Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

a. The
Chief of Police or, in his/her absence, disability or inability to
act, the ranking member of the Police Department, is hereby authorized
to provide by regulation for the closing of any street or portion
thereof to motor vehicle traffic on any day or days whenever he/she
finds that such closing is necessary for the preservation of the public
safety, health or welfare.
b. Any
regulations promulgated by the Chief of Police, and in accordance
with paragraph a. above, shall provide for the posting of proper warning
signs of such closing on any street or portion thereof during the
time the same is closed in pursuance thereof.
c. Any
violation of this regulation promulgated thereunder shall be punished
by a fine not to exceed fifty ($50.00) dollars.
d. Any
regulation adopted that mandates the closing of any street for a period
greater than forty-eight (48) consecutive hours shall not become effective
unless and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any Police Officer may provide for the removal of that vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute
or in this chapter, every person convicted of a violation of a provision
of this chapter or any supplement thereto shall be liable to a penalty
of not more than fifty ($50.00) dollars or imprisonment for a term
not exceeding fifteen (15) days or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

All former traffic ordinances of the Borough of Roseland are
hereby repealed, and all ordinances or parts of ordinances in conflict
with or inconsistent with the provisions of this chapter are hereby
repealed, except that this repeal shall not affect or prevent the
prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.

The Governing Body hereby finds and declares that problems of
traffic control occur and traffic must be moved through or around
street construction, maintenance operations, and utility work, above
and below ground which requires blocking the roadway and obstructing
the normal flow of traffic; and that such obstructions are or can
become dangerous when not properly controlled. In order to better
promote the public health, safety, peace and welfare, it is necessary
to establish controls and regulations directed to the safety and expeditious
movement of traffic through construction and maintenance zones and
to provide safety for the work force performing these operations.
The Borough of Roseland, in the County of Essex, State of New
Jersey, does hereby adopt the current Manual on Uniform Traffic Control
Devices hereafter known as M.U.T.C.D., except as hereby supplemented
and amended, as it controls and regulates whenever construction maintenance
operations of utility work obstructs the normal flow of traffic. Any
person, contractor, or utility who fails to comply with the provisions
of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or
in the case of a public utility as required under a public utility
agreement, wishing to conduct work on, under or above the roadway
to contact the Police Department in order to arrange a preconstruction
meeting in order to submit plans for the safe movement of traffic
during such period of construction work. Any person, contractor or
utility who fails to comply with this section prior to the start of
such work or whose plans are not approved by the Police Department
is in violation of this section.

The person, contractor, or utility shall provide the Police
Department with at least two (2) emergency contact phone numbers to
be called in case of emergency problems at the construction or maintenance
site prior to the start of any work. If for any reason emergency contact
cannot be reached, or if the emergency contact person does not respond
to the call from the Police Department to correct a hazardous condition,
the Borough may respond to correct such hazardous condition. The reasonable
fees for such emergency service by the Borough shall be charged to
the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility
work on any roadway in the Borough before the hour of 9:00 a.m. or
after 4:00 p.m. This time limit may be adjusted to permit work prior
to 9:00 a.m. or after 4:00 p.m. by the Officer in charge of the Police
Department. If it is determined by the Officer in charge that the
construction or maintenance operations prior to 9:00 a.m. or after
4:00 p.m. would substantially delay traffic or cause a safety or health
hazard, the work shall then be permitted only between 9:00 a.m. and
4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless
approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance
sites when determined by the Police Department that same is necessary
to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work,
including the removal of equipment and vehicles, stored material within
the street right-of-way, backfilling of open excavations and/or other
related work, in order to abate any nuisance and/or safety hazard
or for any violation of this section.

It is to be expressly understood that no materials, vehicle
or equipment are to be placed in the roadway or sidewalk or until
all construction, signs, lights, devices and pavement markings are
installed.

