The words and phrases used in this chapter shall, for the purposes
of this chapter, have the meanings respectively ascribed to them by
the Article 1 of the Vehicle and Traffic Law of the State of New York.
The Town Superintendent of Highways, under the direction of
the Town Board of the Town of Fabius, shall install and maintain traffic
control devices when and as required under the provisions of this
chapter to make effective the provisions of this chapter or the Vehicle
and Traffic Law of the State of New York, subject to the provisions
of §§ 1682 and 1684 of the Vehicle and Traffic Law.
A.
The violation of any provision of this chapter shall constitute a
traffic infraction.
B.
Every person convicted of a traffic infraction for a violation of
any provision of this chapter, which is not a violation of any provision
of the Vehicle and Traffic Law of the State of New York, shall, for
a first conviction thereof, be punished by a fine of not more than
$50 or by imprisonment for not more than 15 days, or by both such
fine and imprisonment; for a second such conviction within 18 months
thereafter, such person shall be punished by a fine of not more than
$100 or by imprisonment of not more than 45 days, or both such fine
and imprisonment; upon a third or subsequent conviction within 18
months, such person shall be punished by a fine of not more than $250
or by imprisonment for not more than 90 days, or by both such fine
and imprisonment.
It shall be unlawful for the owner or operator of any vehicle
to park said vehicle on any highway located within the Town of Fabius,
except those highways located within any villages and state highways
maintained by the state, between the hours of 1:00 a.m. and 8:00 a.m.
from the 1st day of December of each year and the 1st day of April
of the following year.
It shall be unlawful for the owner or operator of any vehicle
to park said vehicle at any time on any sidewalk which is owned or
maintained by the Town of Fabius.

B.
Penalties. Any parking violations shall be the responsibility of
the registered owner or driver of the vehicle on the date of the violation.
