The Town of St. Joseph, St. Croix County, adopts the following all-terrain vehicle (ATV) and utility terrain vehicle (UTV) ordinance for the operation of ATVs and UTVs upon the roadways listed in § 183-18. This article is adopted with the intent of promoting recreation within the Town, weighing consideration of the recreational value of connecting all-terrain vehicle trails against possible dangers to the public.
The definitions of "all-terrain vehicle" and "utility terrain vehicle" in this article are those found in Wisconsin Statutes § 23.33, "All-terrain vehicles and utility terrain vehicles." The term "ATV/UTV" refers to a vehicle which is either an all-terrain vehicle or utility terrain vehicle.
This article is adopted pursuant to Town authority under Wis. Stats. § 23.33, and the applicable provisions of Wis. Stats., § 23.33, regulating ATV/UTV operation are adopted and incorporated.
All Town of St. Joseph roads are designated as all-terrain vehicle routes. State and county roads are excluded as not within the jurisdiction of the Town of St. Joseph.
All-terrain vehicle route signs must conform to Wisconsin Administrative Code § NR 64.12 and must meet reflectivity requirements applicable to traffic signs in the Town.
A. 
Speed limits: 35 miles per hour, or as otherwise posted for automobile traffic, whichever is lower.
B. 
ATV/UTV operators shall ride single-file on the right side of the road in the direction of traffic unless making a left-hand turn.
C. 
ATV/UTV operators shall slow the vehicle to 10 miles per hour or less when operating within 100 feet of a pedestrian.
D. 
No person may operate an ATV/UTV on a roadway or all-terrain vehicle route unless they are in compliance with DNR guidelines and Wisconsin statutes.
If any section, clause, provision or portion of this article is adjudged unconstitutional or invalid, the remainder of this article shall not be affected thereby.
