There shall be a Department of Finance, the head of which shall
be the Director of Finance, known as the Chief Financial Officer,
who shall be appointed pursuant to requirements as set forth in N.J.S.A.
40A:9-140.10, by the Manager and shall be qualified by training and
experience in Township budgeting, accounting and finance. The Chief
Financial Officer of the Township shall hold a term of four (4) years
from the first day in January in which the Chief Financial Officer
is appointed, or as otherwise consistent with State statute. The Chief
Financial Officer shall supervise the work of the Department and its
Divisions; be responsible for the accounting, pre-auditing, control,
receipt, custody and disbursement of Township revenues and expenditures
and shall also be responsible for all fiscal matters and financial
policies of the Township.

Within the Department of Finance there shall be a Division of
Accounts and Control. Under the supervision and direction of the Director
of Finance, the Division shall:
a. Develop, maintain and enforce a uniform system of accounts, including
forms, standards and procedures for all Departments of the Township
Government. Any uniform system of accounts shall include appropriate
provision for such records and reports as may be prescribed or approved
by the Manager for the determination of the cost of performance of
each functional program or activity, measured in such work units as
may be appropriate thereto, and for such data, records and reports
as may be prescribed or approved by the Manager for the preparation
and execution of a budget for the expenditure of public funds for
capital purposes to give effect to general improvement programs.
b. Maintain and operate the Township's central bookkeeping and accounting
records according to sound accounting principles, and in accordance
with the requirements of the Director of the State Division of Local
Government.
c. Audit all receipts and disbursements of the Township Government and
of each of its Departments and pre-audit all bills, claims and demands
against the Township, including payrolls, and require each Department
Head to certify that the materials, supplies or equipment have been
received and accepted as specified and that the services have been
duly rendered.
d. Control all expenditures to assure that budget appropriations are
not exceeded, and maintain such books and records as may be required
for the proper exercise of such budgetary control.
e. Review each proposed expenditure and commitment to be made on behalf
of any Department for conformity with state law, the Charter and ordinances
of the Township, and authorize only such expenditures and commitments
as conform with all the requirements of this chapter.
f. Install, operate and maintain a central payroll system and all social
security, pension and insurance records for personnel of all Departments.
g. Devise, install and supervise a perpetual inventory of unissued stores
of the Township and install an accounting system whereby the status
of such inventories will be maintained currently. Supervise a physical
inventory periodically. Supervise the making of inventory lists of
furniture and equipment by every officer, department or other agency
having possession of Township owned property. Devise a system of inventory
records to account for all furniture and equipment and supervise a
periodic counting of such furniture and equipment.
h. Submit a monthly report of expenditures and balances to the Township
Council and Manager.

Within the Department of Finance there shall be a Division of
Assessments, the head of which shall be the Township Tax Assessor.

a. Appointment. The Township Council shall provide for the appointment
of a Tax Assessor and such Deputy Tax Assessors consistent with New
Jersey State Statutes. Prior to appointment, the Assessor shall be
qualified by training or experience or a combination thereof in the
valuation and assessment of real and personal property. The Tax Assessor
shall be appointed for a term of four years and shall acquire tenure
as provided by law.
b. Qualifications. The Tax Assessor shall hold the Tax Assessor's Certificate
provided for in N.J.S.A. 54:1-35.25 et seq. Nothing in this section
shall affect adversely the salary or tenure rights acquired pursuant
to N.J.S.A. 54:1-35.31 or any other law.
c. Powers and Duties. The Municipal Tax Assessor shall perform all functions,
duties and services required by law and regulations promulgated in
connection therewith. The Assessor shall, in addition to regularly
scheduled office hours, field work and other responsibilities, be
required to appear before the Monmouth County Board of Taxation, Division
of Taxation, New Jersey Tax Court and such other courts and administrative
agencies of competent jurisdiction to defend all municipal assessments
of property as certified upon the tax rolls of the municipality.
In addition, the Assessor shall perform the following duties:
1. Make assessments for benefits of local improvement, and for that
purpose have and exercise the powers and duties of a Board of Assessment
for Local Improvement as provided by law.
2. Maintain adequate assessment records of each separate parcel of real
property assessed or exempted.
3. Maintain a current tax map of the Township as a public record, and
cause to be recorded thereon all changes in ownership or character
of the real property assessed, employing for that purpose the facilities
of other departments as provided by the code.
d. Hours. The Municipal Tax Assessor shall be required to work the normal
business hours for the Township of Aberdeen.
The Assessor shall put in such additional time in and out of
the office as is required to perform added and omitted assessments,
field work and such other functions required by law.
e. Professional Standards. All work performed by the Assessor shall
be done in a competent and professional manner and in accordance with
the highest ethical standards of the profession.
f. Term of Office and Compensation. The Municipal Tax Assessor shall
serve a term of office of four years from the first day of July next
following his appointment.
Vacancies other than due to expiration of term shall be filled
by appointment by the Township Council as aforesaid for the unexpired
term.
The Mayor and Council shall determine the amount of compensation
of the Assessor by ordinance.

