The Village Board of Trustees recognizes, and hereby determines,
that it is beneficial to the Village to employ Village police officers
that are part of the Village community in their daily lives. The Board
of Trustees finds that having police officers that reside in the Village
or in close proximity helps to preserve and protect the health, safety
and general welfare of the Village residents. Through adoption of
this article, the Village Board hereby makes a legislative determination
that those who are residents of the greater Cazenovia community take
a greater interest in promoting the public safety, health and welfare
of this community than do nonresidents whose families reside in areas
unaffected by Village services. The Village Board further declares
that such a quality is desirable for its employed full time police
officers, and that establishing a residency requirement for its full-time
police officers will help assure the most effective delivery of essential
public services. The Village Board determines that the public need
is sufficient to grant full-time Village police officer employment
and promotion preferences to residents of the Cazenovia School District.
In the event there is a vacancy or promotional opportunity in
a new or existing full-time police officer position, the Village will
give preference to qualified applicants who are residents of the Cazenovia
School District.
In accordance with the Civil Service Law, in the event there
is a vacancy in a new or existing full-time police officer position
and a current eligible list exists, the Village will fill the vacancy
by selection from the eligible list certified by the Madison County
Civil Service Department of persons who have taken the appropriate
civil service examination. In the event the list contains a sufficient
number of qualified applicants who are residents of the Cazenovia
School District, the Village will canvass those residents and select
one of the top three available candidates on the list who are residents
of the Cazenovia School District to fill the position. In the event
the Village determines, in its sole discretion, that there are an
insufficient number of qualified applicants on an eligible list who
are residents of the Cazenovia School District, the Village may fill
the vacancy by selection from all candidates on the list.
This article shall supersede any inconsistent provisions of
the Public Officers Law § 3, the Public Officers Law § 30
and Village Law § 3-300.
If any clause, sentence, paragraph, subdivision, section or
part of this article shall be adjudged by any court of competent jurisdiction
to be invalid, such judgment shall not affect, impair or invalidate
the remainder thereof but shall be confined in its operation to the
clause, sentence, paragraph, subdivision, section or part thereof
directly involved in the controversy in which such judgment is rendered.
This article shall take effect immediately upon filing in the
office of the Secretary of State, or on March 8, 2019, whichever date
is later.

Pursuant to the authority provided in § 3-300(2)(b)
of the New York State Village Law, the Village Justice of the Village
of Cazenovia need not be a resident of the Village of Cazenovia, but
must be a resident of the County of Madison.
