A. 
There is hereby established a Police Department within the City of Orange Township.
B. 
There is hereby established the office of Director of the Police Department. The Director shall be appointed by the Mayor and confirmed by the City Council. He shall be qualified by experience and training to perform the duties of the Department. The Director shall be the appropriate authority pursuant to N.J.S.A. 40A:14-118 and any other applicable statutes, regulations, ordinances and resolutions. There shall also be a Deputy Director of the Police Department appointed by the Mayor. He shall be qualified by experience and training to perform the duties of the Department as delegated by the Director.
C. 
The Director shall perform the following duties:
(1) 
He shall promulgate policies, rules and regulations for the effective disposition of the police function and the discipline of the officers and personnel of the force.
(2) 
He shall determine the powers, functions, duties and assignments of officers and personnel of the force.
(3) 
He shall be responsible for the day-to-day operation of the force and may delegate such authority to the Deputy Director or other officer of the force where appropriate.
(4) 
He shall administer, supervise and direct the personnel and functions of the Department as set forth in this chapter.
(5) 
He shall administer and enforce the rules and regulations and special emergency directives for the disposition and discipline of its officers and personnel.
(6) 
He shall exercise and discharge the powers and duties of the force in addition to those duties set forth in § 26-3.
(7) 
He shall periodically promulgate reports for the Mayor and City Council regarding the operation of the force and the disposition of the police function.
(8) 
He shall promulgate such other policies, rules and regulations to effectuate the duties established by this chapter.
(9) 
He shall perform such other duties as directed by the Mayor.
D. 
The Deputy Director shall perform those duties as delegated, assigned and designated by the Director.

The Director shall determine the number of Detectives and police officers necessary for the efficient operation of the force, subject to budget limitations. All enumerated positions shall be filled in accordance with the budget and Section 26-2B.

A. 
There shall be the promotional position of Detective in the Police Department of the City of Orange Township.
B. 
All promotions from the position of police officer to the position of Detective shall be made by the Director of Police.
C. 
Detectives shall perform all appropriate functions set forth in § 26-3 of the Code of the City of Orange Township.
D. 
All police officers promoted to the positions of Detective shall receive an annual stipend in the amount of seven hundred fifty dollars ($750.).
E. 
Any police officer promoted to Detective may be removed at the discretion of the Police Director.

The Department shall perform all appropriate functions associated with:

A. 
No person shall be given or accept a permanent appointment as a police officer in the city unless such person has successfully completed a police training course at a school approved and authorized by the Police Training Commission in the Department of Law and Public Safety of the state, pursuant to the provisions of N.J.S.A. 52:17B-66 et seq.
B. 
This section shall not prohibit the giving or accepting of a probationary or temporary appointment as a police officer for a period not to exceed one (1) year, to enable a person seeking a permanent appointment to complete a police training course as prescribed by the Police Training Commission.
C. 
No person shall be permitted to take a police training course unless he holds a probationary or temporary appointment as a police officer in the city, and such appointee shall be entitled to a leave of absence with pay during the period of the police training course.
A. 
The City Council is hereby empowered to appoint such number of temporary special police officers as he shall see fit. The powers and duties of temporary police officers, so appointed, shall be the same as those of any regular patrolman.
B. 
Temporary special police officers appointed pursuant to this section shall have no obligation to contribute to any pension fund and shall acquire no pension rights, tenure rights or civil service status.
C. 
There is hereby created in the City of Orange Township the positions of Special Police Officers Class One and Special Police Officers Class Two:

D. 
Class One. Officers of this class shall be authorized to perform routine traffic details, spectator control and similar duties. They shall also be permitted to perform the following functions:
If authorized by ordinance, Class One Officers shall have the power to issue summonses for disorderly persons and petty disorderly persons offenses, violations of municipal ordinances and violations of Title 39 of the Revised Statutes. Any use of a firearm by an officer of this class shall be strictly prohibited.

E. 
Class Two. Officers of this class shall be authorized to exercise full powers and duties similar to those of a permanently appointed Police Officer. The use of a firearm by a Class Two Officer may be authorized only after the officer has been fully certified as successfully completing training as prescribed by the Police Training Commission.

