There is hereby set off, created and established as a garbage
collection district, to be designated as Garbage Collection District
No. 1, the lands and territories situate within the corporate boundaries
of the Township of Aberdeen, County of Monmouth and State of New Jersey.

The Township Council shall provide for the collection, removal
and disposal of garbage, rubbish and other refuse matter or material
in accordance with the terms and conditions set forth in an agreement
between the Township of Aberdeen and the contractor responsible for
the collection and removal of the material, and in addition, the Township
Council may establish such reasonable rules and regulations consistent
with the agreement as it may deem necessary or expedient.

There shall be raised, by levying and collecting, at the same
time and in the same manner as other Township taxes, within the limits
of the garbage collection district, sufficient monies to provide for
the payment of the cost of removing and disposing of the garbage,
rubbish and other refuse matter from the district.

All monies assessed and levied as aforesaid shall be a lien
upon the lands and premises against which they shall be assessed,
in the same manner that taxes are made a lien against lands in the
Township of Aberdeen, and the payment thereof shall be enforced with
the same time and in the same manner and by the same proceedings as
the payment of taxes is enforced within the Township.

The cost of collecting, removing and disposing of garbage, rubbish
and other refuse material shall be raised by assessing and levying
against those residences, apartments and dwellings as provided for
in the contract between the Township and the garbage collector within
the limits of the Garbage Collection District No. 1. Condominiums
are excluded from this garbage collection district and shall provide
for cost of collecting, removing and disposing of garbage, rubbish
and other refuse material, individually.

a. Established. The position of Recycling Coordinator is hereby created
and established within the Township of Aberdeen.
b. Manager or Designee. The Recycling Coordinator shall be the Township
Manager or his designee.
1. Duties of the Recycling Coordinator shall include, but are not limited
to: the preparation of annual or other reports as required by the
State and County agencies regarding local solid waste and recycling
programs, reviewing the performance of local schools and municipal
agencies in conducting recycling activities, periodic review of local
residential and business recycling practices and compliance, review
and recommendation on local subdivision and site plan submittals and
local construction and demolition projects for appropriate waste disposal
and recycling provisions.
2. The Recycling Coordinator shall be required to comply with the Certification
Requirements for Municipal Recycling Coordinators, as established
by the State of New Jersey. The Recycling Coordinator shall have completed
or be in the process of completing the requirements for certification
as a "Certified Recycling Professional" (CRP) no later than January
13, 2012, as required by the New Jersey Recycling Enhancement Act.
c. Rules and Regulations. The Township Manager or his designee, subject
to the approval of the Township Council, shall establish and promulgate
reasonable rules and regulations as to the manner, days and times
for the collection, sorting, transportation, sale and/or marketing
of the recyclable materials in order to encourage the preservation
of material resources while minimizing the cost of the recycling program
to the Township of Aberdeen.

By reason of the growing problem of solid waste disposal and
its impact on our environment, conservation of recycling materials
have become an important public concern. There is an increasing necessity
to conserve our material resources. The collection of newspapers,
corrugated cardboard, clean mixed paper, aluminum cans, tin and bimetal
cans, glass bottles and jars, and pourable plastic bottles, for recycling
purposes from residences in the Township of Aberdeen will foster and
promote the general public welfare.

