No person shall drive a motor vehicle, motorcycle, wagon, conveyance,
or apparatus, motorized or otherwise, of any kind, upon private property
within the Village of Dering Harbor other than the owner or a tenant
nor while driving the same, enter upon, cross or make any use whatever
of such property without the express permission of the owner or owners,
or the duly authorized agent or representative of the owner or owners.
For the purpose of this chapter, the term "private property"
shall be construed to include waterfront lands below the ordinary
high-water mark.
This chapter shall not be applicable to a peace or public officer
actually engaged in discharging duties in connection with his office.

Any person whose conduct violates the vehicular trespass prohibited by §
197-1 of this chapter is guilty of an offense and, upon conviction thereof, may be fined not more than $250 or imprisoned for not more than 15 days, or sentenced to both such fine and imprisonment. Each separate violation shall constitute a separate offense.
This chapter shall take effect immediately.