F. 
All special law enforcement officers are appointed on a year to year basis with no vested right of reappointment.

(1) 
No special law enforcement officer may carry a firearm except while engaged in the actual performance of the officer's official duties and when specifically authorized by the Chief of Police, or, in the absence of the Chief, other law enforcement officer of the local unit, to carry a firearm and provided that the officer has satisfactorily completed the basic firearms course required by the commission for regular police officers and annual requalification examinations as required for permanent, regularly appointed full-time officers in the local unit. A special law enforcement officer shall be deemed to be on duty only while he is performing the public safety functions on behalf of the local unit at the rates or stipends as shall be established by ordinance. A special law enforcement officer shall be deemed to be on duty for purposes of this act while performing private security duties for private employers, which duties are not assigned by the Chief of Police, or, in the absence of the Chief, other Chief Law Enforcement Officer of the local unit, or while receiving compensation for those duties from a private employer. A special law enforcement officer may, however, be assigned by the Chief of Police or, in the absence of the Chief, other Chief Law Enforcement Officer, to perform public safety functions for a private entity if the Chief of Police or other Chief Law Enforcement Officer supervises the performance of the public safety functions. If the Chief of Police or other Chief Law Enforcement Officer assigns the public safety duties and supervises the performance of those duties, then, notwithstanding that the local unit is reimbursed for the cost of assigning a special law enforcement officer at a private entity, the special law enforcement officer shall be deemed to be on duty.
(2) 
Any firearm utilized by a special law enforcement officer shall be returned at the end of the officer's workday to the officer in charge of the station house, unless the firearm is owned by the special law enforcement officer and was acquired in compliance with a condition of employment established by the local unit. Any special law enforcement officer appointed shall only use a firearm supplied by the local unit.
(3) 
Officers of any class must complete approval course requirements established by the Police Training Commission. The City of Orange Township may require its officers to pay for the course of training and charge the officer for uniforms and equipment.
G. 
Any person who at any time prior to his or her appointment had served as a duly qualified, fully trained full-time police officer in any municipality of this State shall be eligible to serve as a special police officer.

H. 
Before any appointment is made, the Chief of Police or Director of Police or Chief Law Enforcement Officer shall ascertain the eligibility, character, integrity, psychological fitness and qualifications of the applicant.

A. 
The fees as provided in Chapter 88, Fees, are established for certain services extended and materials distributed by the Department of Police for the following areas:

(1) 
Copies of reports which are noncriminal in nature.
(2) 
Search fee in cases where a review of a record is desired.
(3) 
Viewing photographs of accident scenes.
(4) 
Copies of photographs.
(5) 
Photostat of an accident report.
(6) 
Photostat of a report other than an accident.
(7) 
Taking fingerprints of canvassers, solicitors and applicants for gun permits.
(8) 
Issuance of permit to purchase a pistol or revolver.
(9) 
Copies of audio recordings, 911 calls, telephone calls, radio transmission: fifty dollars ($50.) per hour or any part thereof plus the cost of any audio cassette tapes. Copies requested by criminal justice agencies will be provided free of charge.

B. 
The viewing or reviewing of reports, or of photographs of accident scenes, shall be permitted and conducted at the police headquarters daily, Monday through Friday, from 9:00 a.m. to 4:00 p.m.
C. 
No search fee shall be charged in the event that a report or photograph is not on file with the Police Department or for any report for which a formal request is made by any local, county, state or federal law enforcement agency or by the federal postal authorities.
D. 
The Department of Police shall issue a receipt for all fees and moneys received for the services extended or materials furnished as provided in this section and shall cause to be delivered the moneys and fees received to the City Treasurer daily prior to 4:15 p.m. each business day.
E. 
The Police Department shall issue a receipt for all fees and moneys received for the services extended or materials furnished as provided in this section.

