No person shall sell or attempt to sell at public auction within the city any goods, chattels or other property of any kind or description whatsoever without being first licensed under this chapter as an auctioneer.
A. 
No person shall be licensed as an auctioneer unless he is of good moral character and is duly qualified and prepared for transacting the business of an auctioneer; nor unless, in the opinion of the Director of the Finance Department, upon the written approval of the Chief of Police, the Fire Chief, the Director of the Health and Welfare Department and the Building Inspector, the licensing of such person will be conducive to the public good.
B. 
The license fee to be paid for such license shall be as provided in Chapter 88, Fees.

Every license which is granted to an auctioneer shall authorize him to carry on such business, but on special occasions he may act as an auctioneer at any other place where his services may be required.
All sales at public auction within the city shall be made by a licensed auctioneer.
No licensed auctioneer or other person shall sell or attempt to sell at public auction any goods, chattels or other property of any kind or description whatsoever in or upon any street or sidewalk in the city without the special permission of the Chief of Police.
Nothing contained in this chapter shall be held to apply to sales made at public auction under or by virtue of any statute or law.

Any person who violates any of the provisions of this chapter shall, upon conviction thereof, be subject to a fine not exceeding five hundred dollars ($500.) or imprisonment for a period not exceeding ninety (90) days, or both.
