Each Marijuana Facility shall be operated from a permanent location. No Marijuana Facility described in this Chapter shall be permitted to deliver or operate from a movable, mobile or transitory location. No Marijuana Facility shall dispense or sell Marijuana via a drive-through window or lane.

A. 
A Marijuana Facility may be located in any of the following zoning districts subject to compliance with Chapter 400 of this Code:
1. 
"I-2" Heavy Industrial District;
2. 
"I-1" Light Industrial District; and
3. 
"C-3" Highway Business District.
B. 
No Marijuana Facility shall be located at the following locations:
1. 
Within one thousand (1,000) feet of a daycare as defined in Article XIV of the Missouri Constitution;
2. 
Within one thousand (1,000) feet of any educational institution or school, as defined in Article XIV of the Missouri Constitution, or college or university, either public or private;
3. 
Within one thousand (1,000) feet of any church as defined in Article XIV of the Missouri Constitution;
4. 
Within one thousand (1,000) feet of any public park or public pool;
5. 
Within one thousand (1,000) feet of any halfway house or correctional facility;
6. 
Within one thousand (1,000) feet of any other Marijuana Facility; or
7. 
Within any building or structure that contains a residential unit.
C. 
No Marijuana Facility shall be located more than one thousand (1,000) feet from the centerlines of Interstate 70 or Interstate 370.
D. 
The distances described in Subsection (B) and (C) of this Section shall be computed as follows: unless otherwise specified below, by direct measurement from the nearest property line of the land used for the above purposes to the nearest portion of the building housing the Marijuana Facility, using a straight line. In the case of computing the distance between a Marijuana Facility and a school, daycare or church, the distance shall be measured in accordance with Article XIV of the Missouri Constitution.
E. 
It shall be unlawful for any person to distribute, transmit, give, dispense or otherwise provide Marijuana as a home occupation.
F. 
No Marijuana Facility or the activities within the Marijuana Facility shall emit an odor or in any way cause a nuisance as set forth in this Code.

All exterior signage for a Marijuana Facility shall comply with the requirements of the City sign code, Chapter 400, Article XVI, Sections 400.1370 through 400.1860, as amended.

There shall be posted in a conspicuous location in each Marijuana Facility a legible sign containing the following warnings:
A. 
A warning that the use of Marijuana may impair a person's ability to drive a motor vehicle or operate machinery, and that it is illegal under State law to drive a motor vehicle while under the influence of or impaired by Marijuana;
B. 
A warning that loitering in or around a Marijuana Facility is prohibited; and
C. 
A warning that no one under eighteen (18) years of age is permitted within the Marijuana Facility unless the person is a Qualifying Patient who is under the age of eighteen (18) years who has been emancipated by a court order and a Qualifying Patient under the age of eighteen (18) years when accompanied by the Qualifying Patient's parent or guardian.