A. 
Purpose. For the convenience of those persons and entities which utilize the services of off-duty law enforcement officers in the City of Orange Township Police Department and to authorize the outside employment of the City of Orange Township police officers while off duty, the township hereby establishes a policy regarding the use of said officers.
(1) 
Members of the Police Department shall be permitted to accept police related employment for private employers or school districts only during off-duty hours and at such time as will not interfere with the efficient performance of regularly scheduled or emergency duty of the township.
(2) 
Any person or entity wishing to employ off-duty police shall [first obtain the approval of the Police Director], which [approval] shall be granted [if in the opinion of the] Police Director, such employment would not be inconsistent with the efficient functioning and good reputation of the Police Department, and would not unreasonably endanger or threaten the safety of the officer or officers who are to perform the work. (3) 
All off-duty assignments shall be within the township unless specific written approval is given by the Police Director.
B. 
Escrow accounts.
(1) 
Any person or entity requesting the services of an off-duty law enforcement officer of the City of Orange Township shall first complete an application for services and specify dates, time and the number of hours of employment. If the number of hours is not known, then an estimate of the number of hours shall be required. All hours shall be approved in writing by the Police Director. The person or entity shall establish an escrow account with the City of Orange Township's Chief Financial Officer by depositing funds sufficient to cover the rates of compensation and administrative fees based upon the number of hours of service. If the hours are estimated, the escrow shall include a payment for an additional eight (8) hours over the estimate. All overages will be returned to the person or entity requesting law enforcement services within sixty (60) days after law enforcement services have been terminated.
(2) 
Prior to posting any request for services of off-duty law enforcement officers, the Police Director or his designee, shall verify that the balance in the escrow account of the person or entity requesting services is sufficient to cover the compensation and fees for the number of hours specified in the application. The Police Director shall not post a request for services from any person or entity unless all fees and compensation as described herein have been deposited with the Township Chief Financial Officer. No officer shall provide any such services for more hours than are specified in the request for services unless a new or amended request for services is submitted accompanied by the appropriate escrow payment.
(3) 
In the event the funds in such an escrow account should become depleted, services of off-duty law enforcement officers shall cease and requests for further services shall not be performed or posted until additional funds have been deposited in the escrow account as described herein. The Chief Financial Officer (CFO) shall not issue payments to law enforcement officers if funds have not been deposited and available in the escrow account. No payments will be issued until deposits are made.
(4) 
The person or entity requesting such services shall be responsible for ensuring that sufficient funds remain in the escrow account in order to avoid any interruption of services.
(5) 
All payments for special duty assignments shall be made through a special police fund established by the Chief Financial Officer of the municipality from which payment shall be made to the individual police officers performing such service. All payments from the trust fund shall be made to the police officers subject to required deductions and an administrative fee to be retained by the municipality. All funds in excess of the amount due the City of Orange Township will be returned to the depositor within thirty (30) days of written request to refund same. Any dispute between the contractor and the police officer on assignment as to services rendered or compensation due shall be determined by the Police Director. His decision shall be final and binding.
C. 
Requests for services. All requests to the township for the services of off-duty law enforcement officers in the City of Orange Township Police Department shall be forwarded to the Police Director for posting at least ten (10) days before such services are required. The Police Director may, but is not required to, waive the ten (10) day notice. Any law enforcement officer, when so employed by the City of Orange Township shall be treated as an employee of the City of Orange Township provided, however, that wages earned for outside employment shall not be applied toward the pension benefits of law enforcement officers, so employed, nor shall hours worked for outside employment be considered in any way compensable as overtime.
D. 
Rates of compensation; administrative fee; payment for services.
(1) 
Rates of compensation for contracting the services of off-duty law enforcement officers shall be established by ordinance adopted from time to time by the governing body. The current rate of compensation shall be as follows:

(2) 
Cancellation. In the event that the person or entity requesting the off-duty law enforcement officers fails to contact the City of Orange at least four hours prior to the scheduled start time to cancel the job, or the officer works less than four hours and the job is completed, the officer is entitled to be paid for the minimum of four hours.

(3) 
An additional fee will be established by ordinance adopted from time to time by the governing body to cover administrative costs, overhead, equipment utilization and out-of-pocket expenses for the City of Orange Township.
(4) 
All other Ordinances or portions of Ordinances inconsistent herewith are hereby repealed to the extent of their inconsistency only.
(5) 
If any part of this Ordinance shall be declared to be invalid or inoperative, such part shall be deemed severable and the invalidity thereof shall not affect the remaining parts of this Ordinance.