As used in this chapter:
ALUMINUM CANS
shall mean all disposable cans made of aluminum used for
food or beverages. Specifically excluded are aluminum foils, pie tins,
trays cookware and other aluminum products.
CLEAN MIXED PAPER
shall mean high grade bond paper, mixed office and school
papers, such as stationery, construction paper and writing tablets,
including computer printouts, magazines, gift wrapping paper, soft
cover books, junk mail and single layer cardboard (chipboard). Specifically
excluded are carbon papers, hard cover books (unless cover and binder
are removed), paper cups and plates, food wrappers or any other paper
contaminated by direct contact with food products, and paper products
used for personal hygiene, such as tissues.
CONSTRUCTION AND DEMOLITION MATERIALS
shall include all asphalt, concrete, tree stumps, brush,
land clearing debris, pallets, waste lumber and other material generated
from construction and demolition projects.
CORRUGATED CARDBOARD
shall mean layered cardboard including a waffled section
between the layers, of the type commonly used to make boxes and cartons.
Specifically excluded are waxed cardboard and any cardboard contaminated
by direct contact with food, such as pizza boxes.
GLASS BOTTLES AND JARS
shall mean transparent or translucent containers made from
silica or sand, soda ash and limestone, used for the packaging or
bottling of various products. Specifically excluded are dishware,
light bulbs, window glass, ceramics and other glass products.
NEWSPAPER
shall mean and include paper of the type commonly referred
to as newsprint, and includes any inserts which are normally included
in the newspaper. Specifically excluded are any pages of the newspaper
used for household projects, or used for cleanup of pet waste.
PERSON
shall mean any person, firm, partnership, association, corporation,
company or organization of any kind.
POURABLE PLASTIC CONTAINERS
shall mean plastic bottles where the neck is smaller than
the body of the container, and is limited to plastic resin type #1
PET and plastic resin type #2 HDPE. Specifically excluded are other
resin types (#2 through #7) and non-bottle plastic containers such
as margarine tubs and other consumer items and packages, such as film
plastics, blister packaging, boxes, baskets, toys and other products.
SOLID WASTE
shall mean all garbage and rubbish normally produced by the
occupants of commercial, industrial and residential property and disposed
of by private or public pickup.
TIN AND BIMETAL CANS
shall mean all disposable cans made of tin, steel or a combination
of metals including, but not limited to, containers commonly used
for food products. Specifically excluded are cans which contain toxic
products, such as paints and oils.

Pursuant to the Interlocal Service Act, N.J.S.A. 40:8A-1 et
seq., the Township Council is hereby authorized to enter into an agreement
the form of which is annexed hereto and made a part hereof by and
among the municipalities to be determined.

a. It shall be mandatory for all persons who are owners, lessees and
occupants of residential properties, of business and industrial properties
and of private or public and government institutions and buildings,
in the Township to separate newspapers, corrugated cardboard, clean
mixed paper, aluminum cans, tin and bimetal cans, glass bottles and
jars, and pourable plastic bottles, ("designated recyclables"), from
all other solid waste produced by such residences and establishments,
for the separate collection and ultimate recycling of such materials.
b. Residences, businesses and institutions provided with recyclables
collection service by municipal forces or through municipal contract
shall place all designated recyclables in the appropriate containers
at curbside or other area(s) in the manner and schedule as regularly
published and distributed by the municipality.
c. Any multi-family complex, business or institution not provided recyclables
collection service by municipal forces or through municipal contract
shall be responsible for arranging the appropriate separation, storage,
collection and ultimate recycling of all designated recyclables.
d. Any multi-family complex, business or institution which is not provided
recyclables collection service by municipal forces or through municipal
contract shall provide the municipality with, at a minimum, an annual
report describing arrangements for both solid waste and recyclables
collection services, including the size, number and location of storage
containers, frequency of pickup service, the name and address of any
contractor hired to provide such service, and phone and other contact
information for the contractor.

Such newspapers and cardboard shall be compacted and shall be
tied securely in bundles not exceeding fifty (50) pounds in weight
with a rope or cord sufficient in strength to facilitate handling.
Such bundles shall be placed separately at the curb for collection
as provided in the garbage ordinance prior to the collection.

It shall be a violation of this section for any person not authorized
by the Township to collect or pick up or cause to be collected or
picked up any such newspapers at the curb as provided by this section.

