A. 
There shall be, within the Borough of Chambersburg, certain locations, herein established as municipal off-street parking lots, such lots having parking meters, not within the public right-of-way, but municipal property, established for the temporary storage of motor vehicles, under rules herein established, with parking meters, in the following locations:

B. 
Said parking lots may also be equipped with parking spaces without parking meters pursuant to Article V.
A. 
Each parking meter in said lots shall be in operation and the provisions of this chapter regulating such operation and establishing parking time limits shall be in force between 8:00 a.m. and 5:00 p.m., Monday through Friday (not applicable to Saturdays, Sundays, and legal holidays). Upon the deposit of such coin or coins and placing the meter in operation, such parking space may be lawfully occupied upon payment of a fee, which may be set from time to time by resolution of Town Council.
B. 
Rosedale and Spring Street Lot. The multispace parking meter kiosk system in use in the Rosedale and Spring Street Parking Lot shall be in operation and the provisions of this chapter regulating such operation and establishing parking time limits shall be in force between 8:00 a.m. and 5:00 p.m., Mondays through Fridays (not applicable to Saturdays, Sundays, and legal holidays). Upon the deposit of such coin or coins and placing the meter in operation, such parking space may be lawfully occupied upon payment of a fee, which may be set from time to time by resolution of Town Council.
C. 
Parking at parking meters shall require no deposit of coins other than between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, provided that the requirements of this article as to metered parking shall not apply on legal holidays as defined in this chapter as well as Saturdays and Sundays.
D. 
Users may redeposit coins into a parking meter in order to extend the period of eligibility to park in such spaces during those periods when the deposit of coins is required (hereinafter known as "feed the meter").
A. 
Parking meters installed on said lots shall be placed immediately adjacent to the individual parking spaces, unless meters are multispace parking meter kiosks, and said meters shall be designated by an identification sign. Each parking meter shall be placed or set in such manner as to show the parking space adjacent to such meter is or is not legally occupied, except in such cases as a multispace parking meter kiosk system. Each parking meter installed shall indicate by a proper legend the legal time established by this article and, when occupied, shall indicate on and by its dial and pointer or digital display the duration of the period of legal parking and, on the expiration of such period, shall indicate illegal or overtime parking.
B. 
All vehicles parked in a municipal parking lot, hereinabove referred to, shall be parked wholly within the lines bounding or marking an individual parking space, hereinafter known as a "stall"; and it shall be unlawful to park any vehicle elsewhere than in such a stall. It is a violation of this article to park in prohibited areas, including but not limited to access and exit driveways and turning areas.
C. 
No vehicle over 21 feet in length may park in any municipal parking lot. No vehicle registered as a mobile home or camper may park in any municipal parking lot. No trailer or hitch may be parked in any municipal parking lot unless it is connected to a motor vehicle and the sum of the length of the motor vehicle and trailer or hitch is 21 feet or less. No unregistered or uninsured vehicle may be parked in a municipal parking lot. No vehicle creating or being a nuisance in fact may be parked in a municipal parking lot.
A. 
The Borough of Chambersburg operates the following type of multispace parking meter system: The multispace parking meter system displays the date, time and amount of time remaining or length of time expired (up to 72 hours) on an attached computer screen. The user identifies the number of the parking space the vehicle operator intends to use (park in), presses the corresponding number on the machine keypad, and places coin in the machine until the vehicle operator has achieved the desired time. Expiration time for each space is stored in the master meter computer and displayed, on demand, on the machine screen for all spaces governed by that machine.
B. 
Whenever a multispace parking meter system is in use, the operator of any vehicle, upon entering a parking space during the time of limited parking, shall immediately deposit the proper coin in the multispace parking meter governing the parking space, dependent upon the length of time the vehicle operator desires to park such vehicle. Failure to deposit legal tender shall be a violation of this article and shall be subject to a fine in accordance with § 286-68, Violations and penalties.