Within the Department of Finance, there shall be a Division
of Tax Collections. The head of the Division of Tax Collections shall
be the Township Tax Collector.

a. Appointment. Pursuant to N.J.S.A. 40A:9-141 et seq., the Governing
Body, by ordinance, shall appoint the Tax Collector.
b. Term of Office; Vacancies. The Tax Collector shall hold office for
a term of four years from January 1 next following his appointment.
Vacancies other than those due to expiration of term shall be filled
by appointment for the unexpired term.
c. Qualifications. No person shall be appointed or reappointed as Tax
Collector unless he or she shall hold a Tax Collector Certificate
issued by the Director of the Division of Local Government Services.
d. Certification Requirements. A Tax Collector certificate shall be
obtained upon qualification and successful completion of the examination
given by the Director of the Division of Local Government Services.
Qualifications for certification shall be in accordance with N.J.S.A.
40A:9-145.2. Revocation or suspension of any certificate shall be
in accordance N.J.S.A. 40A:9-145.5.
e. Duties. The Tax Collector shall have, perform and exercise all the
functions, powers and duties as are provided by general law and Township
ordinance. The Tax Collector shall;
1. Receive and collect all monies assessed or raised by taxation or
assessment for any purpose.
2. Keep proper records and shall report to the Director at least once
a month all receipts and deposits made by him and shall in such report
account for all monies for which he is responsible.
3. Keep a current record of all tax title liens, advising the Director
promptly as such liens become subject to foreclosure under the law.
4. Enforce the payment of delinquent taxes by the means provided by
law as soon as same become delinquent.
5. Serve as Township Tax Searcher and Township Improvement Searcher
and perform such duties as are prescribed by general law and Township
ordinance. However, the Township Manager may appoint, in lieu of the
Township Tax Collector, any qualified person to the position of Township
Tax Searcher and Township Improvement Searcher.
f. Compensation. The Tax Collector shall receive compensation as provided
in the annual salary ordinance.

The Division of the Treasury shall operate as follows:
a. Chief Financial Officer. Within the Department of Finance there may
be a Division of the Treasury, the head of which shall be the Chief
Financial Officer.
b. Powers and Duties of the Chief Financial Officer. The Chief Financial
Officer shall have, perform and exercise all of the functions, powers
and duties as provided by general law and Township ordinances. The
Chief Financial Officer shall keep and maintain books and records
of all financial transactions of the Township in accordance with the
standards and requirements of the Division of Local Government in
the Department of the Treasury of the State of New Jersey. He shall
have custody of all public monies of the Township and shall make monthly
reports to the Director of Finance of all receipts, expenditures,
commitments and unexpended appropriations. All monies received from
any source by or on behalf of the Township or any department, board,
office or agency thereof, except as otherwise provided by Township
ordinance shall be paid to the Chief Financial Officer who shall,
by the next ensuing bank day after their receipt, deposit them to
the credit of the Township in the authorized public depositary of
the Township to the credit of the proper account.
c. Disbursements. Disbursements in payment of bills and demands shall
be made by the Chief Financial Officer upon pre-audit and warrant
of the Director of Finance, approved by the Manager; except that payments
from the payroll account shall be made pursuant to paragraph (d) below.
Every warrant shall be in the form of a warrant-check payable to the
order of the person entitled to receive it, and shall specify the
purpose for which it is drawn and the account or appropriation to
which it is chargeable. Each warrant-check shall bear the signatures
of the Manager or Acting or Deputy Manager, or the Mayor or Deputy
Mayor and the Chief Financial Officer or Acting Chief Financial Officer.
d. Payroll Account. There shall be an account to be designated the Township
of Aberdeen Payroll Account, and the Chief Financial Officer, upon
receipt of a warrant or an amount due such payroll account, shall
deposit the same to the credit of the payroll account, charging the
appropriate budgetary accounts therewith. Disbursement from the payroll
account may be made by payroll checks signed by the Chief Financial
Officer alone or someone authorized by the Manager to act in the Chief
Financial Officer's stead upon pre-audit and warrant of the Director
of Finance and approval by the Manager of the entire payroll.
In case of error or adjustment in the payroll, the Chief Financial
Officer shall, and it shall be his duty to, make proper correction
and appropriate record of such correction.
e. Travel Expenses. Itemized claims supported by receipts where available
should be presented in order to obtain reimbursement for expenses
incurred by local officials where authorized to travel by the Township.
Travel expenses will be reimbursed only in accordance with the travel
regulations of the Township.