This section is in no way intended to prohibit separate newspaper
drives by outside charitable organizations on days other than those
designated for collection by the Township.

a. The Police Department, the duly appointed Municipal Recycling Coordinator,
the Monmouth County Health Department and the Code Enforcement Officer
and any duly designated agent of the Township are hereby jointly and
severally empowered to inspect solid waste and recycling arrangements
and compliance at local residences, businesses, schools and institutions,
and to enforce the provisions of this section, by issuance of warnings,
notices, summonses and complaints. A typical inspection may consist
of sorting through containers and opening bagged solid wastes to detect
the presence of recyclable materials.
b. The authorized inspector may, in his or her discretion, issue a warning
rather than a summons following an initial inspection, with a follow
up visit to determine compliance within a stated period of time.
a. Separation of Recyclable Materials from Solid Waste. It shall be
mandatory for all persons, who are owners, lessees and occupants of
residential property, to separate newspapers, mixed paper and cardboard,
leaves, glass bottles and jars, pourable plastic bottles, aluminum
cans and tin and bimetal cans as hereinafter defined from all other
solid waste produced by such residence for collection and ultimately
recycling of said materials. Mixed paper shall be put out in a closed
container or clear plastic bag. Cardboard shall be broken down, bundled
and tied.
1. The following bulky recyclables shall not be placed with solid waste
at the curbside or in containers provided for waste collection and
transportation to a disposal facility; concrete, asphalt, brick, block,
tree stumps, tree limbs over three (3) inches in diameter, metal appliances
or bulk metal items larger than one (1) cubic foot and/or heavier
than five (5) pounds.
2. Automotive and other vehicle or wet cell batteries, used motor oil
and antifreeze shall not be disposed as solid waste. Such items are
to be kept separate from other waste materials and recyclables, and
brought to local service stations, scrap yards, or publicly-operated
recycling facilities designed and permitted to handle such products.
3. Common, nonrechargeable dry cell batteries, commonly labeled A, AA,
AAA, C, D and 9-Volt, may be disposed with regular municipal solid
waste; however, rechargeable dry cell and button batteries still contain
significant amounts of various toxic metals, including mercury, and
shall be separated and brought to retail outlets or publicly-operated
recycling facilities providing specific arrangements for the proper
packaging and shipment of rechargeable and/or button batteries to
appropriate processing facilities.
4. Computers, computer monitors and other related electronic hardware,
as well as analog and digital televisions, are prohibited from being
placed with other solid waste for disposal. These and other electronic
devices shall be kept separate and brought to retail outlets or publicly-operated
recycling facilities providing specific arrangements for shipment
of these items to appropriate processing facilities.
b. Business and Industrial Property; Institutions. It shall be mandatory
for all owners, lessees and occupants of business and industrial property
and of private, public and governmental institutions and buildings,
to separate newspapers, mixed paper and cardboard, leaves, glass bottles
and jars, pourable plastic bottles, aluminum cans and tin and bimetal
cans from all other solid waste produced by nonresidential establishments
for collection and the ultimate recycling of the materials.
c. Construction and Demolition Materials.
1. The municipality shall issue construction and demolition permits
only after the applicant has provided a Debris Management Plan identifying
the estimated number and types of containers to be used for the handling
of all solid wastes and recyclables generated during the project,
and arrangements for the proper disposition of the generated materials.
2. A refundable deposit of one hundred ($100.00) dollars shall be submitted
with the Debris Management Plan, which will be returned after the
completion of the project and submittal of appropriate records documenting
the quantity and disposition of solid wastes and recyclables. Inadequate
or incomplete documentation may result in the forfeiture of some or
all of the required deposit.
d. Used Oil Collection Sites. In accordance with existing State regulations
(N.J.A.C. 14A:3-11), all service stations, oil retailers and motor
vehicle reinspection stations with used oil holding tanks shall accept
up to five (5) gallons at a time of used motor oil from individuals
changing oil from cars, lawn mowers or motorcycles and shall post
a sign informing the public that they are a used oil collection site.
e. Liquid and Hazardous Waste Exclusions.
1. No liquids of any type shall be placed with recyclables, or with
solid waste for collection and disposal.
2. No chemicals, liquid paints, pesticides, herbicides, reactive polishes
or cleansers, cleaning or automotive products, or other hazardous
wastes shall be placed with recyclables, or with solid waste for collection
and disposal.
f. Provision and Labeling of Recycling Containers.
1. All apartment and other multi-family complexes, businesses, schools
and other public and private institutions shall provide separate and
clearly marked containers for use by residents, students, employees,
customers or other visitors, for trash and the various types of recyclables,
as appropriate.
2. Any company or agency providing dumpsters, roll off or other containers
to any apartment or other multi-family complex with shared disposal
and recycling areas, or to any business, school or other institution,
or for any construction/demolition project, shall clearly mark such
container for trash or for specific recyclables, as may be appropriate.

