In addition to any other manner authorized by law or by ordinance, sidewalk improvements abutting other than commercial or industrial properties may be made by special assessment of abutting properties as provided in this article. For purposes of this article, the term "sidewalk improvements" includes new construction, reconstruction and repair of sidewalks.
A. 
A special assessment is hereby made of all other than commercial or industrial properties abutting sidewalk improvements made pursuant to this article. Except as provided in Subsection B of this section, said assessment shall be in the amount of 50% of the cost of the improvement. The remaining 50% of the cost of said improvement shall be paid by the City of Bloomington as provided for herein.

B. 
The City Manager may in his discretion waive the assessment when all of the following conditions are met:
(1) 
Repair of the sidewalk is necessitated by the growth of one or more trees has caused or will aggravate the deteriorated condition of the sidewalk;
(2) 
The deteriorated condition of the sidewalk poses a hazard to pedestrians using the sidewalk; and
(3) 
Failure to waive the assessment would cause serious financial hardship to the abutting property owner.

A. 
Appropriations. Sidewalk improvements authorized to be made by this article are limited to those for which appropriations are made in each fiscal year. This article shall not be construed to require any appropriations.

B. 
Nature of benefited property. Property eligible to be assessed pursuant to this article is limited to property used principally for other than commercial or industrial purposes, and shall not include property being developed under Bloomington City Code Chapter 24 or Bloomington City Code Chapter 44, § 44-204.

Owners of properties for which sidewalk improvements are desired to be made may request such improvements by making application therefor with the Public Works Department. The application shall be on forms used by the Department and, except as provided in § 38-1002B above, shall be accompanied by a check for 50% of the estimated cost of the sidewalk improvement abutting the property to be benefited thereby. Applications shall be taken and processed in chronological order.
A. 
Sidewalk improvements made pursuant to this article shall be made by persons selected by the City of Bloomington. Improvements made in any fiscal year shall not exceed the lesser of:
(1) 
Improvements requested; or
(2) 
Appropriations for such fiscal year.
B. 
Application made for sidewalk improvements under this article for which appropriations have not been made shall be carried over into the next fiscal year and receive chronological priority at that time.