There shall be a Department of Public Works, the head of which
shall be the Director of Public Works/Engineer who shall be appointed
by the Township Manager.
a. The Director of the Department of Public Works shall:
1. Be responsible for all matters relating to the construction, management,
maintenance and operation of the physical properties of the Township,
other than office supplies, furniture and equipment.
2. Provide mechanical services required by any Department, office or
agency of the Township Government, except as otherwise directed by
the Manager or Council.
b. The Director/Engineer, subject to the Charter and this chapter and
in consultation with the Manager, shall:
1. Be the Administrative Head of the Department.
2. Hire, discipline and dismiss employees of his Department.
3. Promote and demote employees within the Department.
4. Assist the Manager in the preparation and administration of the operating
and capital budgets for the Department.
5. Prepare and present short and long range needs and goals of the Department.
6. Cooperate and coordinate the work of his Department with all jurisdictional
officials, boards and commissions.
7. Prescribe the internal organization of the work of his department.
8. Have all the powers, functions and duties prescribed by general law.
9. Report regularly to the Manager at the Manager's direction.
10. Maintain records as may be required to control Departmental receipts,
property and personnel, evaluate programs and to provide information
for budgeting, public reporting, planning and financing of Departmental
programs and work schedules.
11. Make, alter and enforce individual work assignments.
12. Delegate authority to subordinates or other personnel to perform
any of the duties and responsibilities of his office.
13. Generally be responsible for the proper and efficient conduct of
all public works functions of the Township.

There shall be a Township Engineer who shall be appointed by
the Manager. The Office of Township Engineer may be combined with
the Office of the Director of Public Works. The Engineer shall receive
such compensation as may be agreed upon and determined by the Council.
The Township Engineer shall be a duly licensed civil engineer of the
State of New Jersey and shall perform such duties as are prescribed
by general law and ordinance and in addition shall:
a. Prepare, or cause to be prepared, plans, designs and specifications
for public works and improvements undertaken by the Township, either
on force account or by public contract.
b. Provide and maintain surveys, maps, plans, specifications and control
records with respect to public works and facilities owned or operated
by the Township.
c. Provide technical and engineering advice and assistance to other
Township Departments as needed.
d. All papers, documents, memoranda, reports and other materials relating
to the administration of engineering duties of the Township Engineer
shall be and remain the property of the Township. Upon the termination
of his services with the Township, the Township Engineer shall forthwith
surrender to any successor all such property.
e. The Township Manager may appoint a consulting engineer who shall,
as a minimum, have the same qualifications as the Township Engineer.
In lieu of appointing an individual, the manager may appoint a firm
of engineers, each member of which shall be a licensed civil engineer
of the State of New Jersey. The consulting engineer shall perform
such services and shall be paid such fees as may by resolution be
agreed to by the Township Council.

Within the Department of Public Works there shall be a Division
of Public Property, the head of which shall be the Shop Foreman. Under
the direction and supervision of the Director of Public Works, the
Division of Public Property shall:
a. Maintain and repair all Township streets, bridges, culverts and drains.
b. Construct and reconstruct streets, roads, culverts and drains; treat
road surfaces and resurface streets and roads according to such standards
and schedules as directed or approved by the Township Manager.
c. Maintain all Township streets in a clean and safe condition, free
of obstructions and hazards and remove snow and ice therefrom as required.
d. Install, repair and maintain street traffic signs, lines and markers.
e. Operate, maintain and repair Township-owned buildings and properties,
except the Township water plant, and provide custodial and janitorial
services therefor, including office quarters, waterfront property
and all other real estate.
f. Trim, plan, care for and preserve public parks, greens, grounds and
trees in the public way.
g. Control the care, use and disposition of motor vehicles owned by
the Township, other than fire engines, and for this purpose the Division
shall:
1. Operate or supervise the operation of a garage or garages for the
storage, servicing, repair and maintenance of Township-owned motor
vehicles.
2. Supervise any work done by contract for the storage, repair servicing
and maintenance of Township-owned motor vehicles or equipment.
3. Control the maintenance of motor vehicles owned by the Township by
maintaining individual vehicle records of mileage, costs of operation
and maintenance and replacement schedules.