C. 
The multispace parking meter system shall be used in the following places:
Rosedale and Spring Street Lot, defined as "the lot bounded on the east by North Main Street, on the south by Lincoln Way West and on the north and the west by Spring Street."
Whenever a vehicle is to be parked in any of said parking lots at any time during which the parking meters therein shall be in operation, the operator of such vehicle shall, upon entering a parking space adjacent to a parking meter, immediately deposit, or cause to be deposited, in such parking meter, one or more coins of the United States, as so designated by the Borough Treasurer, as shall be specified in the legend upon such parking meter. Upon the deposit of such coin or coins and placing the meter in operation, such parking space may be lawfully occupied by such vehicle for the length of time designated by § 286-60 of this article for parking in said parking lot upon deposit of such coin or coins. If any vehicle shall remain in any such parking space for such length of time that the meter shall indicate by a proper signal that the lawful parking time shall have expired, such vehicle shall be considered as having been parked overtime, and the parking of a vehicle overtime shall be a violation of this article, provided that every hour that a vehicle shall remain parked at a meter showing a violation shall constitute a separate violation of this article.
It shall be unlawful, and a violation of this article, for any person to deface, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this article, provided that nothing herein shall apply to the servicing or opening of parking meters by officers, employees and/or parking enforcement officers of the Borough under the direction of the Mayor and/or the Borough Council.
Overnight parking shall be permitted in a municipal parking lot, without coin deposit in meter, listed in § 286-52, provided that the Borough Manager, or his designee, may, from time to time, ban overnight parking in those lots, or in such parts of those lots, which may be closed off for the purposes of cleaning, snow removal, special events, or similar purposes. In such cases, it shall be unlawful to remove, relocate, or ignore officials' barricades established for such temporary closure of these parking lots.
The Borough of Chambersburg may establish the position of parking enforcement officer, a local code enforcement official, for the sole purpose of the enforcement of laws associated with parking.
A. 
It shall be the duty of the parking enforcement officers of the Borough to report:
(1) 
The number of each parking meter that indicates that the vehicle occupying the parking space adjacent thereto is or has been parking in violation of any of the provisions of this article;
(2) 
The hour and date of such violation;
(3) 
The state license number of such vehicle; and
(4) 
Any other facts, the knowledge of which shall be necessary for an understanding of the circumstances attending such violation.
B. 
Any such police officer, or parking enforcement officer, who shall undertake enforcement of these provisions, shall also place upon such vehicle a ticket to the owner or operator thereof that such vehicle was parked in violation of the provisions of this article; and, further, said notice shall instruct such owner or operator that if they shall report to the office of the Chief of Police, or his designee, and pay, for the collection by the Borough, the fine indicated below, or if they shall place the fine indicated below enclosed within the envelope provided in the night deposit box installed at Borough Hall, within such time limits as herein established, the same shall save such violator from prosecution and from further payment of the fines and costs hereinafter provided in § 286-68 of this article.
A. 
Penalties for violation of Article VI.
(1) 
Tickets may be left on the windshield of the vehicle in the form established by the Borough or delivered by regular mail to the owner of such vehicle in violation. Failure to receive a ticket after being conspicuously posted is no excuse for invalidation of penalty. Operators who fail to accept a parking ticket by leaving the scene before the issuer has an opportunity to conspicuously post said ticket will receive the ticket by United States first-class mail.
(2) 
Ticket amounts are due upon their issuance and may be paid, in person, at the Borough office during regular business hours.
(3) 
Any person and/or entity violating any provision of Article VI shall, upon conviction thereof, be guilty of a summary offense and sentenced to pay a fine of not more than $50 plus court costs and reasonable attorney fees and, in the event of default of payment, such violator may be sentenced to imprisonment for a period not to exceed five days. Each day and/or each violation by the same person and/or entity shall be considered a new and separate violation of the Code of the Borough of Chambersburg.