Any person, contractor or utility who commits a violation of
this section shall, upon conviction thereof for a first offense, pay
a fine of not less than one hundred ($100.00) dollars nor more than
five hundred ($500.00) dollars and/or be imprisoned in the county
jail for a term not exceeding ninety (90) days. For a second offense,
the person, contractor or utility shall, upon conviction thereof,
pay a fine of not less than two hundred and fifty ($250.00) dollars
and/or be imprisoned in the County Jail for a term not exceeding ninety
(90) days.
A separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

In accordance with N.J.A.C. 7:27-14, 15, a person who, while
operating a commercial, diesel motor vehicle with its engine running,
shall not maintain the commercial, diesel motor vehicle in a stationary
position for more than three (3) minutes. A person violating this
section shall be fined not less than ten ($10.00) dollars nor more
than twenty-five ($25.00) dollars for each offense.

a. Upon
the declaration of an emergency, there shall be no parking upon streets
or sections of streets where temporary EMERGENCY NO PARKING signs
are displayed. The Chief of Police or, in his/her absence, the ranking
Police Officer is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
b. The
effectiveness of this subsection is contingent upon the signs being
erected as required by law.
c. Any
unoccupied vehicle parked or standing in violation of this subsection
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal, before regaining possession
of the vehicle.

a. Whenever snow has fallen and the accumulation is such that it covers
the street or highway, an emergency shall exist and no vehicles shall
be parked on the streets or highways or portions thereof listed below.
The parking prohibitions listed below shall remain in effect
after the snow has ceased, until the streets have been plowed sufficiently,
and to the extent that parking will not interfere with the normal
flow of traffic.

b. Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal before regaining possession
of the vehicle.

a. The Borough of Roseland hereby determines to install and utilize
a traffic control signal monitoring system ("System") at the intersection
of Eisenhower Parkway and Eagle Rock Avenue.
b. The System to be installed shall be approved by the Borough Council
by resolution.
c. The Borough shall have the authority to enter into a contract, following
a lawful procurement process, for the installation of the System.
Any contract that shall contain provisions contrary to the Act shall
not be deemed invalid but rather shall conform or be modified so as
to conform to the Act.
d. Signs shall be created by the Borough and shall be approved by the
Municipal Engineer, notifying drivers that the System is being utilized
at a specific location within the Borough. Such signs shall be placed
on each street converging into the affected intersection as required
by the Act.
e. A vendor contracting with the Borough concerning the installation
and use of a System shall establish a public awareness campaign to
notify the public of the intersection at which the system will be
installed and of the date on which the system will be activated. The
public awareness campaign shall, at a minimum, utilize electronic
and print media and shall make available electronically on an Internet
website, certain information required under the Act.
f. The Municipal Engineer shall inspect and certify the System at least
once every six (6) months from the date of its installation.

The Police Department of the Borough of Roseland shall review
the recorded images produced by the System to determine whether sufficient
evidence exists to conclude that a traffic control signal violation
has occurred and shall issue, within ninety (90) days from the date
on which the violation occurred, a summons when appropriate to be
served by a law enforcement official in accordance with the Rules
of the Court.

a. Except as otherwise provided in this section, the recorded images
produced by the System shall be available for the exclusive use of
the Police Department for the purpose of discharging his or her duties
under the Act.
b. Any recorded image or information produced in connection with the
System shall not be deemed a public record under N.J.S.A. 47:1A-1
et seq., or common law. The recorded images shall not be: (i) discoverable
as a public record by any person, entity, or governmental agency,
except upon a subpoena issued by a grand jury or a court order in
a criminal matter, or (ii) offered as evidence in any civil or administrative
proceeding not directly related to a traffic control signal violation.
c. Any recorded image or information collected in connection with a
traffic control signal violation shall not be retained after sixty
(60) days following the collection of any fine or penalty.
d. If a summons is not issued within ninety (90) days following the
alleged traffic control signal violation, all recorded images and
any information collected with respect to the alleged traffic control
signal violation shall be purged by the Police Department within three
(3) days.

a. The owner and operator of a motor vehicle shall be held jointly liable
for a traffic control signal violation summons issued pursuant to
this section subject to provisions of the Act.
b. Any person liable for a traffic control signal violation, pursuant
to the section and the Act, as determined by use of the System, shall
be subject to the following fines or such fines as otherwise determined
by the Administrative Office of the Court and/or the Municipal Court
of the Borough of Roseland.
c. Unless modified by the Legislature or the NJDOT, in no case shall
motor vehicle points or automobile insurance eligibility points pursuant
to section 26 of P.L. 1990, c.8 (N.J.S.A. 17:33B-14) be assessed against
any person for a violation occurring under the provisions of the Act.
d. Whenever use of the System results in the collection of a fine for
violating N.J.S.A. 39:4-81 (failure to obey instructions of any official
control device), the full amount of such fine assessed by the Municipal
Court, less any applicable fees due, shall be paid to the Borough
of Roseland Financial Officer.