A. 
Purpose. To create a partnership between the Orange Police Department and the various religious leaders of the City of Orange and surrounding towns to provide enhanced policing and spiritual services to the service population.
B. 
Policy. The Orange Police Department recognizes the influence and impact that faith-based leaders have in people's lives within the community. The Department will work together in a partnership with qualified religious leaders, regardless of denomination, who are available to respond during a crisis or in time of need in providing a more personalized quality of service to the community. The religious leaders will perform tasks of a more spiritual nature while the officer addresses those tasks that are of law enforcement nature.
C. 
Definitions.
POLICE CHAPLAIN
In accordance with N.J.S.A. 40A:14-141 a volunteer, ordained member of the clergy in good standing from the religious body from which he or she is selected who is available to provide spiritual help, guidance and counseling.
POLICE CHAPLAIN COORDINATOR
A volunteer Police Chaplain who directs programs or events associated with the Police Chaplain Program.
POLICE CHAPLAIN LIAISON
A member of the command staff, designated by the Police Director, who administers the Police Chaplain Program for the department.
D. 
General procedures.
(1) 
Qualifications.
(a) 
Candidates for Police Chaplain must be a duly ordained clergy member with a degree from an accredited institution. The candidate must be in good standing and an active participant in his or her church, parish, synagogue, or temple and be presently affiliated with a duly recognized religious place of faith located within Orange.
(b) 
Police Chaplains shall conform to all police procedures and departmental regulations, insofar as applicable, and shall be credentialed in accordance with the provisions of N.J.S.A. 40A:14-141.
(c) 
Police Chaplains shall demonstrate compassion and understanding for fellow human beings and be tactful and considerate in their approach to all people, regardless of race, creed, religion or national origin.
(d) 
The Police Chaplain Program is a volunteer service, without rank or salary. The candidate shall be available to serve in an on-call status, with a minimum availability to be determined based on the number of members enrolled in the program.
(e) 
Police Chaplains shall maintain high spiritual and moral standards and honor and abide by the seal of confessions and confidentiality.
(f) 
Police Chaplains shall complete the required training and orientation before being accepted into the program, and also complete regularly scheduled in-service training to remain active.
(g) 
Police Chaplains must possess a valid New Jersey driver's license and pass a criminal history and background check completed by the Police Department.
(h) 
Police Chaplains must not be under indictment, on bail pending court, parole, probation, or in any way be associated with any current criminal court proceedings, or convicted of any offense involving moral turpitude.
(i) 
Police Chaplains may not be in support or involved in any questionable activity or subversive activity against the government entity.
(2) 
Duties and responsibilities.
(a) 
Police Chaplains shall serve a law enforcement related community support service function. Police Chaplains are not sworn officers and do not have the authority to make a full custody arrest. Police Chaplains are not authorized to physically interfere with law enforcement matters.
(b) 
Police Chaplains accept the responsibility to foster integrity and honor with the agency and community and execute his or her duties with a professional demeanor.
(c) 
Police Chaplains shall be requested to perform the following duties and any other duties that may be assigned by the Police Director:

Assist the Department in making notifications to families concerning serious injuries or death;
[2] 
Visit sick or injured Police Department personnel at home or in the hospital;
[3] 
Attend and participate in funerals of active and retired members of the Department;
[4] 
Counsel police personnel regarding personal problems and stationhouse adjustments;
[5] 
Coordinate and conduct memorial services;
[6] 
Participate in in-service training programs;
[7] 
Attend departmental functions such as graduations, promotions, and award ceremonies;
[8] 
Assist in programs and counseling targeted at youthful offenders;
[9] 
Assist in enhancing public relations and community outreach;
[10] 
Meet with the Police Director and other police personnel on a regular basis for the purpose of ongoing evaluations, development of programs, and discussion of departmental morale.
(d) 
Police Chaplains will not wear a uniform or police related clothing that will give the appearance to the public that they are a sworn police officer. Police Chaplains shall wear clothing representative of their faith or proper attire.