Within the Department of Public Works, there shall be the following
divisions under the direction and supervision of the Director of Public
Works:
a. Division of Sanitation and Recycling;
b. Division of Streets and Roads;
c. Division of Buildings and Grounds;
d. Division of Park Maintenance;
e. Division of Water and Sewer;
f. Division of Public Works;
g. Division of Public Property.

There shall be a Department of Public Safety in and for the
Township, the head of which shall be the Director of Public Safety.
Unless and until the Council shall by resolution authorize the appointment
of a separate Director, the Manager shall serve as Director of Public
Safety without additional compensation. The Director, subject to the
direction and supervision of the Manager, shall be responsible for
the proper and efficient conduct of all public safety functions of
the Township Government and shall supervise and direct the work of
the Department of Public Safety.

There shall be a Division of Police, (hereinafter may be referred
to as the Police Department) in and for the Township, the head of
which shall be the Chief of Police, and which shall be composed of
such officers, full-time Patrolmen and Special Law Enforcement Officers
as may be appointed by the Manager.

Such additional Divisions shall be created as the Township Council
shall determine as being necessary for the public safety and welfare
in and for the Township.

The Chief of Police shall:
a. Be the executive head of the Division of Police, subject to the direction
and supervision of the Manager, and shall be responsible for the proper
and efficient operation of the Division and the supervision of its
activities.
b. Be responsible for the observation and enforcement of all laws of
the State and ordinances within the jurisdiction of the Division of
Police; the enforcement of the rules and regulations of the Division
of Police, and shall perform such other duties as shall be prescribed
by ordinance of the Township Council.
c. See that all persons connected with the Division are properly instructed
in their duties and shall give particular attention to the training
and instruction of new members thereof.
d. Have under his control all records and property of the Division of
Police and designate any member of the Division to prepare these reports
and keep the records in such manner as he may prescribe, as well as
to take charge of such property and any other property coming into
the custody of the Division.
e. Furnish the Township Manager complete monthly and yearly reports
of Division of Police matters.

a. To be eligible for appointment as a probationary patrolman, the applicant
must have the following qualifications:
1. Be a citizen of the United States.
2. Be of good moral character.
3. Be able to read and write the English language intelligently.
4. Be not less than 18 years of age nor more than 35 years of age at
the announced closing date for filing applications for the position
or as otherwise approved by the New Jersey Police and Fireman Retirement
System.
5. Persons having served in the active military service of the United
States during "time of war" and conflict as defined in N.J.S.A. 43:16A-11.7
can for the purpose of meeting the maximum age requirement, as allowed
by the New Jersey Police and Fireman Retirement System, may reduce
their actual age by the stipulated period of such military service.
Should this reduced age meet the age maximum in effect, the applicant
will be considered as having met the age maximum for enrollment. The
period of time to be deducted from an individual's age is limited
to actual time served during the war or conflict. Earlier or later
periods of military service cannot be used to reduce individuals'
ages so as to enable them to meet any maximum age limits. Any active
military service terminating in dishonorable discharge is not creditable.
6. An applicant shall also be permitted to reduce their actual age in
order to meet the maximum age requirement of 35 years if, in accordance
with N.J.S.A. 40A:14-127.1, they have previous service as a former
state trooper, Sheriff's officer or deputy, or county or municipal
police officer. Prior experience in federal law enforcement agencies
or in law enforcement agencies of other states that would meet the
requirements of police officer in New Jersey would also qualify for
the purpose of reducing the applicant's age. Age reductions may also
be granted for persons who have prior service with the Delaware River
Port Authority Police, Amtrak or South Eastern Pennsylvania Transportation
Authority (SEPTA) Police Departments. No person may be appointed over
the age of 45 except for those who were previously involuntarily terminated
from their former law enforcement officer employment.
7. Be in good health, sound in mind and body.
8. Exhibit, prior to appointment, a certificate from the Township Physician
that the applicant is physically capable of performing the duties
which will be required as a probationary patrolman.
b. Except as outlined in Subsection C, Probationary patrolmen shall
be appointed on the basis of merit and as the result of a competitive
examination that fairly tests and determines the qualifications, fitness
and ability of the applicant to perform the duties of the position
to which they seek appointment. Preference shall be given to those
applicants who are residents of the Township of Aberdeen at the time
they file for the examination for appointment to the Police Department
as allowed by N.J.S.A. 40A:14-123.1a. The aforesaid examination shall
be conducted at such time and in such manner as the Mayor shall determine.
c. In accordance with P.L. 2021, c. 7 (N.J.S.A. 11A:4-1.3), and in the
sole discretion of the appointing authority, temporary entry-level
law enforcement officers may also be appointed without taking a competitive
examination, provided that within nine months of appointment they
successfully complete a full basic course for police officers training
course at a school approved and authorized by the New Jersey Police
Training commission.

