No person shall conduct, maintain or operate a business for the sale of meat, poultry or fish, unless a license is first obtained from the Division of Health. Such establishment shall be kept in a clean, sanitary condition at all times. Meat, poultry and fish shall be kept refrigerated at all times, either in refrigerators or refrigerated display cases.

a. 
No beef, pork, veal, mutton, lamb or horseflesh, nor any part of any animal from which said meat is obtained, shall be sold for food purposes or exposed for sale or held in possession in a store in which food is sold unless said animal has been examined both before and after slaughter by a meat inspector duly appointed by the United States Government or by the State of New Jersey, Department of Agriculture, and unless the meat of said animal has been passed as fit for food and has been stamped or labeled with a proper mark or marks according to the system of the United States Bureau of Animal Industry or prescribed by the Division of Health. The provisions of this section shall be construed to apply to all meat, sausages, chopped meats and edible viscera.
b. 
All meats, poultry and fish delivered in the Town of Morristown shall be protected from contamination by flies, dust and dirt while in the process of delivery and shall be kept refrigerated at or below 45° F., at all times; and no meat, fish or poultry shall be exposed to sale outside of any market or store or retailed from any vehicle.
c. 
Any person transporting or storing frozen food for a food establishment shall keep frozen foods at or below 0° F., at all times, except when being allowed to thaw for use. No such foods shall be refrozen. All hot foods shall be delivered and kept at or above 140° F., at all times.
d. 
Whenever the words "horseflesh" or "horsemeat" are used in this section, they shall mean and be deemed to cover flesh of the equine animal family, whether raw, processed shall be separate machines for grinding horseflesh, and when ground with other meat, the machine provided for the grinding of horsemeat shall be used.
e. 
Wherever horseflesh is served in a restaurant, the item shall be indicated on the printed or mimeographed menu in letters at least as large as those used to name any other item on the menu; and if there is no such menu, a sign bearing the cut or kind of horseflesh served, in letters large enough to be readily seen by all customers, shall be displayed at the point where customers are served.
f. 
Horseflesh or preparations containing horseflesh, prepared as animal food, must be immediately packed and kept in sealed containers and shall not be kept or stored in or offered for sale from a case or ice box maintained for storage of food kept for human consumption. A separate display case shall be provided for the former, and said containers of horseflesh shall have conspicuously marked thereon "horseflesh prepared as animal food," as well as such other information and identification as may be required by State and Federal laws.
g. 
No person shall erase, cancel, obliterate, deface, cover, remove or alter any brand, tag, label or other marking required by any provision of this code, attached or affixed to any package, container or meat.
h. 
The terms "hamburger" or "ground meat" are defined as chopped beef, ground beef or beef patties, with or without the addition of beef fat as such and/or of seasoning, and such meat shall not contain more than 30% of fat. Hamburger or ground meat, fresh meat loaf, ground veal, ground mutton, ground lamb, ground pork, or any combination thereof, with or without the addition of fat and/or seasoning, shall not contain more than 30% of fat.
i. 
"Sausage" means the product commonly or usually known as pork sausage, breakfast sausage, country-style sausage, farm-style sausage or similar pork products. Sausage shall not contain more than 50% of fat.

No person shall be permitted to operate a business which performs the slaughter of animals for consumption or sale.

The following rules and regulations shall be strictly adhered to in the keeping of fowl for domestic use:
a. 
Rule 1: Fowl shall not be allowed to fly or run at large, but shall be confined in a suitable house or coop with an enclosed runway.
b. 
Rule 2: No part of a coop, house or runway shall be less than 50 feet from any property line with the doors or windows of any building occupied by human beings, whether for dwelling or business purposes, except by written permission from the Division of Health, provided that poultry kept temporarily in markets may be kept under the conditions specified.
c. 
Rule 3: All live poultry kept on the licensed premises shall be confined in metal frame coops, all of which shall be constructed of noncorrosive wire of at least No. 8 gauge of uniform size and have a removable bottom of sheet metal for each tier or section. Said coops shall be cleaned thoroughly each day.
d. 
Rule 4: All coops and stands shall be raised at least eight inches above the floor for sanitary reasons. A plentiful supply of running hot water shall be available and used.
e. 
Rule 5: Poultry yards or coops shall be maintained in such proper sanitary conditions so as to avoid offensive odors and any condition which may be conducive to the harborage of rats, mice, insects or other vermin. Such poultry yards and coops shall be cleaned as often as necessary in order to maintain a proper sanitary condition at all times.
The failure to clean the poultry yards or coops within 24 hours after notice in writing from the Division of Health Inspector of an existing unsanitary condition shall be prima facie evidence of a violation of this rule.

The following rules and regulations shall be strictly adhered to in the keeping of other animals.
a. 
Rule 1: Not more than two chickens or pigeons or a combination of chicken and pigeons may be kept as pets in a dwelling unit. After the age of six weeks the animals shall be removed from the dwelling unit.
b. 
Rule 2: No person shall keep any horses, goats, donkeys, rabbits, sheep, swine, cattle or roosters within the Town limits except as may be allowed by permit issued by the Division of Health under rules and regulations to be hereafter promulgated.
