A.
There shall be, within the Borough of Chambersburg, certain locations, herein established as municipal off-street parking lots, such lots not having parking meters, not within the public right-of-way, but municipal property, established for the temporary storage of motor vehicles, under rules herein established, without parking meters, in the following locations:

Said parking lots may also be equipped with parking meters in some spaces pursuant to Article VI.
C.
In such lots and in such parking spaces without parking meters, the Borough of Chambersburg may, from time to time, establish a parking permit system, for the use of unmetered parking lots in exchange for a usage fee, to be established by Borough Council, from time to time. Parking permits sold for municipal parking lots shall be valid and in effect between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, provided that the requirements of this article as to parking permits shall not apply on legal holidays as defined in this chapter as well as Saturdays and Sundays. These parking permits shall be established as such:
(1)
The permits shall be of the types and form determined by the Borough Treasurer and shall be displayed by hanging from the rearview mirror. If mirror design prohibits the hanging of the permit, the permit shall be displayed on the left side of the dashboard of the motor vehicle authorized to use the same so that the permit is clearly visible through the windshield.

Violations.

(a)
It shall be a violation of this section for any person to use or display a permit, or to make available or permit its use or display in or on a vehicle not authorized or entitled hereunder for use, or by an operator not authorized to use such permit, or to display, the same.
(b)
It shall be a violation of this section for any operator to use a parking space without displaying a valid Borough-issued permit for the specific parking space and/or the specific parking lot in question. Failure to pay a renewal fee for a permit invalidates its use.
(3)
Types of permits.
(a)
Permits assigned to vehicle; spots are on a first-come-first-served basis: In some parking lots, at the discretion of the Borough Manager, the system shall be that permits are issued to vehicle(s) for their use for a set period of time. In such vehicle-specific permit parking lots, a group of parking spaces shall be designated for those vehicle permits on a first-come-first-served basis between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, provided that the requirements of this article as to parking permits shall not apply on legal holidays as defined in this chapter as well as Saturdays and Sundays.
(b)
Permits assigned to specific parking spot: In some parking lots, at the discretion of the Borough Manager, the system shall be that permits are parking space specific. In such circumstances, in all parking lots, other than the Rosedale Parking Lot, such designated spaces shall be available for specific permits between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, provided that the requirements of this article as to parking permits shall not apply on legal holidays as defined in this chapter as well as Saturdays and Sundays. However, in the Rosedale Parking Lot, the Borough Manager is authorized herein to direct the issuance of a limited number of 24/7/365 space-specific parking permits, for an additional fee, to be set by Council, from time to time.
(4)
Application for permits. The application for a parking permit shall contain at least the following information:
(a)
The name, address, and telephone number of the applicant for which a permit is sought and, if the person is not a Borough resident, their business name, address, and telephone number;
(b)
A current valid driver's license number of the person in possession of the permit as taken from that person's current driver's license;
(c)
In those cases where parking permits are vehicle specific, the applicant shall provide owner's information about the permitted vehicle, the name of the owner, the owner's address and phone number, and a copy of the vehicle registration and/or license plate number.
(5)
The Borough Treasurer shall establish the type and form of application for permits.
(6)
The Borough Treasurer may require satisfactory proof of all information set forth on any application and any other information deemed necessary by the Borough Treasurer.
(7)
Permits may be sold on a monthly, quarterly, semiannual, or annual basis.
(8)
In some cases, the permit may provide the reservation of particular parking spaces. In other cases, said permit may provide access to the next available space in a group of spaces so designated for this purpose. The Borough Manager is herein authorized to designate which spaces shall be associated with which system.
(9)
Upon receipt of the application and permit fee and determination that the information upon the application indicates that the applicant is entitled to the requested permit, the Borough Treasurer shall issue the same, which shall be valid until the last day of the period for which the permit was sold. The permit shall be renewable at any time prior to its expiration date for a period beginning on the day following its expiration date, so long as the Borough Treasurer is satisfied that there have been no changes in the information set forth on the application.
(10)
It shall be a violation of this section for any person to submit incorrect information on an application for a permit or in seeking a renewal thereof.
(11)
Change of license or address. If a person to whom a parking permit is currently issued for their home or work address for which that permit has been issued, such person shall update their information to the Borough Treasurer. If such person renews or replaces their driver's license during the then-current period of such permit, the Borough Treasurer shall, on application therefor, update said permit information accordingly.
(12)
Disposal of motor vehicle. If a person to whom a vehicle-specific parking permit is currently issued sells or otherwise disposes of the motor vehicle for which that permit has been issued, such person shall remove the decal permit and return it to the Borough Treasurer. If such person replaces that vehicle with another during the then-current period of such permit, the Borough Treasurer shall, on application therefor, issue a replacement permit of the same type for that motor vehicle for the balance of the period without another application fee being paid.
(13)
Forfeiture of permit. In addition to the other penalties provided in this chapter, the Borough Treasurer may declare a parking permit to be forfeited for any violation of this section by the holder thereof and require the permit to be delivered to the Finance Department.
D.
No vehicle over 21 feet in length may park in any municipal parking lot. No vehicle registered as a mobile home or camper may park in any municipal parking lot. No trailer or hitch may be parked in any municipal parking lot unless it is connected to a motor vehicle and the sum of the length of the motor vehicle and trailer or hitch is 21 feet or less. No unregistered or uninsured vehicle may be parked in a municipal parking lot. No vehicle creating or being a nuisance in fact may be parked in a municipal parking lot.
E.
Southgate parking lot and the common areas of the Southgate redevelopment project: The Borough Manager is herein authorized to establish policies for access and parking upon the municipal property associated with the Southgate redevelopment project.