The rights, privileges, powers and duties of the members of
the Police Force, including temporary officers and Special Law Enforcement
Officers, shall be those prescribed by State Laws governing municipal
Police Departments generally, by the Charter and ordinances and resolutions
of the Township Council.
The Division of Police, through its Chief, shall:
a. Preserve the public peace, protect life and property, prevent crime,
detect and arrest offenders against the penal laws and ordinances
effective within the Township, suppress riots, mobs and insurrections,
disperse unlawful or dangerous assemblages, and preserve order at
all elections and public meetings and assemblages.
b. Administer and enforce laws and ordinances to regulate, direct, control
and restrict the movement of vehicular and pedestrian traffic, and
the use of the streets by vehicles and persons, to protect the safety
and facilitate the convenience of motorists and pedestrians, and to
make and enforce rules and regulations not inconsistent with the ordinances
of the Township for such purposes.
c. Remove or cause to be removed all nuisances in the public streets,
parks and other public places of the Township, inspect and observe
all places of public amusement or assemblage and all places of business
requiring any State or Township license or permit and report thereon
to the appropriate department.
d. Respond to all fire alarms and assist the fire company in the protection
of life and property, in regulating traffic, maintaining order, and
in enforcing observance of the State Uniform Fire Safety Act. The
Chief of the Fire Company may request the Township Manager or the
Officer-in-Charge at the time of any emergency to provide the assistance
of the Police Reserves in emergencies.
e. Furnish assistance upon request to the Township First Aid and Rescue
Squad.
f. Provide for the attendance of its members in Court as necessary for
the prosecution and trial of persons charged with crimes and offenses,
and cooperate fully with the law enforcement and prosecuting authorities
of Federal, State and County governments.
g. Operate a training program to maintain and improve the Police efficiency
of the members of the Division.
h. Make, administer and enforce rules and regulations for the disposition,
conduct and discipline of the Division.

Each member of the Division of Police shall devote his whole time and services thereto, except as provided in subsection
2-19.5 below. Although certain hours will be allotted for the performance of regular tours of duty, officers are considered at all times available for duty and must act promptly at any time that their services are required, except when on authorized leave or in the event of disability.
No Police Officer shall be required to be on regular duty for
more than six (6) days a week, but in case of an emergency, the Manager
or Chief of Police shall have full authority to summon and keep on
duty any and all such officers during the period of the emergency.

Each full-time Patrol Officer appointed to the Police Force
of the Township may pursue other employment outside of the duty hours
as prescribed by the Manager and subject to the approval of the Manager.

The Chief of Police shall have the power to relieve from duty
any member of the Division of Police for the violation of any provision
of this section or any rule governing the Division of Police until
such time as complaint and charge against such member shall have been
disposed of by formal hearing in accordance with N.J.S.A. 40:47-6.

The Manager may appoint Special Law Enforcement Officers for
a term not exceeding one (1) year, and revoke such appointments without
cause or hearing. Such Special Law Enforcement Officers shall carry
out their duties and responsibilities under the direct supervision
of the Chief of Police and their powers, rights and duties shall be
specifically defined by the Chief of Police. The powers, rights and
duties, however, shall immediately cease at the expiration of the
term for which they were appointed, or upon revocation of their appointment.
Special Officers shall not carry a revolver or other weapon at any
time except as otherwise directed by the Chief of Police.
No person shall be appointed as a Special Law Enforcement Officer
unless he is a citizen of the United States, is able to read, write
and speak the English language, is physically qualified, of good moral
character, and shall not have been convicted of any crime involving
moral turpitude. Every such Special Law Enforcement Officer shall
be fingerprinted and his fingerprints shall be filed with the Division
of the State Police and Federal Bureau of Investigation. Reports shall
be made by the Chief of Police to the Township Manager concerning
the eligibility and qualifications of any person proposed to be appointed
a Special Law Enforcement Officer

The Township Council shall establish by resolution and may,
from time to time, amend and repeal by resolution such rules and regulations
as it may deem necessary for the government and efficient working
of the entire Division of Police. The rules and regulations, when
adopted, shall be posted by the Police Chief within five (5) days
after the adoption thereof in a prominent place in the Division of
Police Headquarters and a copy thereof delivered to each and every
member of the Division within five (5) days after the adoption of
the rules or regulations or any amendment or repeal thereof.

