unattended vehicle parked or standing in a designated parking space which has remained there for a period of 10 hours after a summons has been issued charging a violation hereunder. When a vehicle is removed from an off-street parking project, the owner of the vehicle shall pay, before being entitled to recovery or possession of the vehicle, all reasonable charges for towing, storage and other removal expenses incurred.
5.
Unlawful use of public parking areas for the conduct of private business. It shall be unlawful to utilize any portion of any public parking facility, hereinabove enumerated, included but not limited to parking spaces, driveways, traffic lanes and planting areas, for the use of said spaces or general areas for the purpose of storing or causing to be stored commercial and/or private vehicles for the purpose of using said public parking spaces or general areas for the storage, maintenance, washing, painting, repairing, loading or unloading of vehicles or for the conduct of private business, regardless of time limits posted and fees paid, within the subject areas, which practice denies or unduly limits the use of the parking facilities to the general parking public for whom they are intended. Nothing herein shall be construed to prohibit necessary and minimal emergency repairs which are required to render a car operational so that it can be moved from any parking space.
6.
Tampering with meters. It shall be unlawful to tamper with parking meters or to deposit therein anything other than coins designated in this section. It shall be unlawful to deface, injure, tamper with, willfully break, destroy or impair the usefulness of, or to open without lawful authority, any parking meter installed in off-street parking projects. It shall be unlawful to deposit or cause to be deposited in any parking meter any slug, device or substitute for a coin of the United States of America.

Parking Area No. 3.

Direction of traffic designated. Traffic shall move in a westerly direction only in the Railway Parking Plaza area at the Erie Lackawanna Railroad Station (known as "Parking Area No. 3") from the entrance to the Plaza on Morris Street to the exit on Saw Mill Lane.
2.
Bus stop established. Buses shall pick up and discharge passengers in the Railway Plaza at the curb at the front entrance to the Erie Lackawanna Railway Station. No person shall stop or stand a vehicle other than a bus in the bus loading lane except to pick up and discharge passengers, which shall consume no more than three minutes.
3.
Bus storage lane established. Buses may be parked facing in a westerly direction for no longer than 15 minutes at one period in an area which shall be designated as a temporary bus storage lane in the third lane removed from the curb of the Railway Station Plaza. No person shall stop or stand a vehicle in the traffic lane designated as a bus storage lane with the exception of a bus.

Erection of signs. Signs shall be erected and lanes marked in accordance with this section.
e.
Enforcement of ordinance and regulations. Morristown Parking Authority Enforcement Officers and Morristown Police Officers are authorized to enforce regulations adopted pursuant to this section, or any provisions of this section by the issuance of a municipal court summons for violations thereof.

In accordance with the provisions of N.J.S.A. 39:5A-4, the regulations of Subtitle 1, Title 39 of the Revised Statutes are hereby made applicable to the properties listed below.

The owners of the premises referred to in Subsections 7-41.2, 7-41.3, 7-41.4 and 7-41.6 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the "Manual on Uniform Traffic Control Devices for Streets and Highways." The cost for the procurement and installation of signs and pavement markings shall be the responsibility of the owner of said property. The owner shall subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Town of Morristown. The owner shall be responsible for the repair and restoration or replacement of same.

a.
The Town of Morristown hereby determines to install and utilize a traffic control signal monitoring system ("system") at various intersections within the Town of Morristown as approved by the Commissioner of Transportation pursuant to the Act.
b.
The system to be installed shall be approved by the Governing Body by resolution.
c.
The Town of Morristown shall have the authority to enter into a contract, following a lawful procurement process, for the installation of the system. Any contract that shall contain provisions contrary to the Act shall not be deemed invalid but rather reformed to conform to the Act.
d.
The signs notifying drivers that a system is being utilized shall be approved by the Municipal Engineer, and shall be placed on each street converging into the affected intersection as required by the Act.
e.
The Municipal Engineer shall inspect and certify the system at least every six months from the date of its installation.

The Police Bureau of the Town of Morristown shall review the recorded images produced by the system to determine whether sufficient evidence exists demonstrating that a traffic control signal violation has occurred and shall issue a summons when appropriate in accordance with the rules of the court.

Except as otherwise provided in this section, the recorded images produced by the system shall be available for the exclusive use of the Police Bureau for the purpose of discharging his or her duties under P.L. 2007, c. 384.
b.
Any recorded image or information produced in connection with the system shall not be deemed a public record under N.J.S.A. 47:1A-1 et seq., or common law. The recorded images shall not be:

Any recorded image or information collected in connection with a traffic control signal violation shall not be retained after 60 days following the collection of any fine or penalty.
d.
If a summons is not issued within 40 business days following the traffic control signal violation, all recorded images and any information collected with respect to the traffic control signal violation shall be removed by the Police Bureau within two business days.
e.
The Town of Morristown shall certify compliance of this section by filing a report to the Commissioner of Transportation in accordance with the Act.

The liability of the owner and operator of a motor vehicle for a traffic control signal violation summons pursuant to the system shall be joint subject to provisions of the Act.

Any person liable for a traffic control signal violation, pursuant to the section and the Act, utilizing the system shall be subject to the following fines:

a.
No driver shall enter an intersection unless there is sufficient space on the other side of the intersection to accommodate the vehicle he/she is operating without obstructing the passage of other vehicles or pedestrians, notwithstanding any traffic control signal indication to proceed.
b.
All intersections within the Town of Morristown shall be designated as "Don't Block the Box" intersections, and appropriate striping and signage shall be provided.
c.
This section is consistent with and amplifies N.J.S.A. 39:4-67, by authorizing the installation of signage to be designed for this purpose and erected at intersections.
d.
There shall be a minimum penalty of $250 for a violation of this section.
