The International Property Maintenance Code, 2015 Edition, published in January 2015 by the International Code Council, is hereby adopted in its entirety. It is adopted and made a part of Chapter 5 of the Code of Ordinances of the Township of Kingston (Code Enforcement).

The International Property Maintenance Code, 2015 Edition, is specifically incorporated herein and adopted by reference in this Part 5 as to the provisions and terms more particularly set forth in that certain document, three copies of which are on file in the Administration Office of Kingston Township, being marked and designated as the International Property Maintenance Code, 2015 Edition, as published in January 2015 by the International Code Council, and is hereby adopted as the Property Maintenance Code of Kingston Township for regulating and governing the conditions and maintenance of all property, buildings and structures; providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said International Property Maintenance Code on file in the office of Kingston Township are hereby referred to, adopted and made a part hereof by specific Incorporation, as if fully set out in this Part, with the additions, insertions, deletions and changes, if any, as more particularly stated herein.

The following sections of the International Property Maintenance Code, 2015 Edition, are added as a part of this Part 5, as follows:

Section 101.1. Insert "Township of Kingston."
B. 
Section 103.5. Insert "Township of Kingston Fee Schedule."

Section 304.14. Insert "June 1 — September 30."
D. 
Section 602.3. Insert "September 1 — May 31."
E. 
Section 602.4. Insert "September 1 — May 31."
F. 
Section 304.3, Premises Identification. The following "Premises Identification" provisions are added to and made a part of Section 304.3 of the International Property Maintenance Code, as adopted heretofore by the Township of Kingston, and the same shall follow the last sentence of the present Section 304.3 thereof, as follows:
(1) 
All address numbers for buildings located a distance greater than 60 feet from the road right-of-way shall be installed on a post.
(2) 
The post shall not be located more than 10 feet from the driveway servicing the building and more than 10 feet from the road right-of-way. The post may be located on either side of the driveway. The number shall be a minimum of four inches high. Height of the number sign shall not be less than three feet nor more than four feet above the ground. The numbers shall be installed on both sides of the post and shall be perpendicular to the road, and shall not be concealed from view from the road by trees, shrubs, bushes or like vegetation or any other obstruction of whatever nature.
(3) 
Reflective numbers must be affixed to all posts, so that the same can be seen clearly from the road right-of-way during the hours of darkness.
(4) 
The owner of the land on which a number sign is located shall be responsible for the installation and maintenance of the sign as specified herein.

The following amendments of Section 106 (violations) of the 2015 Edition of the International Property Maintenance Code are hereby adopted and enacted as an integral part of this Part:
A. 
Section 106.3 Prosecution of Violation. Any person failing to comply with a notice of violation or order served in accordance with Section 107 shall be subject to a criminal action brought by the Township of Kingston before a District Justice under the provisions of the Pennsylvania Rules of Criminal Procedure for the enforcement of a summary offense. Further, if the notice of violation or order is not complied with, the Township of Kingston shall institute appropriate proceedings at law or in equity to restrain, correct or abate such violation, or to require the renewal or termination of the unlawful occupancy or condition of the building or structure in violation of the provisions of the Code, or of the Order or direction made pursuant thereto. Any action taken by the Township of Kingston having jurisdiction over such structure, building or premises shall be charged against the real estate upon which the structure is located and shall be a lien upon such real estate.
B. 
Section 106.4 Violation penalties. Any person or entity who shall violate a provision of this code or fall to comply therewith or with any of the requirements thereof shall be prosecuted for the commission of a summary offense in the manner more particularly provided in Section 106.3 hereof. The District Justice may levy criminal fines not to exceed $1,000 per violation upon the conviction of the person or entity of the summary offense so charged. Each day that a violation continues, after due notice has been served, shall be deemed a separate offense.

The section of the International Property Maintenance Code, 2015 Edition, designated as "Appendix A: Boarding Standard," and all of its sections, are adopted entirely herein.

The provisions of the Township of Kingston Code of Ordinances, so far as they are the same as those ordinances and regulations in force immediately prior to the adoption of this Part, are intended as a continuation of such ordinances and regulations and not as a new enactment. The provisions of this Part shall not affect any suit or prosecution pending or to be instituted to enforce any of the prior ordinances and regulations except as otherwise provided by law.

It is hereby declared to be the intention of the Board of Supervisors of the Township of Kingston that the chapters, parts, sections, paragraphs, sentences, clauses and phrases of this Part are severable. If any section, paragraph, sentence, clause or phrase of this Part is declared unconstitutional, illegal or otherwise invalid by the judgment or decree of a court of competent jurisdiction, that invalidity shall not affect any of the remaining chapters, parts, sections, paragraphs, sentences, clauses or phrases of this codification.