a. Any and all extra duty assignments for Police Personnel shall be
determined and approved by the Chief of Police or his designee. No
Police Officer shall perform special duty assignments for private
entities for compensation other than through the procedure in this
section. The Chief of Police or his designee shall obtain any information
deemed necessary, and use his discretion to determine approval or
denial of the special duty assignment. At the Chief or designee's
discretion, the special duty assignment shall be determined for approval
based on the nature of each individual assignment, and the Chief or
designee may approve any and all necessary equipment for each assignment.
b. The work to be performed shall be considered "special assignment
from independent contractors" and will not be considered a direct
assignment. The taking of any and all extra duty assignments shall
be on a voluntary basis in accordance with a fair and reasonable system
established and administered by the Chief of Police.
c. Officers engaged in special duty assignments shall be deemed off-duty
and shall conform to all Police Department rules, regulations and
procedures. All such agreements for special duty assignment shall
be contracted for in writing by the completion of a form available
from the Police Department which contracts shall be paid fifteen (15)
days from the date of billing. Interest shall be charged at the rate
of twelve (12%) percent per annum on any amount billed for which payment
has not been made within fifteen (15) days. Delinquent parties shall
be liable for all costs, fees, and attorney fees associated with the
collection of any amount due.
d. All special duty assignments shall be within the Township, unless
specific written approval is given by the Chief to the officer to
work outside the Township, the Chief of Police may contact adjoining
municipal police departments to see if they are willing to perform
such special assignments.
e. All payments for special duty assignments shall be made through a
Special Police Fund established by the Municipal Treasurer from which
payment shall be made to the individual Police Officers performing
such service. All payments from the trust fund shall be made to the
Police Officers subject to required deductions and administrative
fees to be retained by the Township to cover administrative costs,
overhead, and out-of-pocket expenses. The Township shall retain a
fifteen (15%) percent administrative fee for each officer and a five
(5%) percent administrative fee for each police vehicle utilized in
connection with the special duty assignment.
f. In the event that the person or entity requesting the special duty
assignment fails to contact the Police Chief at least four (4) hours
prior to the scheduled start time of the job, the person or entity
is responsible to pay the officer the minimum four (4) hours for the
special duty assignment.
g. The Police Chief or his designee shall have the authority to order
any Police Officer engaged in a special duty assignment to respond
to an emergency. The Police Chief or his designee shall also have
the right to order any special duty assignment to be terminated whenever
said assignment creates an unacceptable risk to the health, safety
and welfare of the Police Officer and/or citizens of the Township.
h. The Township shall be responsible to provide all necessary insurance
coverage for the Police Officers as required by law, including but
not limited to workers compensation, public liability, and claims
for damage and personal injury which may arise as a result of the
municipality's performance under the contract.
Editor's Note: Currently the Township is fulfilling this section
through an Interlocal Agreement with a neighboring municipality pursuant
to the Interlocal Services Act.

Within the Department of Public Safety, there shall be a Division
of Emergency Management, referred to as the Office of Emergency Management.

There shall be a Director of Emergency Management who shall
be appointed by the Township Manager to serve at his pleasure and
a Deputy Director who shall be appointed by the Director with the
approval of the Township Manager. The Director shall serve as Chairman
of the Emergency Management Council.

The Director shall be responsible for the planning, activating,
coordinating and the conduct of Emergency Management Advisory Council
and supervise disaster control operations in the Township.
The Deputy shall act in the name of the Director when the Director
is unable to discharge his normal duties and shall assume such other
responsibilities as may be delegated to him by the Director.

The Director may, when, in his opinion, a disaster has occurred
or is imminent, and with the advice and consent of the Manager and
Township Council, proclaim a state of local disaster emergency. Upon
such proclamation, the Director, in accordance with the regulations
promulgated by the State Office of Emergency Management, shall be
empowered to issue and enforce such orders as may be necessary to
implement and carry out defense or disaster control operations and
to protect the health, safety and resources of the residents of the
Township.

There shall be an Emergency Management Advisory Council of the
Township, pursuant to N.J.S.A. App. A:9-33 et seq., which shall be
comprised of the Director, Deputy Director and eight (8) additional
members who shall be appointed by the Township Manager and serve at
the pleasure of the Manager.
One (1) member shall be selected from each of the following:
a. Aberdeen Township Division of Police.
b. Fire District I with the advice and consent of the Board of Fire
Commissioners of District I.
c. Fire District II with the advice and consent of the Board of Fire
Commissioners of District II.
d. Aberdeen Township First Aid Squad with the advice and consent of
the Squad.
e. South Aberdeen Township First Aid Squad with the advice and consent
of the Squad.
f. Department of Public Works.

