A.
As used in this section, the term "public parks" shall include Airport Park, Bloomington High School Tennis Courts, Buck-Mann Park, Evergreen Park, Ewing Parks I, II and III, Fell Avenue Park, Forest Park, Franklin Park, Withers Park, Highland Park, Holiday Park, Miller Park, Oakland School Park, O'Neil Park, Rollingbrook Park, Stevenson School Park, Suburban East Park, Sunnyside Park, Constitution Trail, Northpoint Park, Buckeye Park, Angler's Lake Nature Preserve, Clearwater Park, Eagle Crest Park, Tipton Park, McGraw Park, Bittner Park, Atwood Wayside, Lincoln Park, Dawes Place, Friendship Park, Alton Depot, the Den at Fox Creek Golf Course, Lincoln Leisure Center, P.J. Ervin Park, Pepper Ridge Park, Prairie Vista Golf Course, Sale Barn Soccer Fields, Cedar Ridge Park, Emerson Park, Lincoln Oak Memorial Park, Marie Litta Park, R.T. Dunn Fields, Brookridge Park, Gaelic Park, Eagle View Park, The Grove Park and Hershey Road Community Gardens.

B.
Constitution Trail shall be closed between one hour after sunset and one hour before sunrise. Friendship Park shall be closed between the hours of 9:00 p.m. and 6:00 a.m. All other public parks in the City of Bloomington shall be closed between the hours of 10:00 p.m. and 6:00 a.m. Except as provided in Subsection C, no person shall enter or remain upon the premises of a public park in the City of Bloomington during hours said park is closed.

C.
This section shall not apply to:
(1)
Employees or agents of the City of Bloomington or any peace officer when acting in the course of their duties; or
(2)
Participants in or service workers connected with activities and events conducted or sponsored by the City of Bloomington Parks and Recreation Department or for which the Department has issued a permit for use of the Miller Park Pavilion, or persons taking participants to or from the parks but only for such time as is necessary for such activities; or

(3)
The holder of any franchise of the City of Bloomington for sale of food in such parks and his employees when acting in the course of their duties; or
(4)
Participants in activities conducted in facilities owned by the Centrillio Council of the Girl Scouts of America.