The Township may use municipal personnel to collect recyclable
material set forth herein at curbside and/or from a drop-off center
and shall sell the recyclable material if a market exists therefor
pursuant to N.J.S.A. 40A:11-1 et seq.
The Township may elect to enter into agreements with qualified
persons or corporations authorizing them to collect the recyclable
material at curbside or from a drop-off center and to sell the recyclable
material provided the amount of money realized exceeds the cost of
collection.

Recyclable material as defined herein shall be the property
of the Township once placed on the curbside or brought to a drop-off
center.
It shall be a violation of this section for any person unauthorized
by the Township to pick up or cause to be picked up the recyclable
material as defined herein. Each such collection in violation hereof
shall constitute a separate and distinct offense punishable as hereinafter
provided.

Anything herein to the contrary notwithstanding, any person
who is owner, lessee or occupant of a residential or nonresidential
property may donate or sell the recyclable material, as defined herein,
to any person whether or not operating for profit. The person, however,
shall not pick up the recyclable materials at curbside or at a municipal
drop-off center without prior written permission from the Township
Manager, or his delegated representative, to make such collection.

Any person who violates or neglects to comply with any provision
of this section, or any rule or regulation promulgated pursuant thereto,
shall be punishable upon conviction thereof by a fine not to exceed
five hundred ($500.00) dollars or up to ninety (90) days in jail,
or both, except that the maximum fine or penalty for the failure to
comply with any provision of this section, or any rule or regulation
promulgated pursuant thereto shall not exceed fifty ($50.00) dollars
for the first offense. As an alternate penalty, a convicted person
may be ordered to perform community service in the recycling program
for a period not to exceed ninety (90) days. Each day such violation
or neglect is committed or permitted to continue shall constitute
a separate offense and be punishable as such.

As used in this section:
a. Solid waste shall mean all garbage and rubbish normally produced
by the occupants of commercial, industrial and residential property
and disposed of by private or public pickup.
b. Recyclables shall mean those materials which would otherwise become
solid waste, and which may be collected, separated or processed and
returned to the economic mainstream in the form of raw materials or
products.
c. Person shall mean any individual, corporation, company, partnership,
firm, association, entity or political subdivision of this State subject
to municipal jurisdiction.
d. Litter shall mean small amounts of waste product that has been improperly
disposed of in the street.

a. Solid waste and recyclables collected from all residential property
may take place in the Township of Aberdeen only between the hours
of 6:00 a.m. and 7:00 p.m., prevailing time, Monday through Saturday.
The collection of solid waste and recyclables from residential property
at any time other than between the hours referenced in this section
is prohibited.
b. Solid waste and recyclables collected from all industrial and commercial
property, as well as property owned by the Matawan-Aberdeen Regional
School District, may take place in the Township of Aberdeen only between
the hours of 7:00 a.m. and 7:00 p.m., prevailing time, Monday through
Saturday, except on legal holidays when collection shall be between
the hours of 6:00 a.m. and 7:00 p.m. The collection of solid waste
and recycles from industrial and commercial property at any time other
than between the hours referenced in this section is prohibited.
c. This section applies to any person providing solid waste and/or recyclable
collection services to any property within the Township of Aberdeen.
d. This section shall not apply to street sweepers or street cleaners
used to clear litter from the street.

Any person, vendor, contractor, company, organization or entity
violating any provisions of this section, shall upon conviction thereof,
be subject to a fine of not less than five hundred ($500.00) dollars
nor exceeding twenty-five hundred ($2,500.00) dollars for each offense.