Under the direction and supervision of the Director of Emergency
Management, the Council shall generally assist the Township in establishing
the various local volunteer agencies needed to meet the requirements
of all emergency management and disaster control activities in accordance
with the rules and regulations established by the Governor of the
State of New Jersey, and more specifically:
a. Develop plans for emergency operations in accordance with directives
from and approval of the State Director and/or County Coordinator.
b. Supervise local tests and exercises.
c. Coordinate activities of local and County services and allied agencies
in an emergency.
d. Maintain administrative records as may be required.
e. Investigate and apply for State or Federal grants or other aids and
assistance.
f. Take such action as may be appropriate and lawful to plan, enforce,
activate, coordinate and conduct emergency operations within the Township.

a. Established. There is hereby established in the Township a volunteer
CERT.
b. Members. The CERT shall consist of up to fifty (50) members, all
of whom shall be under the supervision, and respond to the direction
of the Township's Emergency Management Coordinator.
c. Appointment, Qualifications. Members of the CERT shall be appointed
by the Township Council and shall serve terms of one (1) year. CERT
members shall be at least eighteen years of age and shall undergo
mandatory training in areas such as disaster preparedness, disaster
fire suppression, disaster medical operations, light search and rescue
operations, disaster psychology and team organization, and anti-terrorism.
Such training shall be organized by the Township and in accordance
with the curriculum established by the Federal Emergency Management
Agency (FEMA).
d. Continuing Training. CERT members serving multiple terms shall be
required to undergo continuing training as required by the Township.

There shall be a Department of Planning, Zoning and Development,
the head of which shall be the Director of Zoning and Development.

The Department of Planning, Zoning and Development, under the
supervision of the Director, shall be organized into two (2) sections:
a Division of Planning, Zoning and Development; and a Uniform Construction
Code Enforcing Agency whose duties and responsibilities are set forth
in full in Chapter XII.

The Director of Planning, Zoning and Development shall be appointed
by the Manager and shall be qualified on the basis of administrative
abilities and qualifications with special regard to education, training
and experience in land use planning and related governmental affairs
or be licensed as a Construction Official under the Uniform Construction
Code. He or she shall hold or actively pursue a regularly issued New
Jersey Professional Planner's License.

The Director of Planning, Zoning and Development, subject to
the Charter and administrative code and approval or direction of the
Manager, shall:
a. Supervise the Administrative Zoning Officer as described in the Municipal
Land Use Law, N.J.S.A. 40:55D-1 et seq.
1. The Zoning Officer will be responsible for all administrative and
legal enforcement of the Township Zoning Ordinance.
b. The Director shall be responsible for the administrative and legal
enforcement of the Uniform Construction Code, Housing Code, Commercial
Properties, Maintenance Code, Demolition Ordinance and other development
ordinances.
1. Either directly or through a planning consultant hired by the Township,
provide the Township with guidance in planning within the framework
of the master plan.
2. Work with a Planning Consultant to the Township Planning Board or
Board of Adjustment, reviewing plans submitted to these Boards for
site improvements, subdivisions, etc. and disseminating information
to applicants and their representatives and advising and instructing
them on Township development requirements. The Zoning Officer shall
attend Zoning Board Meetings, as needed. The Zoning Officer shall
prepare or cause to be prepared and presented, reports and comments
on applications before each Board as required.
3. Prepare or cause to be prepared reports and recommendations on subdivision
applications and site plans and all other assignments, as requested
by the Planning Board, Board of Adjustment, or any other municipal
body.
4. Direct and supervise all department personnel and assist the Planning
Board and Board of Adjustment in their prescribed activities and functions,
including the preparation of annual budgets.
5. Assist the Manager and Planner in the development of long-range capital
improvement programs and with the overall planning of future land
use within the Township.
6. Along with the Planner, make recommendations regarding subdivision,
zoning, and other land use development ordinances within the Township.
7. In connection with the Manager and Planner, provide the Township
with guidance in planning within the framework of the master plan
and review and make recommendations regarding the master plan.
8. Assist the Manager and Planner in preparing Federal or State grants
as requested by the Manager and administer community development programs
in the Township.
c. Be the administrative head of the Department and delegate authority
to subordinates or other personnel to perform any of the duties and
responsibilities of this office. Hire, discipline and dismiss employees
of this Department.

The Construction Official shall serve as Supervisor of Demolition
of Buildings and shall be charged with the enforcement of such ordinance
heretofore adopted by the Township.