The Police Director may issue each Police Chaplain garment(s) identifying them as a Police Chaplain.
[2] 
Each Police Chaplain shall also be issued an Orange Police Department photo identification card and badge that must be worn at all times when activated into service.
E. 
Appointment and term of office.
(1) 
The Police Director shall recommend to the Mayor persons he or she believes meet the qualification of N.J.S.A. 40A:14-141, the Rules and Regulations of Orange with relation to police chaplains and Orange Police Chaplain Policy Chapter 6:59, if any.
(2) 
The Mayor shall appoint Police Chaplains in accordance with this policy, with the advice and consent of the City Council.
(3) 
A person appointed as a Police Chaplain shall serve at the pleasure of the Police Department, and for a period of one (1) year from the date of appointment and shall continue to serve in that capacity until he or she resigns, is terminated, or reappointed by the Council at the recommendation of the Police Director.
(4) 
Notwithstanding the foregoing, the position shall be an "at will" position and the appointment of Police Chaplain may be terminated without cause.
F. 
Activation procedure.
(1) 
The Police Chaplain Coordinator will work with the Police Chaplain Liaison to create and maintain a duty list of availability for the chaplains.
(a) 
The list will consist on an on-call Police Chaplain and a back-up Police Chaplain who are available to respond in a time of crisis or need.
(b) 
The list will follow a 24/7 concept and will be made available to Orange Police Department and the shift supervisors.
(2) 
The shift supervisor will determine when a Police Chaplain is needed and utilize the on-call list to activate the Police Chaplain response in the emergent situation. If the on-call Police Chaplain is not available, the backup Police Chaplain shall be contacted. If the on-call and back-up Police Chaplains are not available, any available Police Chaplain from the list shall be requested.
(a) 
If the involved person(s) discloses his or her specific faith or requests to speak with a specific member of the clergy, the supervisor may forego the above process and contact a representative of that faith or the specific clergy member directly.
(3) 
The shift supervisor will direct the Police Chaplain to respond to the location where the service is to be provided. The Police Chaplain is authorized to be present for support and guidance to the involved person(s) during the course of their duties and responsibilities. If requested, the Police Chaplain will also assist the involved person(s) in contacting a representative of their religious faith for additional support if the faith is different from the responding Police Chaplain.
(4) 
The shift supervisor will be responsible for the physical safety of the Police Chaplain. While risk of injury is an inherent part of police work, care is to be given as to not place the Police Chaplain in the way of undue harm.
G. 
Training.
(1) 
The Department shall provide Police Chaplain's training in those duties which they are authorized and assigned to perform.
(2) 
Prior to appointment, each Police Chaplain candidate must attend and successfully complete a Basic Police Chaplain Training Course approved by the Police Director.
(3) 
Upon appointment, each Police Chaplain shall receive orientation training consisting of a review of the rules and regulations and policies and procedures of the Orange Police Department.
(4) 
The orientation training shall also contain a block of field training instruction on the various incident and tasks handled by the Department. Emphasis will be placed on the Police Chaplain's role as a support function and will aid the Police Chaplain in knowing what to expect from members during a particular situation to assist in a support capacity.
(5) 
Upon completing the orientation training, the Police Chaplain shall then schedule a ride-along session with a Field Training Officer or supervisor to personally experience the nature of police work. Each Police Chaplain will be required to complete a ride along at least once annually thereafter.
(6) 
All the Police Chaplains will meet as a group at least semi-annually to receive updated instruction on updated policies and procedures from the Police Chaplain Liaison. These meetings will give Police Chaplains the ability to network with each other and discuss ideas and/or concerns with the program.
(7) 
All training shall be coordinated by the Police Chaplain Coordinator and Police Chaplain Liaison.
H. 
Confidentiality.
(1) 
All police information shall be considered confidential in nature. Police Chaplains shall not release or discuss confidential information to anyone.
(2) 
Each Police Chaplain shall be required to sign a nondisclosure agreement. Subsequent disclosure of any confidential information verbally, in writing, or by any other means or media shall be grounds for immediate dismissal and possible criminal prosecution.
(3) 
Police Chaplains shall hold to the "Seal of Confession" without exception. They should not surrender to subpoena, and they should not testify in a court of law, consult with anyone professional or otherwise in any way that might jeopardize the seal of confession, even at risk of personal or professional harm.
(a) 
Any conversations held that indicate criminal activity of the part of the person speaking to the Police Chaplain are not privileged conversations, and that information is to be relayed immediately to a member of the Orange Police Department as required by law.
(4) 
Privileged communication not regarded as confessional in nature should be regarded as highly confidential material and should only be revealed with the consent of the person involved. It is not the intent of the Orange Police Department to use Police Chaplains as a tool to solicit criminal confessions. Confidential information should only be revealed when it is assumed the revelation is for the greater good of the individual.
