As used in this chapter, the following terms shall have the meanings indicated:
APPLICANT
A person or entity applying for a permit to hold a rodeo event.
ARENA
A space for public events or contests.
CIRCUS
Entertainment involving large animals and clowns, typically hosted in a large tent.
CULTURAL USES
An auditorium, library, museum; an ethnic celebration, such as a feast or festival.
FESTIVAL
A musical or other seasonal celebration.
RODEO EVENT
Exhibition of skill in steer wrestling, bronco riding and similar events evolving from the practice of gathering cattle to be branded.
No person shall conduct a rodeo event or similar public exhibition within the Township of Hopewell without first obtaining a permit and paying the permit fee therefor.
No person owning, occupying or having possession or control of any lot of land in the Township of Hopewell shall suffer or permit the same to be used for the purpose of holding any rodeo event or similar public exhibition unless a permit therefor has first been obtained pursuant to this chapter.
A written application for a permit, as required by this chapter, shall be made to the Township Clerk, which application shall contain the following information:
A. 
Name and address of applicant.
B. 
The date or dates and hours during which the rodeo event will be held or conducted.
C. 
A description of the planned rodeo event.
D. 
The location of the land upon which the rodeo event is to be held or conducted.
E. 
Names and addresses of all concessionaires, if any.
F. 
A location and site plan, which may be an applicant-prepared sketch, but which must include the following:
(1) 
Dimensions of the site including length, width and total size;
(2) 
Location of the lot or parcel including North arrow and date of preparation;
(3) 
Distance to property lines of the precise location on the property of the proposed rodeo event;
(4) 
Lot and block numbers;
(5) 
Names and route numbers of existing public or private streets, alleys or rights-of-way to be utilized in conjunction with the rodeo event;
(6) 
Location, type and width of all access points including driveways, curb openings and crossovers;
(7) 
Location of buildings and any other structures, existing or proposed for the site, with distances between buildings and structures shown;
(8) 
Location of proposed sanitation, trash receptacles, concessions, fencing, admission booth, medical station, restrooms, and similar facilities;
(9) 
Location of any screening now in place or to be put in place; and
(10) 
Any additional information reasonably requested by the Township.
G. 
Sanitation plan. A plan for adequate sanitation facilities and garbage, trash, restrooms, and sewage disposal for persons at the rodeo.
H. 
Sustenance plan. A plan for providing food and water for those attending the rodeo.
I. 
Medical facilities. A plan for adequate medical facilities for persons attending the rodeo.
J. 
Parking, crowd, and traffic control. A plan for adequate parking facilities and traffic control in and around the festival area.
K. 
A fire protection plan.
L. 
Lighting plan. If any outdoor lights or lighting is to be utilized, a plan shall be submitted showing the location of such lights and shielding devices or other equipment to prevent unreasonable glow beyond the property on which the rodeo is located.
M. 
A list of rodeo events promoted by applicant within the last five years including each location where held and the name of a contact person familiar with each prior rodeo event.
No music shall be played, nor sound amplification utilized, which is audible beyond the boundaries of the property on which the rodeo is held. The Township Committee shall have the authority to deny an application for a permit based upon noise complaints generated from a previous rodeo event held by the applicant, or previously held at the same proposed location by a different applicant.
If a permit for the rodeo is approved, a certificate of liability insurance shall be provided to the Township of Hopewell in the amount of not less than $5,000,000. The permit shall not be provided to the applicant until a copy of the certificate of liability insurance is provided to the Township. The policy shall provide for medical payments coverage, and it shall be effective on the date of the rodeo or events.
The applicant shall, upon the issuance of the rodeo permit by the Township, execute an agreement to indemnify and hold Hopewell Township, its officers and employees harmless from any claim of any nature arising from or related to the rodeo event.
The Township Clerk shall cause to be made an investigation of such application to determine the business responsibilities and background of the applicant, applicant's employees and concessionaires, if any, to determine the ability of the applicant to properly conduct the permitted rodeo in a safe manner with due regard for protection of the public. The investigation shall also determine whether applicant's plans for sanitation, restrooms, sustenance, medical facilities, parking, crowd control, traffic control, fire protection, sound amplification and lighting are such that the activity can be permitted without undue interference of vehicular or pedestrian traffic and without endangering public health or safety.
A. 
The report of the investigation required under this chapter shall be forthwith made to the Township Committee which shall thereafter conduct a hearing on the application.
B. 
Applicant shall give notice of the hearing by personal service, or certified mail, to owners of all property located within 200 feet of the proposed rodeo event location. Notice shall also be published in the newspaper of record. All notices must be completed not less than 10 full days prior to the date of any such hearing.
A. 
All taxes on the premises from which the rodeo event is to be operated must be paid current at the time of the application.
B. 
There shall be no alcohol consumption on the property during the rodeo event.
C. 
There shall be no sales of alcoholic beverages at the property during the rodeo event.
D. 
Applicant shall post a bond in an amount to be set by the Township Committee to insure removal of all trash, bleachers and associated components of the site within seven days of the conclusion of the event.
E. 
There shall be no off-site parking. All parking must be planned for and contained within the property owned by, or under lease to, applicant.
The fee for any permit issued under this chapter shall be $200 for each day that the activity is to be conducted.
Any permit issued hereunder may be revoked by the Township Committee after reasonable notice and hearing for any fraud, misrepresentation or dishonesty in the application or in the conduct of the permitted activity or for violation of any of the provisions of this chapter or for the conduct by the applicant or applicant's agents, employees and concessionaires in an unlawful manner or in any manner that constitutes a breach of the peace or a menace to public health, safety or general welfare.
Any person violating any provision hereof shall, upon conviction, be subject to a penalty of either imprisonment for not more than 90 days or a fine not exceeding $500, or both, in the discretion of the court. Each and every day any violation continues shall be considered a separate offense, punishable by like fine or penalty.
If any term or provision of this chapter shall, to any extent, be deemed invalid or unenforceable, the remainder of this chapter shall not be affected thereby and shall be valid and enforced to the fullest extent permitted by law.
