Under the authority granted in Municipal Home Rule Law, § 10(1)(ii)(d)(3),
Town Law §§ 267(2) and 271 are amended in their application
to the Town of Marcellus to provide for alternate members as set forth
in the following sections.
In the event that either the Planning Board or Zoning Board
of Appeals lacks a quorum at any duly called meeting, alternate members
may be appointed by the chairperson or acting chairperson.
A. Alternate
members for the Planning Board shall be appointed from the members
of the Zoning Board of Appeals in attendance with the most senior
members of the Zoning Board of Appeals having the right to act as
alternate members of the Planning Board at such meeting. Each alternate
member shall have one vote.
B. Alternate
members for the Zoning Board of Appeals shall be appointed from the
members of the Planning Board in attendance with the most senior members
of the Planning Board having the right to act as alternate members
of the Planning Board at such meeting. Each alternate member shall
have one vote.
A maximum of two alternate members may be appointed to either
the Planning Board or Zoning Board of Appeals at any meeting.

All provisions of state law relating to Planning Board or Zoning
Board of Appeals member training and continuing education, attendance,
conflicts of interest, compensation, eligibility, vacancy in office,
removal, and service on other boards, shall also apply to alternate
members.