(4) 
Penalties for violation of metered parking stalls for handicapped persons' or disabled veteran's provisions.
(a) 
Any person and/or entity violating any provisions and/or rules for metered parking stalls for handicapped persons or disabled veterans shall, upon conviction thereof, be guilty of a summary offense and sentenced to pay a fine of not more than $200 plus court costs and reasonable attorney fees, and, in the event of default of payment, such violator may be sentenced to imprisonment for a period not to exceed five days. Each day and/or each violation by the same person and/or entity shall be considered a new and separate violation of the Code of the Borough of Chambersburg.
(b) 
Borough police officers and parking enforcement officers as defined herein are hereby duly authorized to issue a ticket in the form established by the Borough to any person and/or entity violating any provisions and/or rules for metered parking stalls for handicapped persons or disabled veterans. The ticket shall instruct such violator that if the violator reports to the Borough office and pays the Borough the sum of $50 within six days of the date of issuance of the ticket, then such payment shall save the violator through prosecution by a citation, which prosecution may result in court costs and attorney fees being assessed against the violator in addition to the fine.
(c) 
Notwithstanding the above, any police officer or parking enforcement officer shall have the sole and absolute discretion to issue a citation without first issuing a ticket as provided for herein.
(5) 
Penalties for violation of Article VI; exceptions.
(a) 
Any person and/or entity violating any of the provisions of this Article VI, Metered Off-Street Parking, except § 286-64 and/or as set forth in Subsections C and D above, shall, upon conviction thereof, be guilty of a summary offense and sentenced to pay a fine of not more than $40 plus court costs and reasonable attorney fees and, in the event of default of payment, such violator may be sentenced to imprisonment for a period not to exceed five days. Each day and/or each violation by the same person and/or entity shall be considered a new and separate violation of the Code of the Borough of Chambersburg.
(b) 
Borough police officers and/or parking enforcement officers as defined herein are duly authorized to issue a ticket in the form established by the Borough to any person and/or entity violating any provisions of this Article VI, Metered Off-Street Parking, except § 286-64 and/or as set forth in Subsections C and D above. The ticket shall instruct such violator that if the violator reports to the Borough office and pays the Borough the sum of $5 within 72 hours of the date of issuance of the ticket, then such payment shall save the violator through prosecution by a citation, which prosecution may result in court costs and attorney fees being assessed against the violator in addition to the fine.
(c) 
The ticket set forth in this subsection shall also instruct such violator that if the violator reports to the Borough office and pays the Borough the sum of $20 after 72 hours but within not more than six days of the date of issuance of the ticket, then such payment shall save the violator through prosecution by a citation, which prosecution may result in court costs and attorney fees being assessed against the violator in addition to the fine.
(d) 
Notwithstanding the above, any police officer or parking enforcement officer shall have the sole and absolute discretion to issue a citation without first issuing a ticket as provided for herein.
The Borough Manager, or his designee, is hereby authorized to suspend, in whole or in part, the parking meter regulations set forth in this article, during such days or such hours as may be deemed necessary by the Borough Manager or his designee.
The following restrictions shall apply for the parking meters enumerated in this section:
A. 
In the East Point Parking Lot, the first two-hour metered parking space in the southeast corner shall be designated as authorized for parking of a handicapped person's or disabled veteran's vehicle only. Such vehicles shall bear a special handicapped registration plate or display a placard issued by the commonwealth, or any other state, evidencing a handicapped person's or disabled veteran's vehicle.
B. 
In the Rosedale and Sprint Street Parking Lot, the first two perpendicular parking spaces inside the lot entrance off North Main Street and the last perpendicular parking space at the westernmost end of the lot closest to Spring Street shall be designated as authorized for parking of a handicapped persons' or disabled veteran's vehicle only. Such vehicles must bear a special handicapped registration plate or display a placard issued by the commonwealth, or any other state, evidencing a handicapped persons' or disabled veteran's vehicle.