There shall be a Department of Parks and Recreation, the head
of which shall be the Director. The Director shall be appointed by
the Township Manager and shall be qualified by education, experience
and training in the field of public recreation and parks maintenance.
Within the Department, there shall be an Advisory Council on Recreation
and Parks constituted and appointed as hereinafter provided.

The Department shall:
a. Provide a year-round program of wholesome recreational activities
for Township residents.
b. Cooperate with other municipal departments, youth organizations,
service clubs and other organizations, in furthering recreational
interests in the Township.
c. Plan, develop and coordinate the use of park and recreational facilities.
d. Plan and operate Township beaches and related facilities, and supervise
the activities of concessionaires at public beaches, parks and recreation
areas, under contract with the Township.
e. Assist the Township Manager in the preparation of the budget and
enter into agreements and understandings with the Regional Board of
Education for joint and cooperative program planning and use of its
facilities.

The Director of Parks and Recreation, subject to the Charter
and Administrative Code contained herein, and in consultation with
the Manager shall:
a. Be the administrative head of the Department.
b. Hire, discipline and dismiss subordinate employees within his Department,
subject to Civil Service Rules and Regulations and availability of
funds in his budget.
c. Promote or demote employees within the Department.
d. Assist the Township Manager in the preparation and administration
of the operating and capital budgets for the Department.
e. Assist the Township Manager in preparing short and long range needs
and goals of the Department.
f. Cooperate and coordinate the work of his Department with all jurisdictional
officials, boards and commissions.
g. Prescribe the internal organization of the work of his Department.
h. Make, alter and enforce individual work assignments.
i. Delegate authority to subordinates or other personnel to perform
any of the duties and responsibilities of his office.
j. Maintain records as may be required to control Departmental receipts,
property and personnel, to evaluate programs, and to provide information
for budgeting, public reporting, planning and financing of park and
recreational programs.
k. Prepare a monthly report on his Departmental activities for submission
to the Manager.
l. Prepare and maintain a roster of qualified seasonal and part-time
parks and recreation employees, for the benefit of the Manager.
m. Prepare a Parks and Recreational Policy Manual as a part of the Township
standard procedure system.

The Director may sponsor, arrange and provide for the giving
of indoor and outdoor exhibitions, concerts, games and contests, and
may use and employ public property for such purposes. The Department
may charge and collect for the use of the Township, a reasonable admission
fee for each person entering or using facilities, exhibitions, concerts,
games or contests, provided under this section, except as the Council
may otherwise provide by resolution.

a. The Department may adopt reasonable rules and regulations for the
conduct of all persons while on or using such public property devoted
to public park or recreational uses through its policy manual and
the standard procedure system of the Township. Any person who shall
violate any such rules, regulations or procedures shall be adjudged
to be a disorderly person.
b. The custodians, supervisors and assistants appointed for the Department
shall, while on duty and for the purpose of preserving order and the
observance of the rules, regulations and procedures of the Department,
have the power and authority of Special Law Enforcement Officers of the Township.

a. All State Parks, recreation areas and open space reservations included
within the State Park System located within the jurisdictional boundaries
of the Township shall be governed by the provisions of this section
and the rules and regulations governing the use of State Parks as
adopted by the State of New Jersey and codified at N.J.A.C. 7:2-1
et seq. to the extent that said regulations are applicable to said
parks, as amended and supplemented from time to time.
b. Fines and penalties for convictions of violations of the State Park
rules and regulations shall be those set out in the most recent schedule
of fines for violation of rules and regulations governing use of State
Parks as adopted by the State of New Jersey. Where no specific fine
or penalty for a violation of any particular rule or regulation has
been established by the State of New Jersey, the general penalties
for violations of this section shall apply.

a. Maximum Penalty. For violation of any provision of this section,
the maximum penalty, upon conviction, shall be as provided by law.
b. Application. The maximum penalty stated in this section is not intended
to state an appropriate penalty for each and every violation. Any
lesser penalty including a nominal penalty or no penalty at all may
be appropriate for a particular case or violation.

There shall be a Department of Health, the head of which shall
be the Director of Health who shall be appointed by the Township Manager.
The Department shall have the functions, powers and duties of a Municipal
Health Officer or Department of Health as prescribed by general law
and ordinance, including the enforcement of the State Sanitary Code.

There shall be a Registrar of Vital Statistics within the Department
of Health, who shall be appointed by the Township Manager. The Registrar
shall have charge of the administrative duties involved in obtaining
reports of and recording births, marriages and deaths in the Township,
together with such related work as may be required in accordance with
general law and ordinances of the Township.
