a. 
A violation of any section or subsection of this chapter shall, upon conviction thereof, be punishable by a fine not to exceed $1,250 or by imprisonment for a term not exceeding 90 days, or both for each violation committed thereunder. Notwithstanding anything to the contrary contained herein, a violation of any section or subsection of this chapter may be punishable by a fine exceeding $1,250, but not greater than $2,000, provided that the owner of the subject property be afforded a thirty-day period to cure or abate such condition and shall also be afforded an opportunity for a hearing before the Municipal Court for an independent determination concerning said violation. Subsequent to the expiration of the thirty-day cure period, a fine greater than $1,250, but not greater than $2,000, may be imposed if the Municipal Court has not determined otherwise, or, upon reinspection of the subject property, it is determined that the abatement of the condition has not been substantially completed.
b. 
Each violation of a section or subsection of this Code shall constitute a separate and distinct violation independent of any other section or subsection or any order issued pursuant to this Code. Each day's failure to comply with any such section or subsection shall constitute a separate violation.
c. 
Where the defendant is other than a natural person or persons, the provisions of Paragraph b shall also apply to any agent, superintendent, officer, member or partner who shall, alone or with others, have charge, care or control of the premises.
d. 
In the event of the imposition of a fine or penalty by the Municipal Court or any other court of competent jurisdiction against the owner, operator or lessor of any building or structure in the Town required to be registered pursuant to § 13-90, for violation of any Town ordinance or any State law applicable to the Town, the fine or penalty shall be collectible as a lien against the premises and, in addition thereto, shall be collectible pursuant to the procedures for appointment of a receiver so set forth in § 13-90, in addition to any other remedies now provided by law.
e. 
Violations of any provision of this Code may be prosecuted by the service of a summons by the Code Enforcement Officer upon the violator, commanding such violator to appear in the Municipal Court of the Town of Morristown.
